Yahoo’s Ross Dellenger observes that “while many doubt that the [NIL Go] clearinghouse will withstand inevitable legal challenges, administrators [at the 2025 NACDA Convention] provided legitimate reasons for why they believe in its long-term survival. Most notable of those, says NCAA president Charlie Baker, is that the clearinghouse’s appeals process – arbitration – is equipped with subpoena powers.” Baker: “Arbitration typically has subpoena power and I’m pretty sure since this one sits inside an injunction, they will have it.” Dellenger notes that power conference officials confirmed that “significant subpoena powers” exist under the arbitration appeals process, “but those powers are less expansive than subpoena authority within a courtroom. The decision to use subpoena powers and how exactly to use them – limited or broad – is expected to rest with the arbitrator presiding over the appeals process.” Ohio State AD Ross Bjork, who serves on the House implementation committee, explains that “we won’t have complete subpoena power, but if an athlete goes into arbitration…those records, you can get access to some of those records.” Dellenger also sheds some more light on the algorithm Deloitte will use to determine whether deals fall within a “range of compensation” deemed acceptable. Clemson AD Graham Neff, who also serves on the implementation committee tells Dellenger that “athletic performance is a big part of it. Your social media reach and following. Market – where schools are at. The reach of your school within said market.” For example, Neff points out the “reach of Georgia Tech in Atlanta is different than the reach of Georgia State.” Michigan State AD/implementation committee member J Batt on the enforcement mechanism: “Those penalties being worked through are going to be significant and are going to be different than any penalties we’ve had previously.” More from Dellenger. More from NCAA President Charlie Baker’s sitdown with Sports Illustrated’s Bryan Fischer for Collegiate Sports Connect at the 2025 NACDA Convention, during which Baker says of the House settlement’s impact on Olympic sports: “Virtually all of the A4 schools, which is where a majority of the Olympic athletes come from, have all said they're going to continue to support their Olympic programs and many of them have actually talked about the fact that they’re going to scholarship a lot more people in their Olympic programs as a result of this – and a lot more folks in their women’s programs as a result of this settlement. So, I remain fairly hopeful about that. I think the bigger challenge on all the Olympic stuff is just going to come down to – we have a great relationship with the USOPC, and we're just going to have to make sure that we continue to stay close to them as we go forward here.” Baker also notes federal lawmakers from both sides of the aisle have remained engaged with the NCAA about its future, “and, by the way, a lot of the folks on both sides have looked at some of these lawsuits we’ve been dealing with around five years to play four, which has been the standard practice in college sports for probably 100 years, and have said, ‘Okay, that's a really good example of why you probably need some help from us on liability because you shouldn't be in court on stuff like that.’ And I think the fact that there are now two bills that are pending in Washington and there are Democrats who are starting to either write their own bills or signing onto some of the bills that are currently under discussion there I think is a really positive development.” What happens if Congress doesn’t act? “Come back and talk to them again next year. The good news is we do have the settlement, which deals with what I thought were some of the most important issues that needed to be addressed. The employment thing is not something you're going to find a lot of student-athletes signing up for. In fact, when the men's basketball team at Dartmouth was engaged in that conversation with the National Labor Relations Board, there weren’t any other programs at Dartmouth that came with them. They could’ve if they’d wanted to. There weren’t any other programs in the Ivy League that came with them. They could’ve done that, too. And there weren’t any other programs in DI that came with them.” Full conversation. (link)

Regarding the proposed governance structure, Baker remarks there is “genuine support” for a “simpler, flatter, less complicated governance model for Division I. I’m a health care and government guy. I’ve spent my whole career around very complicated decision-making models. I found the NCAA’s decision-making model in DI to be just ponderous. I mean, it took me a year just to figure out how it worked, and I had a day job there. It also made it possible for people because it was so complicated and so big to not have to own the decisions that get made, and that’s when you’re in really bad territory. So, I think there’s a fair amount of support for making it simpler, less complicated, flatter, smaller committees with identified responsibility for the folks that are on those committees and a bigger role for student-athletes.” Asked about concerns expressed by non-Power 4 schools related to the governance proposal, Baker notes that a lot of the leaders at P4 departments came from those schools. “This idea that you’re somehow born into the A4 is just not true. It’s an ecosystem, and like any other good ecosystem, you can tell when you look at the trajectories of the careers of a lot of the folks in key positions in those conferences, they're all over the place. They’re in DIII, they're in DII, they're in DI, they're not in A4, they started in A4, they end up moving to higher positions with more responsibility outside the A4. I think the math on this shows that somewhere around 80% of the key leaders – ADs, head football coaches, men’s basketball coaches, women’s basketball coaches, baseball coaches, softball coaches in the SEC – 80% of them had significant parts of their career outside the Power 5. I use the whole Power 5 for that.” Baker pegs that number at around 70% for Big Ten, ACC and Big 12. So, I sort of start with the premise that this idea that somehow there’s everybody else and the A4, that’s not the way it looks in terms of how the people who are in the A4 and work there got there.” Lots more.
