Lane Kiffin-DeSanto Rollins lawsuit: Judge issues stay in case involving Ole Miss football

The case levied by DeSanto Rollins against Ole Miss and football coach Lane Kiffin has been stayed, according to court documents obtained by the Clarion Ledger on Friday.

The pause in proceedings, ordered by US Magistrate Judge Roy Percy, comes one day after Kiffin and Ole Miss filed a motion to dismiss the lawsuit.

"Under Local Uniform Civil Rule 16(b)(3)(B) '(f)iling a motion to compel arbitration, or a motion asserting an immunity defense or jurisdictional defense stays the attorney conference and disclosure requirements and all discovery, pending the court’s ruling on the motion, including any appeal,'” Percy wrote in the order. "Consequently, the disclosure requirements and all discovery are hereby stayed, and the case management conference is continued, pending a ruling on the motion to dismiss."

Rollins, who Ole Miss says remains part of the football program but has not appeared in a game this season, alleged in a September complaint that Kiffin kicked him off the team in March while berating him over his mental health issues. He is seeking $10 million in compensatory damages from Kiffin and Ole Miss, and $30 million in punitive damages from Kiffin. He is also seeking a temporary restraining order, as well as an injunction reinstating him, based on the following allegations:

  • Racial discrimination on the part of Kiffin and Ole Miss
  • Discrimination on the basis of disability – or perceived disability – on the part of Kiffin and Ole Miss
  • Sexual discrimination on the part of Ole Miss
  • Intentional affliction of emotional distress on the part of Kiffin
  • Negligence and gross negligence on the part of Kiffin and Ole Miss

Kiffin and the university filed their motion to dismiss on Wednesday, contending that Kiffin is "not liable for the intentional infliction of emotional distress," and arguing against the legal validity of Rollins' equal protection, discrimination and negligence claims. Kiffin's legal team also said the US District Court for the Northern District of Mississippi should decline supplemental jurisdiction for Rollins' claims that are based on Mississippi state law.
