ACC Commissioner Jim Phillips reflects on his five years leading the conference in a Q&A with The Athletic’s Matt Baker. Here are some takeaways…

➤ On his time thus far in the big chair: “I’m really proud because as I sit here, I really believe the ACC is strong, it’s healthy and it’s well positioned for the future. This road has never been a straight line. It’s had some curves to it, like life does. But the restabilization of the league was important. Adding three institutions that have really been good for the ACC: Cal, Stanford and SMU. The ACC, I think, it’s as healthy as it’s ever been.”

➤ How has the uneven financial distribution been working? “I think things have gone well. This was basically unanimously supported by the board. If you perform well in football and basketball, you’re going to have a chance to take home a larger distribution level from the conference office. The same thing from a viewership standpoint. That’s motivated schools to invest at a higher level, to compete, to challenge themselves from a nonconference schedule — who are they going to play, when are they going to play them — to try to create really good content. So far, I’ve heard nothing but good things from our league about this. I would be surprised if other conferences don’t do some type of version of what we’ve done. I think it’s a modernization of college sports, and it’s an innovative way and creative way to distribute revenue.”

➤ As for where he sees the ACC five years from now: “I want to continue to be a conference that’s about innovation, creativity, best in class in competition, financially stable and thriving like I feel like we are right now. It’s really important for the conference to stay healthy and continue on that kind of trajectory. It’s a conference that’s been around since May 8, 1953. The significance of this conference to so many matters. That’s what we have done and continue to do each and every day, is to protect and advance the ACC, and that’s what we’ll do as we go forward. It’s “absolutely critical” that any federal law related to college sports includes a provision preventing student-athletes from being deemed employees of their school, per U.S. Sen. Ted Cruz (R-TX), who adds that “without it, we will see enormous and irreparable damage to college sports.” In an interview with ESPN’s Dan Murphy, Cruz observed: “Congress might run out of time to act if it can't find a bipartisan solution in the coming months,” with the current divide between Republicans and Democrats over whether college student-athletes should have a future avenue for collective bargaining thus requiring them to be employees. Murphy: “Cruz and NCAA leaders say many smaller schools would not be able to afford their sports teams if athletes had to be paid and receive benefits as employees. However, as lawsuits over player contracts and eligibility rules continue to mount, a growing number of frustrated coaches and athletic directors from major programs say they are open to collective bargaining as a solution.” Asked if creating a distinction between groups of college athletes is a viable compromise for Congress, Cruz told ESPN he does not think “employment status is the answer to this problem.” More. Tennessee Attorney General Jonathan Skrmetti, who sued the NCAA to secure unlimited transfers for collegiate student-athletes now references the unrestricted transfer portal as a “train wreck” and says it is “sucking the life out of college sports,” according to USA Today’s Brent Schrotenboer. Skrmetti: “I think the portal is probably the single biggest problem that needs to be solved.” Despite his overall concerns, Skrmetti doesn’t regret fighting to remove the rule and says building a system with better rules is up to college sports leaders and Congress. Skrmetti: “It's not that the NCAA got sued by states. It's that the NCAA was behaving illegally. And so just like with the NIL stuff, it was going to happen, like somebody was going to push back. And the point of the litigation is not to carve in stone the Wild West. It’s to get conclusive rulings that the old ways are broken, and it's time to start creating what the next college sports regime looks like. … I don't think we want state political figures doing that through litigation. I think it really needs to be a conversation between the coaches, the student-athletes, the conferences, the universities, the NCAA leadership, everybody who's involved in this.” More. (link)

The Arkansas Board of Trustees voted 7-3 to approve a resolution directing approximately $15M in additional annual funding to the athletic department, a move trustee Ed Fryar stated was necessary to reach the $25M roster budget coaching candidates indicated is required to compete in the SEC. The resolution mandates AD Hunter Yurachek allocate an incremental $5M annually specifically to football, while the university must identify $6M to transfer to athletics—potentially through student fees or tuition increases—and the department will retain an average of $4.4M it previously transferred back to the campus. Chancellor Charles Robinson and Yurachek told the board they had not seen the proposal until the morning of the meeting, prompting dissenting trustee Kevin Crass to criticize the process: “That’s amazing to me that the two people most impacted by this resolution have not been provided a copy of the resolution. Chair Eichler and gentlemen, that is not the way we should do business.” (link)

NIL attorney Daniel S. Greene reports that a “bill has been introduced in Hawaii to create a ‘Name, Image, and Likeness Endowment Fund’ to be managed by the U of Hawaii to compensate its athletes. Per the draft, the creation of this fund ‘is a matter of statewide concern.’ There shall be an initial corpus at least $10M.” (link)
