NCAA Legal News:

+ Hagens Berman attorney Steve Berman expects the full House settlement agreement to be filed on Friday: “We’re very close to wrapping. The amount of disputes right now are tiny.” Berman also tells the AP’s Ralph Russo the defendants have asked for the dismissal of Houston Christian’s (DI) pushback: “There’s no publicly filed agreement to be challenging at the moment. So we thought it was premature, among other defects.” More: “So the way this is going to work out is that at some point like 60, 70 days from now, after the notice goes out, if you’re an athlete, you’ll be able to get on a website and put your name in and the website will tell you how much you’re going to get out of the settlement.” (link)

+ Houston Christian’s motion to intervene in the proposed House settlement has been denied by U.S. District Court Judge Claudia Wilken. Wilken writing: “HCU’s arguments in support of its motion for intervention are essentially objections to the settlement agreement, which are premature because the settlement agreement has not yet been filed. But even if they were not premature, the Court would not consider them because HCU, as a non-class member, lacks standing to object to the settlement agreement. Accordingly, HCU may not re-package the arguments it made in support of the present motion to intervene as objections to the settlement agreement once the settlement agreement is filed for the Court’s approval.” (link); In response, Houston Christian attorney James Bryant tells Sportico’s Daniel Libit: “Obviously, we respect the judge and know she spent a lot of time trying to apply the law correctly. We don’t believe we have been heard. There are avenues we may be heard in and a possibility of further litigation at other times and places.” (link)

+ Boise State (DI) law professor Sam C. Ehrlich via X (Twitter): “Interesting circumstances afoot in Fontenot v. NCAA...The plaintiffs filed an amended complaint adding 3 new members: Deontay Anderson (ex-Houston (DI)/Ole Miss (DI) football), Tucker Clark (current Colorado (DI) golfer), & Sarah Fuller (former Vanderbilt (DI) soccer **& football**).” Ehrlich also points out an addition to the pleading: “105. Defendants realize that there is no longer any defense for the concept of amateurism. They recently voted to move forward with a proposed settlement in the House case that would usher in a form of “revenue sharing” that ostensibly would be tied to NIL payments made by the NCAA’s members. But even if that settlement is approved, it would simply usher in a new, artificially low cap that is far below the revenue sharing that a competitive market would yield. While it is an admission that amateurism is not needed, it also simply substitutes one illegal price fix for another. 106. This case seeks to recover the full amount of compensation that these athletes truly deserve, and to enjoin Defendants from enforcing their illegal agreement in the future. It is not just about NIL but is about full revenue sharing.” (link)

New West Texas A&M AD Doug Lipinski was introduced today and sat down with Press Pass Sports’ Kale Steed about his decision to take this job, his vision for the Buffs and more. On what drew him to the opportunity: “People always talk about the fit, and WTAMU was truly a fit. The programs here are all successful and the academics are top notch, and the school has great facilities. It was a great interview process and having an impact on the institution as well as athletics was a big selling point to me.” How will he evaluate coaches? “I think we have the best coaches in the country in all sports. We’ll be evaluating everything and the way we go about evaluating from A-Z is the student-athlete experience. We want the best for our student-athletes. It’s about teaching and if we are good teachers. It’s not always about wins or losses. At the end of the day, it’s about the student-athletes.” More. MIAA Commissioner Mike Racy chats with Griffon Sports Insider’s Tommy Rezac at MIAA Football Media Day about the future of DII membership and more. Racy says league presidents are in a hovering pattern on membership as a number of issues remain unresolved at the DI level, adding the “MIAA is open for business” as DI schools may look to move to DII. Further: “I’m fairly confident from the conversations I’ve had with all of our presidents there’s still a great appetite to grow the MIAA. There’s a belief that bigger is better. The more, the stronger we are, but also a commitment to do that makes geographic sense and where we’re adding schools like a Fort Smith that look like our current members, a regional public institution.” (link); More from Racy from media day: “There seems to be a growing disconnect among Division II members and even representatives serving on Division II committees and governance regarding the unique nature of the sport of football and the significant investment and commitment necessary by MIAA schools and several other conference members to sponsor the sport. Football has always held a special place in the landscape of American higher education. To sponsor football in Division II requires a considerable commitment of scholarships, coaching staff salaries, support staff, infrastructure investments and maintenance costs. With a football roster of approximately a hundred student-athletes each year, there are additional expectations on campus professionals for compliance and academic advising. There is simply no other intercollegiate sport which compares to football in any NCAA division. Although we can draw some parallels to issues in a few other sports, many of the challenges presented in sponsoring football remain unmatched in American higher education. The MIAA strongly encourages the division’s leadership groups to remove any proposal from consideration that would eliminate the Division II football-only vote from further consideration.” (link)

Pace joins forces with U.S. Men’s National Team standout Tyler Adams to secure a $500K gift from Kenda Sports Group and re-launch its Men’s Soccer program starting in the fall of 2025. AD Mark Brown: "We are excited to bring men's soccer back to Pleasantville and thank Kenda Sports Group for their visionary gift and support to lead this initiative. The addition of men's soccer will allow us to again compete in the world's most popular sport and bring even more excitement to our campus for students, faculty, staff, alumni, and the surrounding Pleasantville community." USC Aiken AD Todd Wilkinson says the Lady Pacers’ Softball facility is on target to be complete in September, adding: “The facility that we’re building is made for softball. It’s gonna be a synthetic turf field– Satcher field is actually repurposed from a baseball field into a softball field. So, the dugouts are originally set up for baseball, and they weren’t quite at the angle they needed to be and the dimensions may have been a little awkward. But this field is being built right from the start as a softball facility, and a first-class softball facility for sure.” (link)
