More from Colorado-Colorado Springs AD Nathan Gibson at the 2024 NCAA Convention on the latest from DII Championships Committee and UCCS. On the prospect of more data tools for committees to use to evaluate selections, Gibson notes there is intrigue around DIII’s exploration of implementing a PairWise ratings system in a larger application than just hockey, adding: “I always hesitate to say any one size fits all because there will always be sports that want different things, but can we get, like I said before, more technology or something in people's hands that will make it easier to get it right and also just to simplify some of the processes.” He goes on to assert that, in general, there may be a need to encourage out of conference or region competition to assist with the success of certain data tools, while not overlooking the budgetary or scheduling limitations. On-campus, Gibson is proud of the work of the Mountain Lion Strong program – UCCS’ peer-led mental health wellness program, which was recognized at convention. On his tenure: “I feel like I spent kind of the first handful of years as athletic director at UCCS just kind of building. We built new facilities. We built up some of our programs. We've added some programs. Now it's really about how do we kind of get back on track with adding resources and support to our team so that we can operate at a higher level and provide more support for our student-athletes.” Full conversation on Connect. Labor law expert Eddie Bonett, who spent 22 years in the Philadelphia NLRB office, joins Optimum Sports to talk about what happens next in the Dartmouth (DI) case and explains the right-to-control test used by the board “may open things to others who are controlled by universities, people like theater majors, who have to put on a show and the university controls their hours. … It may cause them to look for some other test that tightens this up a little bit. Simply using this test, you could take this down to big high school programs – big high school football and big high school basketball schools.” If the current decision is upheld, Bonett notes Dartmouth could refuse to bargain and do a test of cert. “That would go to the district courts, and maybe even up to the Supreme Court . Then, whatever the court says is going to be the guidance for the future. The Board decision would be precedential across board cases. A university would probably try to distinguish this, in terms of the control, but any similar programs are going to run into the same issues. Now, you may have a D3 school that tries it, and they won’t have the same level of control, so maybe that’s a case where the student athletes are not employees under this decision.” More from Bonett. Western Oregon has canceled the rest of its Women’s Basketball season citing “internal team challenges. The decision reflects a commitment to addressing and resolving issues impacting the program. Importantly, the athletic department makes it clear the internal challenges leading to the season cancellation are not related to Title IX matters.” All impacted contests will be counted as forfeit losses. AD Randi Lydum: “This difficult choice is disappointing for all parties involved, and we acknowledge the impact on the athletes, coaching staff and the broader university community. The decision to cancel the season aligns with the highest standards of integrity and accountability within our program. We are committed to the success of players and coaches at Western and are taking proactive steps to that end.” ( link, link)

LeMoyne-Owen will add Men’s Volleyball in 2024-25, thanks in part to a $75K grant from First Point Volleyball Foundation paid out over three years. LOC plans to offer the maximum 4.5 scholarships for the upstart program. Interim President Christopher Davis: “This generous support propels us further toward the formidable institution we all know LeMoyne-Owen can be. This enriches our campus community and provides invaluable opportunities for our student-athletes. This grant marks a pivotal moment in our journey toward athletic excellence and holistic student development.” (link)

A bill in Oregon that would prohibit the NCAA , conferences and any other athletics governing body from punishing an athlete or school for violating NIL rules is headed to the House floor. The bill also provides liability protection for universities and their employees “for any damages to a student athlete’s ability to exercise the student athlete’s (NIL) rights due to any decision or action” by the school or any of its employees that is “routinely taken in the course of intercollegiate sports” or is “part of identifying, facilitating, enabling or supporting opportunities for the current student athlete to exercise the student athlete’s” NIL rights at the school. Representative Zach Hudson (D-Troutdale) offers a hypothetical scenario: “Let’s say a student is making money off of [an NIL] deal. Let’s say that student has some accusation against them and the college kicks them off a team — let’s say for a weapons charge or something. It turns out that that charge was false. It turns out that the college should have known it was false and didn’t do their due diligence to make sure it was a legitimate complaint. But the student has still lost tens of thousands of dollars from the actions of the college. If the student were to sue the college for what they did in that scenario, would a judge dismiss that case based on what’s in the bill?” That scenario will likely be the subject of debate on the House floor. Oregon, Oregon State, Portland and several other universities in the state have voiced support for the bill. ( link)

Renaissance Search & Consulting founder Herb Courtney gets the profile treatment from The Athletic’s Tashan Reed. Courtney, who started the business in 2020 to remedy the lack of diversity he saw in both business recruiting and athletics, believes “A lot of times, there’s a lot of great candidates out there that don’t have access. I wanted to bring a positive change to industries that traditionally have excluded a lot of people. And so, that was our purpose.” On being one of the only black-owned search firms, Courtney: “It really hasn’t been done in terms of being commonplace, and so I don’t take that lightly.
