Newsy Day from Indianapolis…
+ The DI Council has proposed changes to FBS membership requirements. If adopted, all FBS schools would be required to provide 90% of the total number of allowable scholarships over a two-year rolling period across at least 16 sports, including football. Schools also would be required to offer at least 210 scholarships each year, amounting to no less than $6M. The council also introduced new legislation that would increase the fee to transition from FCS to FBS from $5K to $5M. Additionally, the council approved two membership requirements focused on health and safety. The first will require all DI schools to establish policies and procedures to empower athletics health care administrators with authority to oversee a school's athletics health care. The second mandates that all DI schools attest at least once every four years that they are completing a comprehensive review of the school's support services for mental and physical health, safety and athletics performance. + The DI Legislative Committee has ratified a Committee on Student Athlete Reinstatement decision to amend guidelines for reinstating the eligibility of student-athletes who commit violations relating to sports wagering. For all wagering-related violations reported on or after May 2, the following guidelines will apply: “Student-athletes who engage in activities to influence the outcomes of their own games or knowingly provide information to individuals involved in sports betting activities will potentially face permanent loss of collegiate eligibility in all sports. This would also apply to student-athletes who wager on their own games or on other sports at their own schools. If a student-athlete wagers on their own sport at another school, education on sports wagering rules and prevention will be required as a condition of reinstatement, and the loss of 50% of one season of eligibility will be considered. For all other wagering-related violations (e.g., wagering on professional sports), cumulative dollar value of the wagers will be taken into consideration on a sliding scale. (link)
+ Meanwhile, the DI Council also adopted changes to rules governing transfers. The first will allow transfers who opt not to participate in sports after a coaching change at their second school to continue to receive their scholarships without counting against team scholarship limits. The second exempts a school from being obligated to count the scholarship if the transferring student-athlete does not actually enroll at the school. Additionally, the council introduced a proposal to reduce notification-of-transfer windows from 60 days to 30. (link)
+ Based on recommendations from the Transfer Committee, the DI Council adopted changes to the composition of select sport championship committees and implemented a pilot legislative process which authorizes existing oversight committees in basketball and football to propose and adopt rules changes for items under their purview. If adopted by sport management committees, proposals would ultimately take effect only after they are reviewed by the council during a scheduled quarterly meeting. The council will determine whether to make the process permanent after evaluating it for a year. For all other sports, proposals introduced by the council will be reviewed by the Legislative Committee. Also, the council adopted legislation that incorporates success in the sport into representation on select sport championship committees. In individual sports, at least 25% of each committee will be filled by athletics administrators. In team sports, at least 50% of each committee will be athletics administrators. Power 5 leagues that sponsor a sport at the conference level will be guaranteed access to serve on that sport's championship committee. Approximately 30% of committee members will be selected based on success in a sport. (link)

Stanford, Texas, Ohio State, Virginia and Florida finished first through fifth, respectively, in the final LEARFIELD Directors’ Cup standings. It is the Cardinal’s 26th Directors’ Cup. At the conference level, the SEC led all DI conferences with eight schools in the top 25: Florida (5), Tennessee (6), Georgia (7), LSU (9), Alabama (12), Arkansas (13), Kentucky (18) and Texas A&M (24). Tennessee State will create the first ice hockey program in HBCU history, according to HBCU Gameday’s Gaither, who reports the announcement has been in the works for years. TSU partnered with the Nashville Predators in 2020 for a “$1M in 1 month” campaign, with the Predators donating the first $100K. “The campaign was designed for merit and need-based scholarships and raised nearly $2M for over 500 scholarships.” A year later, TSU retained College Hockey Inc. to conduct a feasibility study. A press conference that will include representatives from the NHL and NHLPA is set for later today. (link)

Notre Dame AD Swarbrick tells The Athletic’s Sampson an apparel decision is coming “probably” in July and says NIL is “part of the conversation but not terribly significant. … We're much more focused on gaining the resources that allow us to do things directly for our students." Swarbrick also indicated Notre Dame has done more fact finding with other schools this round to learn brand experiences with Nike, Jordan, etc. (link); Meanwhile, Front Office Sports’ McCarthy and Christovich report Notre Dame wants to triple its media rights fees to $65M to $75M annually in its next deal, adding: “But if the Fighting Irish want that kind of money, they might have to give up their cherished independence — and finally join a power conference.” Crakes Media’s namesake: “My big-picture thought is that Notre Dame will need a conference to support a three-time bump long term. I think either the Big Ten or SEC would do. Also, don’t rule out a third new conference in several years. A lot of assumptions are falling apart as pay-TV-bundle economics go flat.” (link)

James Madison AD Bourne hints at the possibility of expanding Bridgeforth Stadium’s visitors side if ticket demand continues to increase but notes the situation is complicated and nothing is imminent. “You got Godwin Hall right behind it. That side would have to be demolished. We’d have to start from the ground up. Something most folks aren’t aware of is all the infrastructure of utilities, gas, water electricity. Everything runs between the old stadium and Godwin there in that corridors. … I want to make sure we’ve got a full sellout of the stadium and hopefully there’s a waiting list of people waiting to buy tickets. That’s going to add a lot of seats to that side of the stadium when we do it. We want to make sure there’s sustainable revenue flow there that would support it.” (link)

On3’s Prisbell talks with several industry stakeholders about Texas’ NIL law, which as Prisbell describes it, “enables schools to award collective donors priority points – in apparent violation of NCAA rules – while also providing cover against potential infraction issues related to NIL.” North Carolina AD Cunningham: “I do think that’s becoming more commonplace for people to think that way. It certainly would eliminate one of the challenges, which is donor fatigue, because of the number of calls from the different sources of people looking for support.” Prisbell goes on to observe that the more closely collectives and athletic departments become intertwined, the more the risk increases of running afoul of Title IX. The Grove Collective (Ole Miss) Executive Director Jones: “The Title IX thing is one of those deals where it’s hanging out there, and nobody really knows what to do with it, and they’re scared to death of it.” As such, McGuire Woods attorney Wake advised universities during LEAD1’s spring meetings to “stay out of it. Don’t touch it with a 10-foot pole.” Lots more. (link)

Opendorse projects $1.175B will be spent on NIL in 2023-24, with $595M going to Power 5 football student-athletes, $212.5M going to men’s basketball players and $37M going to women’s basketball players. Group of 5 football student-athletes are projected to take in $83.8M, while their men’s and women’s basketball student-athletes are pegged to earn $61.3M and $17.6M, respectively. Opendorse projects the average P5 collective budget to be between $5-10M and the average G5 collective to be around $1-2M. (link); On3’s Terry asserts these “totals for Collectives (Roster Value) are significantly inflated. Our totals used for the On3 NIL Valuation are much lower. With this model, each school would be approximately $13M annually in Collective $ -- and that's just the reported average. My goodness. Not even close.” (link)

The Brandr Group has filed a temporary restraining order against EA Sports that could delay the game’s release, On3’s Nakos reports, adding that if the order is granted, it would prohibit EA from offering deals to student-athletes. Kennyhertz Perry attorney Winter: “The preliminary injunction would be in place throughout the entire pendency of the case. So, that could slow things down. So much depends on who they have agreements with. We don’t know who Brandr has agreements with. Plus, EA could just move forward without those athletes. It could be worse for the athlete because then they’re not getting paid.” Nakos notes a Case Management Conference has been set for September 26, at which point a court date could be agreed upon. Michigan lawmakers have sent a bill to Governor Whitmer that would allow college sporting events in the state to sell alcohol. The bipartisan bill passed both chambers overwhelmingly. Representative Wilson (R-Ypsilanti): “We have seen that when you regulate things in a more controlled way, in this case alcohol, you have better public safety outcomes.” Representative Aiyash (D-Hamtramck), who voted against the bill, argued the measure would “make our fans drunk in the middle of a beautiful sports match.” Eastern Michigan, Western Michigan and Oakland also expressed support for the bill.
