The NCAA’s national office exceeded its financial goals for the fiscal year, and $55M of the resulting budget surplus will be used to offset payments for damages in the House settlement. Doing so would reduce back damages for each conference this upcoming fiscal year by 33%. The NCAA explains this decision to “direct the surplus to reduce the cost burden was made in consultation with South Dakota Attorney General Marty Jackley, who raised financial concerns of some schools that are not in autonomy conferences.” NCAA President Charlie Baker: "Thanks to financial reforms at the NCAA, the national office will be able to cover a larger share of the back damages, resulting in significant savings for our schools in this first year. After discussing the cost implications with many schools in DI, and after productive discussions on the matter with Attorney General Jackley, we are pleased to invest these surplus funds back into DI athletic departments." Stanford leads the way in the Learfield Directors’ Cup winter standings with 904 points, followed by North Carolina (896.75), Ohio State (794.75), Penn State (750), Wisconsin (693.70), Michigan (652), USC (642), Nebraska (638.75), Texas (623.50) and BYU (602.50) in the top 10. SEC Commissioner Greg Sankey spoke during the CAA World Congress of Sports yesterday in Nashville and said the House settlement is “not the end of the story. It is a chapter. It’s a necessary chapter. And one of the realities around other ideas related to college sports is they have started at a point ignoring what we have to deal with from the past. … The coping that you hear is we’re trying to figure out what we have to deal with from our past. That’s the chapter we’re in right now.” Regarding the clearinghouse component of the settlement, Sankey remarked: “That’s sensible. That’s not taking away opportunities. That’s supporting healthy opportunities. ... Part of the challenge is there’s really not a model that exists for that in the professional world because I can walk down the grocery store aisle in Skaneateles, New York, at Top Supermarket and Josh Allen has a breakfast cereal for sale. That’s pretty cool. Doesn’t have any logos. Doesn’t have any marks, but that’s name, image and likeness activity. If some young college person wants to market a breakfast cereal, knock yourself out. That’s what it was supposed to be, and we’ve lost sight of that reality.” Also from Sankey: “Not that anyone listens to my football media days speeches, but in 2019, the line was, ‘When you change the economics of college sports, you alter the Olympic development program in this country.’ Part of the Congressional conversation [around standardized NIL legislation] is that recognition.” (link) 

The IRS last week denied another NIL collective 501(c)(3) status, and James Moore & Co. Partner Katie Davis notes: “The IRS might be under-resourced, but they’re still denying 501(c)(3) status to NIL collectives. This is your friendly reminder that student-athletes are not a charitable class and payments are considered non-incidental private benefits.” The name of the collective has been redacted. (link)

Kentucky is moving toward housing its athletics department under a new university corporate entity that school officials say will improve their flexibility to handle rising financial pressure from the House settlement, according to USA Today’s Steve Berkowitz, who reports the new entity – Champions Blue LLC – is being modeled on structures under which its hospitals and other medical services enterprises are housed. Berkowitz notes that UK had nearly $202M in operating revenue and nearly $197M in operating expenses during FY24, which puts the Wildcats among the top 15 public schools in both categories. UK AD Mitch Barnhart expects that expense figure to increase by around $50M by FY26 due to the House settlement ($20-23M), more scholarships ($3-4M), inflation and other spending. Barnhart also notes the new entity would enable the athletics department to undertake a variety of business development opportunities and to offer pay and benefit programs to employees – and potentially to student-athletes – that it cannot under the current setup. Barnhart: “You've heard other departments talk about business districts and things like that. And those are conversations that are all on the table but really difficult to perform in our current structure. And so this gives us more flexibility to do that. … We’ve got some ideas on some things that we're going to have to run the traps on, so to speak, to say, ‘Hey, does this work? Does it make sense? Can it produce the things we think are necessary for us to move forward? … In the old way of life, there were literally four to five buckets that you got all of your revenue from. We're going to have those four to five buckets become eight to 10 buckets, and we're going to have to figure out other ways to do our work.” (link)
