+ Commissioner Jim Phillips on the College Football Playoff revenue distribution: "I felt like I negotiated hard, just like every conference did and we got to a place that at the end of the day, ‘Do you love it?’ You don't love it, but it certainly was better than where we started, and it's more than we've ever had relative to CFP dollars. But I again understand it causes even a greater gap." Phillips also emphasized the need to get more than one team in the CFP and acknowledged the need to change the league’s perception. “We have to try to change that, and we're determined to do that.” On a potential House settlement: "These cases are going to take a little while. We'll have to work through them. We have 10,000 student athletes that are really doing well that are performing at the highest level. I hope that we don't lose sight of while all this is going on, the conference continues to do really well. We'll manage what we have to manage." (link)
+ Yahoo’s Ross Dellenger observes that while the league is projecting itself as a “shining example of a collegiate conference of old,” inside the ACC Spring Meetings, ”there is unsaid animosity here, uncomfortable squirming and awkward moments. There are eye-rolls, glares and even the occasional public barb.” Dellenger notes it looks increasingly likely that Florida State and Clemson will inevitably leave. “But where exactly will they go? And whom — North Carolina? — will follow them out the door? These are questions without easy answers. It is unlikely that any SEC or Big Ten school will agree to accept a reduction in their TV distribution to add any school. For the SEC, that is especially so given its footprint: the league already owns a foothold in South Carolina and in Florida. Also, the SEC programs in those states would likely make a fuss, if they haven’t already, over inviting into the league their archrivals (See: Texas A&M’s reaction to the SEC inviting Texas).” Dellenger contends it would take over $100M per year from ESPN and Fox in order for the SEC and Big Ten to expand; however, one conference official says there “isn’t as much money in the market as there once was.” Another option is for “8-10 schools vote to break away from the league, end the grant of rights with a majority decision and reform with a TV deal that is just as valuable but with fewer mouths to feed,” something the so-called Magnificent 7 reportedly discussed last year. One administrator tells Dellenger: “Now look. It would have been the smart thing to do. The SEC and Big Ten have cut us open and they’re just watching us bleed out.” More from Dellenger. (link)
+ Following Florida State AD Michael Alford’s comments earlier this week that FSU has not notified the league it intends to leave, Action Network’s Brett McMurphy points out: “Actually, they have. In FSU’s December lawsuit vs. the ACC, buried on Page 32 of FSU’s 38-page complaint, item No. 151 says: ‘FLORIDA STATE be deemed to have issued its formal notice of withdrawal from the ACC under Section 1.4.5 of the ACC Constitution effective August 14, 2023.’” McMurphy adds: “ACC sources said even though it’s in FSU’s lawsuit, it considers the written notice of withdrawal ‘a legal maneuver.’ So, for now, FSU remains an ACC member. But for how much longer? Both Phillips and Alford said everything remains professional and both parties are working together. I cannot confirm if either one of them had their fingers crossed or not.” (link)

SEC presidents and chancellors held in-person meetings in Birmingham yesterday, where they examined proposed terms of an agreement to settle the House and other lawsuits, according to Yahoo’s Ross Dellenger. While a formal vote from presidents is expected at a later date, Dellenger notes there are a “small number of detractors in several leagues, including several presidents in the SEC, according to those with knowledge of the room. However, only a simple majority of support is believed to be necessary to adopt the settlement agreement. … Settlement terms, mostly agreed upon, are being disseminated through the power conferences as commissioners work to gain authorization from their presidential boards through a majority vote. Discussion among executives continues to trend toward a joint decision to support the settlement, a move that could happen by the end of next week.” (link)

On3’s Eric Prisbell wonders why the plaintiffs in the House case would unite with the NCAA in lobbying Congress for protections from future antitrust lawsuits and notes that one prominent source said the settlement’s financial terms are akin to “public hush money.” Another industry leader says at least some on the plaintiffs’ side are mindful not to blow up the entire enterprise, as the settlement alone promises to radically reshape century-old parameters within college athletics. Meanwhile, Prisbell notes that “without antitrust protection from Congress, legal experts have told On3 a so-called compensation cap could be successfully challenged in court if athletes are not involved in collective bargaining.” Prisbell also reports that “several college sports sources expect the role of ambitious, well-funded NIL collectives to continue in a revenue-sharing model. They say those donor-funded collectives will share additional compensation to specifically star athletes in revenue-producing sports.” (link)

Former Syracuse Men’s Basketball HC Jim Boeheim joins the Now It’s Legal podcast with Athletes.org Co-Founder Jim Cavale and says there are things the industry must figure out. “We’ve gone in just a couple short years from a couple hundred thousand dollars for a good basketball player to a million dollars for a good basketball player. That’s crazy. I mean we're talking about $10M teams now, and I don't see how we sustain that over a long period of time. But I know that as long as you allow this, it's going to happen. Just two or three years ago people were talking about, ‘Well, they won't keep doing this, this won't work, they won't sustain this.’ And now they're at the $10M mark from less than a million dollars for a team in basketball. to 10. It’s $15M or $20M in football, so my main concern is how do we do something about the NIL? I think it’s great to revenue-share with players, but right now they’re getting more than revenue-share – in some cases a lot more than they would in revenue-sharing. Why would a player want revenue-sharing of a few thousand dollars when he's getting a million and a half dollars to compete? So, how do we handle that? How do we do something about that? And it maybe it comes down to what professional sports is: unions, salary caps and all that. We’re professional sports without any rules right now.” Boeheim also points out that efforts to head NIL off at the pass were derailed when attorneys informed the Transformation Committee that attempting to cap NIL activities wouldn’t hold up in court. “There’s nothing you can do that a player can’t go to court and say you can’t restrict me that way. The Supreme Court has basically said that. So, even if we get revenue-sharing, which might help, it’s not going to help the NIL part. That’s still there.” Even if NIL comes in-house, Boeheim notes there will likely be a Title IX component, “and I’ve talked to all the smartest people I know…and nobody’s given me an explanation of ‘This is what we can do.’” More from Boeheim. CBS’ Dennis Dodd profiles NCPA Executive Director Ramogi Huma, calling him a “singular force, pushing for what amounts to basic human rights through 12 sessions of Congress and four presidents. Yes, he has been that impactful, speaking truth to power in the highest seats of power but also making sense.” Ithaca professor Ellen Staurowsky, who has partnered with Huma on research projects: "He's as totally committed to trying to make the lives of athletes better on the ground. [He's] going against the system even with all these lawsuits, even with all these losses in court and these massive amounts of money college executives have paid to defend a stance that is indefensible, Ramogi has tried to hold that to account." Huma, who started the NCPA in 2001, says it was a “nerve-racking time. Even when I went and testified [to Congress in 2002] for the first time I could have felt there was going to be a moment when schools in the NCAA proved us wrong, where our arguments weren't valid. It just never came. We just kept getting more and more support." Today, Dodd notes there is a “growing feeling” that the only solution for the current situation is for players to be deemed employees. Staurowsky says of the talks of a House settlement: "I honestly am flabbergasted. We come all the way up to employment and then somehow everybody starts to tap out? Honestly, we're going to do that now?” Dodd also points out that several sources have weighed in, pointing out that players are not represented in the settlement talks. Kennyhertz Perry attorney Mit Winter says of the defendants: “They're trying to do everything they can to provide a way to reach an agreement that benefits these athletes short of them being employees.” (link)

+ USC Football HC Lincoln Riley earned nearly $10M in base salary and a total of $19.7M for the 2022 calendar year, the university’s new federal tax returns show. USA Today’s Steve Berkowitz reports Riley was credited with just over $9.6M in “other reportable compensation.” USC explains that amount includes the $4.5M buyout the Trojans paid Oklahoma on Riley’s behalf, treating that amount as taxable income to Riley and then also paying the taxes that were due on that amount. Berkowitz also notes USC paid former DC Alex Grinch $2M in base salary and more than $2.3M in “other reportable compensation” which was also connected to a buyout and tax payments. USC paid Oklahoma a $1.08M buyout on Grinch’s behalf. The Trojans also paid former HC Clay Helton nearly $4M in severance in 2022, and Berkowitz points out that means “USC paid a total of $28M in 2022 in connection with the employment of three football coaches, two of whom no longer work for the school.” In addition to the figures for the football coaches, USC's new return showed former Men’s Basketball HC Andy Enfield brought home more than $4.2M in total pay for the 2022 calendar year. Cal has received a $600K commitment from former AD Mike Williams and his wife, Jeanne, to support the Cultural Studies of Sport in Education master's program in the Berkeley School of Education. The program is led by Cal Athletic Study Center Executive Director Derek Van Rheenen. Williams: "We have been looking for opportunities that are meaningful for young people, but also for Berkeley. When this was described for me by Cal Athletics, it was very much in line with what we have tried to do and very much aligned with the ultimate vision for Cal Athletics – integrating with the rest of the campus." The Men's and Women's Ice Hockey Committee proposed an adjustment to the rules for checking from behind and contact to the head to provide game officials additional options when adjudicating these penalties. Specifically, could issue a five-minute major and at least a game misconduct or disqualification for clear violations of conduct to the head. The past two years, a standalone major penalty was permitted to be enforced in some instances. A two-minute minor is also available. Officials will have all options available for hitting-from-behind infractions (minor, major and major/game misconduct or disqualification). The committee also advanced proposals to change the high-sticking threshold from four feet to shoulder height and mandate the use of a shootout after the five-minute 3-on-3 overtime period. All rule changes must be approved by the NCAA Playing Rules Oversight Panel, which is scheduled to discuss ice hockey proposals June 6. More proposed changes. (link)

ESPN reports the 2024 season was its most-watched softball season since 2015, with games across all platforms averaging 190K viewers, up 13% YoY. The Arkansas-Alabama matchup garnered 570K viewers while the Big 12 Championship between Oklahoma and Texas drew 563K. Additionally, ESPN+ engagement was up 32% YoY. (link)

The NFL has retained PJT Partners to serve as a liaison between the league and private equity firms interested in buying stakes in teams, according to Sportico’s Scott Soshnick and Eben Novy-Williams, who add: “The league is on the verge of opening its doors to passive PE investment, a move that could dramatically reshape franchise values in the world’s richest sports league. Owners are expected to discuss the topic at league meetings next week in Nashville and could possibly vote on a formal proposal.” Representatives for the NFL and PJT declined to comment. (link)

+ ESPN’s David Hale reports North Carolina AD Bubba Cunningham left the ACC Spring Meetings early to “shore up support” and that the budget deficit trustees mentioned “were remnants from COVID and the department’s decision not to cut or mothball sports. It’s been a part of future budgets for years but was told board members ‘have questions they haven’t gotten answers to’ and the audit is simply fiduciary due diligence.” Cunningham will meet with the board tomorrow to address those concerns but is not expected to be fired. Meanwhile, Hale notes that “several sources I spoke to expressed surprise the topic of a lawsuit to exit the ACC was brought up and there is not widespread support on the board to go that route now. Any lawsuit would also require approval of university system governors. [Commissioner] Jim Phillips called lawsuit talk ‘campus politics’ and said he has heard nothing from UNC about a potential exit.” (link)
+ The News & Observer’s Andrew Carter joins the Ovies + Giglio podcast to talk about what he’s hearing from the spring meetings and says of the UNC Board of Trustees’ criticism of AD Bubba Cunningham that it felt “personal” and posits all the discord from FSU, Clemson and the UNC trustees is driven by football. “To sit there and suggest indirectly or directly, ‘Oh, we’re worried we can’t compete at the highest level [in] football, well, you (UNC) have never done that. You haven’t done that in the ACC. You haven’t won the conference in four decades. … I just think it’s a little bit misguided, I think it’s a little bit presumptuous and silly for UNC to put itself in the FSU and Clemson bucket when it comes to discussions about college football. If you want to talk about TV money affecting your bottom line, okay, yeah, UNC has 28 sports. + More from Hale, who reports Virginia and NC State will play non-conference football games in 2025 and 2026. Hoos AD Carla Williams says she’d like to do more of this, and Wolfpack AD Boo Corrigan confirms the league has no interest in moving to a nine-game schedule right now. Meanwhile, Phillips calls the ACC’s success initiatives “the most dynamic distribution model” in college sports; however, Hale notes that model will have to change again in two years based on new CFP revenue distribution and “ADs told me they did not make any progress toward that in these meetings.” Phillips on the Florida State and Clemson lawsuits: “It’s difficult, it’s disruptive, it’s harmful but that’s the world we live in. It hasn’t changed one iota about how we’ve interacted with them and it shouldn’t.” Phillips on the ESPN option that must be picked up by 2025: “The partnership’s not going away or being affected in a negative way at all. It’s a look in and we’re handling some of what that states.” Can the relationships between the league and Clemson and FSU be reconciled? Phillips is “optimistic” but says: “I don’t know where it’s going to go.” (link)
+ Football HCs around the league believe the ACC has a perception problem, citing Florida State’s CFP snub last year, and Wake Forest HC Dave Clawson says: “What we want to avoid is having a school ranked 13th that should be 10th or 11th. I don’t think it’s the quality of play. I think, at times, it’s the perception in the market. There’s a lot of us who have had good seasons who have seen teams with worse records get ranked ahead of us. Why is that? … Whether we think it or not, the fact that an undefeated Florida State got left out of the playoff, that’s a problem. Why was an undefeated Florida State perceived to be less worthy of the playoff than two teams that lost games?” Seminoles HC Mike Norvell says it “still comes down to an outside group that’s making the ranking and (determines) how teams are positioned. It’s respect that needs to be earned, and we’ve got a job to do, but it’s also about making sure that the story is told.” Clawson adds that it’s up to everyone to raise their games: “You want to encourage the top end and you better raise the bottom so that we become a deeper, more competitive league. So, when people view us they don’t say, ‘Well, that’s a good team in a lesser conference,’ but, ‘That’s a strong conference.’” (link, link)

St. Thomas will leave the CCHA to join the NCHC in men’s hockey beginning with the 2026 season. Tommies AD Phil Esten: "The move aligns with our institutional and athletics trajectory and places the Tommies with the other Summit League hockey-playing members competing in the conference. We are enthusiastic about the new strategic opportunities this will bring our University and department as we will bring new rivalries to St. Paul and compete in expanded markets nationally." The Pac-12 has named Pac-12 Networks Lead Producer for Football and Men’s Basketball Broadcasts Michael Molinari as the SVP for Business Development & Studio Operations for Pac-12 Enterprises, the league’s broadcast production arm. The league notes that with Molinari’s appointment, “Pac-12 Enterprises will take its broadcast production services external and welcome new and prospective clients to utilize its full suite of production capabilities.” The Mercury News’ Jon Wilner notes Oregon State and Washington State will need a media rights agreement if they wish to rebuild the Pac-12 ahead of the 2026 season. “The agreement will include a streaming component (ESPN+, Amazon, Apple, etc.), but building on-campus production facilities to meet digital media demands is a costly undertaking. The Pac-12’s infrastructure would limit the scope of any campus build-out, potentially making the conference more attractive to both new members and new media partners. It’s bold thinking, for sure, and it might become a lost cause. Nobody knows what options will exist for Washington State and Oregon State in 12 or 18 months. But they need to be ready, and Pac-12 Enterprises is an important piece of the preparation.” (link, link)

+ Former Duke Men’s Basketball HC Mike Krzyzewski earned just under $9M in total compensation in 2022, the year he retired. USA Today’s Steve Berkowitz reports Coach K received more than $5.9M in bonus and incentive compensation. “Not adjusting for inflation, that is the largest single-year bonus total reported for him by the school, dating from the 2009 calendar year. In most years, his bonus amount was between $1M and $3M. Krzyzewski's reported total pay includes $1.2M that, according to the document, had been recorded as deferred pay on prior years’ returns. That means his unduplicated net compensation for 2022 was about $7.8M. Beginning with the 2009 calendar year, Krzyzewski has been credited with just over $84.8M in net unduplicated compensation, according to the school’s returns.” His 2022 base pay was nearly $2.4M. Documents obtained by Berkowitz also show former Football HC David Cutcliffe received severance pay of nearly $4.4M in 2022. Additionally, former FB HC Mike Elko was credited with just over $3.9M in total compensation, including just over $3.5M in base pay. Current MBB HC Jon Scheyer was credited with $1.7M in total compensation for the 2022 calendar year, which he began as an assistant coach. (link)
+ Eastern Kentucky Baseball HC Chris Prothro, who took a medical leave of absence on March 25, will not return to the program. Prothro: "The decision to step away was not made easily, but this decision is best for our current players, the coaching staff and future Colonels who chose to play at EKU. Penry Advisors Founder Jason Penry emphasizes the importance of major gifts and lays out a framework for maximizing the chances of securing them. Penry notes the annual Council for Advancement and Support of Education’s (CASE) Voluntary Support of Education (VSE) survey found that 95% of money raised in 2022 came from just 5% of all donors. “In the context of philanthropy, the Pareto Principle, which asserts that approximately 80% of the funds come from 20% of donors, was accepted just 20 years ago. However, in the realm of higher education giving, this principle is now mostly outdated.” Penry uses Ben Porter’s 17-item Principal Gift Checklist as a framework for securing major gifts, noting that “Porter’s research revealed that administrators and fundraisers should have a ‘green light’ for a $5M+ gift solicitation after about 12 of the 17 checklist items are present. … The 17 checklist items…were analyzed in 33 of the largest gifts in the history of college athletics; all 33 gifts were $20M or more. An average of 14.3 of the 17 checklist items were present in the 33 gifts. This number is up from an average of 13.5 (of the 17) checklist items present in the initial study last year of 15 gifts. The expanded research has strengthened the idea that the checklist process is significant.” That said, Penry asserts that “there are no shortcuts to transformational gifts. As my mentor at the 12th Man Foundation, Stu Starner, taught me, ‘Daily processes – worked diligently – over a period of time – will inevitably achieve success.’ Your athletic department’s fundraising success may only be one checked box away.” (link)

EvanMiya Blog publisher Evan Miyakawa breaks down which men’s basketball programs have gotten the most out of their transfers based on the Bayesian Performance Rating, which “incorporates a player’s individual efficiency stats and on-court play-by-play impact all in one.” Over the last five seasons, transfers to Gonzaga, Houston, Connecticut, Auburn and Baylor had the most production, respectively, but Miyakawa notes that only tells part of the story. “What we actually want to measure here is how each transfer performs relative to expectations at his new destination. … Since we can compare any player’s end-of-season BPR to his preseason projection, we can actually find out which teams consistently get their transfers to outperform expectations.” Applying that filter identifies Arizona, Connecticut, Drake, Houston and Washington State as the top five programs in getting their transfer players to outperform expectations. At the other end of the spectrum, Louisville, DePaul, Boston College, Georgia and Rutgers are the programs whose transfers underperformed the most, respectively. More from Miyakawa. (link)
