Big East Commissioner Val Ackerman has expressed “strong objection” to the process by which back damages are being determined in the proposed consolidated settlement of the House, Hubbard and Carter antitrust cases. Yahoo’s Ross Dellenger reports Ackerman is seeking ways to “alter the plan that the NCAA and A5 have orchestrated,” according to an email sent to league members. From the email: “Based on the numbers we have reviewed, the liability of the 22 non-FBS conferences under the proposed formula appears disproportionately high, particularly because the primary beneficiaries of the NIL ‘back pay’ amounts are expected to be FBS football players. I have voiced the Big East's strong objections to the proposed damages framework through recent emails to [NCAA President] Charlie Baker and his counsel and through comments during commissioner calls over the past two weeks. … While we support the goal of a settlement, which would be to avoid a trial [and the risk of a treble judgment] and allow for a flexible payment schedule for the damages penalty, we have taken issue with the manner in which the settlement amount would be paid.” Ackerman also acknowledges it’s “unclear how much time or leverage” the Big East has with the Power 5. The latest on a potential House case settlement from Sportico’s Michael McCann as he looks at why there’s so much public dialogue: “Playing a game of leaks is also a double-edged sword for the NCAA and players’ attorneys. On Saturday, ESPN reported on opposition to the settlement from non-Power Five conferences. They would be on the hook to absorb about 60% of a $1.6 billion price tag despite the fact House only names the NCAA and Power Five conferences as defendants for damages. They’re sensing that approach doesn’t seem so fair and weren’t reluctant to share that concern with a reporter. Expect to see other leaks this week, especially from schools worried about potential reductions in payments from NCAA tournament shares.” (link)

Front Office Sports’ Amanda Christovich reports the NCAA and Power 5 conferences have spent “more than $15M on some of the most powerful lobbying firms in Washington, D.C., and an undisclosed amount (likely in the millions) on well-connected public relations firms, public record and expert analysis show. Using some of the same high-powered lobbyists and PR professionals as Purdue Pharma and the Biden-Harris presidential campaign, they’ve manipulated the conversation on Capitol Hill, shaped media discussions to reflect their talking points, and influenced multiple legislative proposals.” Since 2014, the “NCAA has both in-house and K Street lobbyists on its payroll. In 2019, the NCAA spent $690K in total, according to public lobbying disclosures counted by DYK Media. The organization has increased its expenditures every year since, peaking at $900K in ’23. Overall, the governing body has spent around $7M on both its in-house ‘Office of Government Relations’ and Brownstein Hyatt between ’19 and ’23 alone.” In-house, the NCAA’s lobbying efforts are led by NCAA Office of Government Relations Managing Director Dawn Buth, who was recognized as one of the 500 most influential people in D.C. by the Washingtonian magazine. Meanwhile, Brownstein Hyatt “is the highest-grossing firm in Washington and has participated in some of the biggest lobbying industry campaigns. After pleading guilty to multiple felony counts, the opioid manufacturer Purdue Pharma likely looked to the firm for damage control, crisis communication, and influence to mitigate further penalties.” Lots more from Christovich. Cincinnati AD John Cunningham during a Ball and Brew event this weekend addressed the changes happening across the industry: "This summer I think a lot of key decisions will be made. It's a real important time in college athletics. I think we're making the right moves, I think we're heading in the right direction, but things are going to change a little bit. All we can ask is that we're on the same playing field as everybody else and that we know the game that's being played. I think some of that's going to be taken care of over the next couple of weeks and months." (link)

Cal State Bakersfield AD Kyle Conder joins MB Sports’ Matt Banker to give a unique perspective as an AD in the state where much of the change to athletics has originated. Conder talks about education to legislators, adapting to change, protecting Olympic sports and more. Conder says it’s up to the institutions to effectively communicate the value of a broad-based athletic department. “I know that we have student-athletes that wouldn’t pursue higher education but for the opportunity to have that combination of sport and education. I know we have student-athletes at our institution that wouldn’t be in the U.S. but for this opportunity to participate in both. We’ve got to articulate that in a really meaningful way. If we can demonstrate those facts and figures, data-based information for legislators, for leadership in positions that can make change to show if we start to see Olympic sports impact, it won't just be that our medal count at the Olympics might be impacted negatively, but it could have a negative effect on opportunities for student-athletes to pursue higher education.” You can check out the full Q&A on Connect. ESPN’s Paula Lavigne and Shwetha Surendran reviewed sports-betting policies at 24 Power 5 institutions in states that had mobile sports betting by the end of 2023 and found that “only four schools had policies that explicitly warn student-athletes of potential legal consequences.” They note, however, that it “isn't clear if the universities address the potential legal consequences at in-person sessions with athletes because 21 of the 24 schools contacted by ESPN declined to comment or did not respond to multiple emails asking about their educational efforts around gambling.” While it’s widely known that student-athletes who gamble could jeopardize their college careers, Lavigne and Surendran note that since 2018, state laws have codified even harsher punishments. For instance, South Dakota football student-athlete Clayton Denker confirms the athletic department emphasized the ban on sports gambling at the beginning of the school year; however, he was unaware that betting while a student-athlete could be a felony in the state. Denker: "They should lead with that. If [athletes] were to understand this affects the rest of my life, not just my sport, then I think they would take it more seriously." More. (link)

LPGA Commissioner Mollie Marcoux Samaan joined AthleticDirectorU’s Steph Garcia Cichosz at the 2023 Women Leaders Convention to discuss sustaining passion throughout her journey in and out of intercollegiate athletics, beginning with her time as a two-sport student-athlete at Princeton, where she later returned to serve as AD. Marcoux Samaan, who has since transitioned to serving as the Commissioner of the LPGA, reflects on having “the coolest job in sports” and talks about finding purpose in everyday tasks. “I think life is all about mindset. I think you learn that in the academic setting. You learn that in different roles that you have, but to me it's just all your perspective when you go into a challenge. I think when all the hard tasks are weighing you down, I think as a leader you have to step back and go, ‘Well, that's actually what my job is. My job is to solve problems, so if the problems are weighing you down, then that's not the job you should be doing. Because your job is to solve problems, so that's kind of how I try to deflect the burnout and the stress – I sort of disassociate a bit from the personal side and say my job is to solve this problem. I may not do it perfectly, I might not have all the answers, but I know that I'm trying to find the best answer and I'm trying to put the team first. The NFL’s schedule release landed with “the wallop of a blindside block, straight from 345 Park Ave. to college football administrators across the land,” according to The Mercury News’ Jon Wilner, who notes this year’s slate includes two marquee matchups on Saturday, Dec. 21 in Kansas City vs. Houston and Pittsburgh vs. Baltimore, both of which are on broadcast television and will compete directly with College Football Playoff games. Former Fox Sports President Bob Thompson: “The CFP said, ‘Hey, we’re going with three games and you do what you do.’ And the NFL responded by flexing its muscles.” While college sports’ litany of legal troubles, internal conference conflict and other problems could have myriad negative effects, Wilner notes they can’t stop people from viewing games nor will they “kneecap college football’s public relevance. The NFL can. The NFL will. Increasingly, the nation’s most popular sports league is competing directly against the CFP specifically, and college football generally, for the eyeballs coveted by the broadcast networks and their advertisers. Would the NFL willingly pose a material threat to the very sport that provides its labor? The NFL can. The NFL will.” Wilner notes the NFL has already encroached on the traditionally college-heavy Black Friday slate and has now moved in on the traditionally NBA-heavy Christmas Day. Thompson: “It’s intentional creep into other sports properties’ sacred dates. Imitation is the sincerest form of flattery, but the gorilla is coming. And it will stomp on everything.” (link)

The Columbus Dispatch’s Bill Rabinowitz profiles outgoing Ohio State AD Gene Smith, getting comments from a slew of colleagues, both former and present. Since Smith took over in 2005, 127 Buckeye individuals and 35 teams have won national titles and the headcount of student-athletes has gone from 324 to 811. Former Big Ten Commissioner Jim Delany, who, by his count, worked with 71 athletic directors during his 1989-2020 stint with the league, says of Smith: “There’s no doubt in my mind, that he deserves a place on the Mount Rushmore of college athletics.” Former Buckeyes football student-athlete Joshua Perry: “The thing I appreciate about Gene is that he was around. He spent time with us, got to know us, know our families. I was friends with a lot of athletes at Ohio State, some of them in non-revenue sports. I’d go in my downtime to watch them compete, and I would see Gene out there with Sheila. I thought it was awesome.” Women’s ice hockey HC Nadine Muzerall: “I think his superpower is his ability to connect and make you feel like you’re the most important person, coach or team on campus. … I never saw anyone (else’s) athletic director there. I saw the associate AD or sport AD, but not the actual AD of the school. And Gene was everywhere. He cares. I think that just makes you run through a wall for him.” Football HC Ryan Day: “Every year, our relationship gets stronger. He’s been a mentor. He’s been a friend. He’s been a boss. I would never be in the situation that I am right now without him.” Smith’s last day in Columbus is June 28, after which he and his wife, Sheila, will retire to Paradise Valley outside of Phoenix. Michigan State AD Alan Haller talks about industry changes with the Lansing State Journal’s Graham Couch: “I don't plan on this (new) system impacting the way we look (as a department). I’ve said it, I'm not an advocate of cutting sports. That's not going to be part of it. That’s when you will look for a new AD. There are decisions that have to be made and they're going to be hard. But we’re going to win in this system with the people we have right now and the student-athletes we have right now. Yes, that's a definitive, and if we have to do something different, then probably new leadership is needed. [...] I'm glad that there's hopefully some type of settling, some finality to what's out there. But I'm not an AD that's like ‘Oh my goodness, the system's going to crumble. What are we doing in college athletics?’ No, I think this is a good thing. This is an opportunity. I want to share into the assets of the profitability.” Haller also notes his biggest fear is a loss of connection with student-athletes: “At the end of the day, we have to do what's best for our student-athletes, but also we have to do what's best for the environment that we're trying to create. And there could be some harm done when there are no barriers around that movement.” More. (link)

Memphis Interim AD Jeff Crane joins D1.ticker/Connect’s Kristen Eargle for a look inside his path to the Bluff City. They also discuss his role in helping to lead the Memphis Rising Campaign, the construction of a new indoor football facility, tennis center, Olympic sports weight room and nutrition center as well as the current $220M renovation project for Simmons Bank Liberty Stadium. Crane credits his time as USC Upstate Interim AD as a particularly formative time in his career: “I can't even imagine a better lab or incubator sort of experience for being an athletics director than to go to a place that that has such potential and needed somebody to kind of come in and steady the waters during that time as they went through this transition. [I] was able to hire a new basketball coach there during my time, had significant involvement in the hiring of the athletics director at that time. I just learned so much about being an athletics director and am really appreciative of that opportunity.” Crane on how he evaluates career opportunities: “Sometimes we overthink opportunities. We put too much pressure on ourselves, ‘Are we going to make the right decision? Are we going to do the right thing? Sportico’s Brendan Coffey chronicles the private equity’s involvement in sports, a trend that started in earnest in the U.S. less than 20 years ago. Coffey notes teams have become comfortable with PE’s involvement in large part because “PE firms have gone corporate. … Leagues are comfortable with PE because they have put guardrails around their ownership. No firm is allowed to be a control owner of any North American major league franchise, and in some cases they’re not even allowed to vote. Leagues want to know every investor in the PE fund that wants to buy a stake, so they can veto any deal that includes someone undesirable. And a sale by a PE firm of its ownership stake will usually need to be approved by the league, too. In short, leagues feel they have PE firms entering on team owners’ terms.” Coffey goes on to note soaring team values have piqued PE’s interest in recent years as “growth of North American team values has outpaced the stock market over the past three decades, no small thing considering the U.S. stock market has appreciated 550% the past 20 years.” With several billions of PE money currently invested in sports, that number only figures to increase as the NFL appears increasingly likely to allow PE investment in its franchises and, as Coffey notes: “Florida State University, for instance, has been seeking to bring private equity into its athletic department. If it happens, it’ll open up a whole new sector for PE to explore.” (link)

Gensler Co-CEO Jordan Goldstein talks about the firm’s decision to open an office in Kansas City, telling SBJ’s Bret McCormick: “The epicenter of sports [architecture] talent is in Kansas City. So, it’s really an opportunity to connect with the talent in that marketplace, and no better way to do it than to have a physical space that allows people like [Studio Director] Greg [Brown] and others to join into our firm and be a part of the growth of our practice that really is a globally focused practice with a multi-location approach.” McCormick also notes college athletic departments are becoming increasingly sophisticated in how they commercialize their venues, and Brown, who recently led the design of Baylor’s Foster Pavilion, “will spearhead Gensler’s more focused charge into the space from K.C. The massive changes looming over college sports, including the possibility that student-athletes could become employees, has colleges and athletic departments somewhat anxiously considering their facilities’ futures and the revenue opportunities that could be, and need to be, generated by them.” (link)

Former Texas AD DeLoss Dodds & current Longhorns Executive Senior Assoc. AD/Chief of Staff Chris Plonsky reflect on the impact of the Longhorn Network as the first-of-its-kind effort goes quiet. Dodds: “We were looking at first at doing a conference network, but when you do a conference network, you’re getting only one-eighth or one-tenth of the deal, so you’re part of a group. We decided we wanted something that we could own that could be about us.” Plonsky: “Who could have imagined getting 16 hours of Texas Relays coverage over a weekend. We would have never believed we would get so much for our university, our kids and our coaches. (Dodds and Stultz) saw around the corner with where things were going. They’re so much alike. This doesn’t happen without them.” Former Host/IMG/JMI executive Tom Stultz also played a crucial role: “Had Texas left the Big 12 at that time and gone to any other conference or gone independent, then ESPN would have had a big hole in their coverage in the middle of the country. I think they would say that it was worth what they paid for the Longhorn Network in order to keep the Big 12 together because it gave them content in states with a lot of cable households that they needed.” LHN won’t be lost forever as the Longhorns are set to launch an app on July 1 “that will make globs of LHN content— coaches shows, profiles, documentaries — available on demand.” (link)

In a conversation on the Sporting Class podcast last week, former ESPN President John Skipper explained why he believes Netflix buying rights to two Christmas Day NFL games is just the beginning: “I think it is a very smart deal on the part of the NFL and Netflix. … They’ve been more cautious than Amazon and Apple, but they’re coming. … It’s just the natural evolution. (Netflix) is making money now. He was letting his shareholders know that they were going to not dive into sports while they were losing money. Sports are expensive. Now that they’re making money, now that they’re emerging as the big winner, which they are, they understand that they will need to keep moving into sports. It was a matter of time.” Lots more. (link)

Stratechery’s Ben Thompson in an interview with MoffettNathanson’s Craig Moffett, Michael Nathanson, and Michael Morton talks about the current state of the bundle and observes the bundle was destroyed by the very people benefitting from it. “The studios took all their content, and put it online for some reason. They destroyed the best business model, they destroyed their negotiating leverage relative to the sports leagues, and now they have to pay through the nose.” Thompson notes the “NBA, it looks like they’re getting in under the wire. Probably the last big deal with linear TV, and they’re smart to extend it out 11 years. Who’s going to be bidding on that in 11 years I think is really the open question.” Looking ahead, Thompson believes Amazon is best-positioned for growth in sports: “I think just sports makes sense for them. They’re a habit in people’s lives, they’re the most aggressive, and I think in building out their advertising layer, it is bizarre to me that we are in 2024, and for all these companies, I think they’re finally waking up to the fact that their only potential salvation is advertising, and yet Amazon is the only one that will say ‘Everyone’s getting ads now.’” Thompson says Netflix was “years late to ads, and I think they sort of realized that, to their credit, sort of self-corrected. It’s going to take time to build that up. Ads need scale. What is, if you could buy one single product to get your ad product at scale very quickly, what would you buy? You buy the NFL. Are they going to lose money on it? Probably. Fox lost lots of money on the NFL for years but it was still very useful in actually building up their business at lightning speed to where it needed to be. I think that’s the way to understand the Netflix/NFL thing, and it makes a lot of sense.” Lots more. (link)
