NCAA Legal Matters:

+ U.S. Ninth Circuit Court of Appeals Judges Kim McLane Wardlaw and Jacqueline Hong-Ngoc Nguyen have denied the NCAA’s request for an interlocutory appeal (an appeal before a final judgment in a case) of House v. NCAA case before it heads to trial. Sportico’s Michael McCann and Daniel Libit: “Such appeals are rarely granted. Appellate courts strongly prefer to review cases only after a final judgment on the merits, and this case is not scheduled for a jury trial until 2025. The basic logic: A final judgment offers a completed matter to review, while an interlocutory appeal concerns only a preliminary or incomplete matter.” The NCAA had previously warned that “denial of this petition would be the death knell of the litigation.” McCann & Libit also note that plaintiffs’ attorneys “successfully argued the NCAA failed to identify the necessary ‘extraordinary’ circumstances for an interlocutory appeal and questioned the NCAA’s insinuation it would struggle to pay.” From their brief: “More than $7B in annual revenue attributed to P5 public schools alone ought to be enough to cover defendants’ litigation costs.” (link)

+ The U.S. Department of Justice joined the multistate lawsuit led by Ohio Attorney General Dave Yost which challenges the NCAA’s transfer eligibility rule as an illegal restraint on college athletes’ ability to sell their image and likeness and control their education. The states of Minnesota, Mississippi and Virginia, as well as the District of Columbia, have also joined the suit, bringing the total number of attorneys general who are backing the litigation to 11. Yost: “There is strength in numbers. This case would never have come to pass had many players not been sidelined by the NCAA’s arbitrary and unfair rule. We’re fighting for better competition and long-term change.” (link)

Central Oklahoma promotes AD Stan Wagnon to VP. President Todd Lamb: "He will join the University Cabinet, serving as a strong voice for our student-athletes and Athletics programs in conversations regarding UCO's strategic direction.” (link)

Former Minot State AD Kevin Forde was the subject of an outside investigation by Special Assistant Attorney General Meredith Vukelic that led to his resignation last week. The investigation began after a complaint filed in October and found multiple reports of unwanted touching of employees and looked into claims of differing treatment of female and male coaches, with three females coaches being placed on leave due to accusations of mistreating student-athletes while no male coaches were placed on leave as one was accused of “inappropriate use of social media” and another of “wagering with another college’s male athlete about sex with a female MSU athlete.” The actions did not violate Title VII or Title IX standards, but did violate university and State Board of Higher Education policies. President Steven Shirley: “We will certainly learn from this experience and these findings to improve MSU. It is imperative we ensure our workplace environment is the absolute best, fairest, and most productive it can be for every employee who is part of the MSU family. We have nearly 400 full-time employees at Minot State, along with hundreds of part-time employees, and every one of them deserves to be and must be treated with respect and fairness. I want to thank the individuals who shared their concerns and participated in this investigation. This recent history of events in MSU Athletics, while painful and challenging, is also an opportunity for us to learn and strive to improve, and as a team we will move forward together.” (link)

NCAA SVP of Championships Joni Comstock announces her retirement, effective March 1. Comstock’s 44-year career in athletics includes the last 17 in her current leadership role with the NCAA as well as AD stops at American (DI) and UNC Asheville (DI). (link)

+ During yesterday's NIL Playbook: Proposal to Protect Student Athletes’ Dealmaking Rights congressional hearing, NCAA President Charlie Baker during his testimony indicated that losing the Johnson v. NCAA case would “cost us about half to two-thirds of all the college sports programs around the country." Also from Baker: “If you convert all of college sports into employment, there is simply no doubt, based on math, that you will lose an enormous number of student-athlete opportunities. The money is just not there. Most schools lose money on sports."

+ A key tweet from Yahoo’s Ross Dellenger: “The most noteworthy thing to emerge from the college sports hearing happened afterward, when Rep. Lori Trahan (D-MA) said she doesn't believe Congress will come to a consensus on granting employment exemption & antitrust to the NCAA. "That is not going to pass both chambers. … This Congress just doesn’t seem like the Congress where we’re going to have a lot of bipartisan wins. These are big thorny, tough issues. I’m not optimistic that this is going to be a Congress where we figure out college athletics at large." (link)

+ Dellenger adds some context to U.S. Congresswoman Lori Trahan’s (D-MA) comment yesterday in which she indicated she was “not optimistic that this is going to be a Congress where we figure out college athletics at large.” Dellenger notes Trahan’s remarks come from “one Democratic lawmaker from one chamber of Congress. In the Senate, Sens. Ted Cruz (R-TX) and Cory Booker (D-NJ) have been engrossed in negotiations over a compromise piece of legislation. In fact, in September, Cruz himself proclaimed that there was a 60% chance that a bill passes this Congress.” (link)
