Term-in-Ology: Use of NCAA Marks or Affiliation Prohibited
In the arena of rights of publicity, intellectual property, and certainly name-image-likeness (NIL), the vast majority of the chatter concerns policies and proposals tied to student-athletes.
However, NCAA rules not only restrict (for now) student-athletes’ ability to use their NIL, they also restrict staff members at NCAA schools and others serving on NCAA committees or acting as consultants from using, directly or by implication, the NCAA’s name or their affiliation with the NCAA in the endorsement of products or services.
This restriction is found with NCAA Bylaw 11 which governs rules applicable to personnel, employment, coaching limits, and the like.
