Labor law expert Eddie Bonett, who spent 22 years in the Philadelphia NLRB office, joins Optimum Sports to talk about what happens next in the Dartmouth (NCAA DI) case and explains the right-to-control test used by the board “may open things to others who are controlled by universities, people like theater majors, who have to put on a show and the university controls their hours. … It may cause them to look for some other test that tightens this up a little bit. Simply using this test, you could take this down to big high school programs – big high school football and big high school basketball schools.” If the current decision is upheld, Bonett notes Dartmouth could refuse to bargain and do a test of cert. “That would go to the district courts, and maybe even up to the Supreme Court. Then, whatever the court says is going to be the guidance for the future. The Board decision would be precedential across board cases. A university would probably try to distinguish this, in terms of the control, but any similar programs are going to run into the same issues. Now, you may have a D3 school that tries it, and they won’t have the same level of control, so maybe that’s a case where the student athletes are not employees under this decision.” More from Bonett. UHSP Women’s Basketball student-athlete Grace Beyer gets the profile treatment as she nears the all-time college scoring record of 3,855. Her journey to UHSP was driven by her desire to become a pharmacist and go to college to position herself for a successful career. Bayer: “I have a lot of friends that went to bigger D-I schools and wanted to do something in the healthcare field. Their coaches straight up said no you’re not doing that. That’s kind of how it is when you go to bigger colleges. Basketball is your job. Basketball is your life. I quickly realized that maybe D-I isn’t for me. […] I’ve definitely thought of the what-ifs. What if I did go to a D-I school? Where would I be? But it’s never really been a serious conversation. I’m really happy with my decision to come here.” On the growth of the sport: “Women’s basketball has usually been on the backburner to men’s basketball and it’s been exciting to get the recognition that women’s sports deserves. Caitlin Clark has elevated the women’s basketball game and kind of put it on the forefront of college basketball. And it’s exciting for future women’s college athletes and it’s just a good time to be a part of women’s college basketball.” Bayer is 54 points away from the record, with a pair of regular-season games left for the Eutectics, and on track to graduate in 2025 with her doctorate. Louisiana Christian Football HC Drew Maddox resigns to accept an AC position at Southeast Missouri State (NCAA DI). LCU President Rick Brewer: “Since the day I met Coach Maddox in 2015 I knew he would one day serve as our head football coach. I'm grateful for the Christian leadership he modeled for the young men and coaches under his tutelage. Indeed, Coach Drew Maddox is a steward leader…he left our football program much better than he found it.” (link)

ESPN’s Outside the Lines zeroes in on the meteoric rise of sports gambling since 2018, during which time advertising spend on the industry has increased from $22.9M per year to $360M per year as the number of states to legalize sports betting has increased from four to 40. U.S. Congressman Paul Tonko (D-NY) would like to explore a prohibition on advertising aimed at more vulnerable populations, much like the limits that have been placed on the tobacco industry. “I think we need to take a closer look at this because it could be a public health crisis that grows in tremendous dimension.” American Gaming Association President/CEO Bill Miller disagrees that gambling poses a type of public health crisis. “I think that we are facing is a migration of the American sports bettor who had no legal opportunities to bet on sports into the safe regulated marketplace.” (link)
