The AP’s Newberry observes that the NCAA has been uncharacteristically quiet “as one Republican-controlled state after another rushed to pass laws that supporters hail as a war on ‘wokeness,’ even as critics deride them as exclusionary and a step backward in human decency. SEC (DI) Commissioner Sankey submits the NCAA must be “wise” in its positioning, and TVP Communications Principal Parrott adds: “If they're saying that student athletes have the right to choose where they go to school, how they earn NIL money, how they use the transfer portal. It's going to be interesting to see what happens when they choose to hold events in locations that don't allow, let's say, women making a decision about the autonomy of their own bodies. […] It's going to be interesting to see if any of this influences where student athletes enroll and where they don't." (link)

State Legislative Matters:

+ California Senate President Pro Tempore Atkins (D-39) has introduced a bill that would end California’s travel ban to 23 states with laws it deems as anti-LGBTQ and replace it with an advertising campaign that promotes acceptance for the LGBTQ community in those states. Atkins: “I think polarization is not working. We need to adjust our strategy. We know what we need to do, but we need to be able to be there to do it.” (link)

+ The Arkansas House Insurance and Commerce Committee voted to move forward with a bill that would allow high school athletes who have been admitted to or signed a letter of intent to attend an Arkansas college “to enter into a contract and receive compensation for the commercial use of the student-athlete’s publicity rights” immediately. The bill does not address in-state students who commit to out-of-state programs. (link)

Hawai’i Pacific MBB HC Vorderbruegge will step away after 15 seasons leading the Sharks. Vorderbruegge: "I am leaving Hawaii Pacific University and basketball for an exciting new journey. I have so many good memories of HPU and the staff and athletes I have been blessed to work with. I am certain that under the leadership of Dr. Snell, the athletic department is poised to thrive. Morning Consult’s Burns spoke with dozens of sports executives, digital marketers, content creators and other stakeholders to understand how the relationship between Twitter and the sports industry will evolve, and whether or not CEO Musk’s takeover will impact sports fans’ reliance on the platform. Burns notes that half of sports fans said they have used Twitter at least once in the past month, compared with 44% of the general population; 16% of sports fans said they use Twitter multiple times per day, compared with 13% of U.S. adults; and Musk’s tenure “doesn’t appear to have severely impacted the industry’s ad spending on the platform, according to Sensor Tower data, as several sports properties reportedly spent about the same or even more in January as they did in September, prior to Musk’s acquisition.” Lots more data and analysis. + The state of Georgia FY24 budget includes an additional $66M decrease in state funding for the University System of Georgia, with DIIs impacted between $458K and $6.845M. (link)

+ In fall 2022, the undergraduate enrollment decline slowed to 0.6%, according to preliminary data from the National Student Clearinghouse Research, which also shows that four-year public universities’ undergraduate enrollment fell by 0.9%. Meanwhile, undergraduate certificate programs experienced an enrollment increase of 5.5% YoY. Arkansas higher ed professor Miller believes private liberal arts colleges, as well as community colleges, are emphasizing the recruitment of male students in particular, in part by offering more sports participation options. The data seems to back that up, as the number of male undergraduates increased by 1.3% at four-year private, nonprofit institutions, while female undergraduate enrollment increased by 0.1%. (link)
