Utah inks a 10-year multimedia rights partnership with JMI Sports, effective July 1. JMI CEO Erik Judson: “What they really were looking for is a partner in helping them navigate everything that's happening in college sports. Clearly, multimedia rights is at the center of this, but with [NIL] collectives, facility developments and the changing landscape of conference realignment, they really wanted more than just a multimedia rights partner.” Utes AD Mark Harlan adds: “It's really fair for me to say Learfield was a great partner for the University of Utah. We did a lot of incredible things together, and the people there are just terrific. It really was a fantastic run. In this case, moving on to JMI during the changes that are going on in our industry – and certainly going on in realignment – it just made for us at this time to go with JMI. Indiana is in the process of finalizing a 10-year apparel deal with Adidas, according to Hoosiers AD Scott Dolson, who says Adidas gives IU the best deal and that in the NIL world, apparel deals aren't going to be structured as they have been in the past. (link)

The Fiesta Bowl is planning a rebrand as the Fiesta Sports Foundation with an official announcement targeted for some time in Q4. Fiesta Bowl CEO Erik Moses tells SBJ’s Ben Portnoy: “While the organization is beloved in many corners and has lots of goodwill out there as an Arizona institution, it was starting to dawn on me that our organization was well known, but not known well. I wanted to make certain that wasn’t just my gut feeling and what I was feeling, but to back that up with some data and insight.” As such, the organization engaged Anachel to conduct the brand evaluation, which Moses says “confirmed what I thought. A lot of people know about the game. They have their own Fiesta Bowl memories from those games. They kind of know about Fiesta Bowl Charities and what we do in the community. But there are so many more disconnects between what our organization does and stands for and is about and the impact we have broadly across the space and, frankly, in the college football industry. We wanted to help find a way to bridge that gap.” (link)

Sportico’s Michael McCann explains there are “crucial points of caution to weigh” in a potential House v. NCAA settlement. “First, details really matter with a class action settlement. Settlements are not thematic, big-picture concepts and they don’t punt on specifics. They require exhaustive arrangements – especially for complex ideas like revenue sharing that could spawn their own litigation in a world where college athletes are not employees and not unionized.” Among the questions yet to be answered, according to McCann, is whether the NCAA and conferences themselves will pay and if member schools have to foot part of the bill. “The membership contracts binding a school to a conference or to the NCAA would likely prove key, but any ambiguity in the language could trigger lawsuits.” Another notable question includes whether and to what extent insurance companies would be on the hook. “The NCAA, conferences and member schools all have insurance policies that can cover civil judgments and litigation settlements. The applicability of insurance policies can spark disagreement and lawsuits. That happened with college sports and COVID-19 related closures.” Other pressing issues involve who will be paid and how much and the timing of payments. “None of this is to say NCAA President Charlie Baker can’t forge a path forward. Settling big, threatening cases would be sensible. Perhaps Congress, which to date hasn’t advanced college sports-related legislation, might be more inclined to consider legal reforms if the NCAA is willing to deal. But the road to a world where college sports is functional and fairly treats the athletes is a long one.” Lots more. (link)

South Carolina State AD Nathan Cochran joins D1.ticker/Connect’s Will Scott from the 2024 NCAA Convention to discuss his top priorities, his vision for the athletic department, his perspective on adding sports, his NIL strategy and more. On adding sports, Cochran says President Alexander Conyers informed him the school would like to add women’s golf and women’s bowling and adds: “We want to make sure that we’re providing more opportunities for our women student-athletes, and so that is my charge is to look at bringing those sports on and how we can do it. The good thing is we have our own golf course and we have our own bowling alley, so those two things make it very easy to add those two sports and provide more opportunities for our women student-athletes. … We’re going to explore those within the next year.” Cochran says of his message to donors when it comes to NIL that the “biggest thing for us is the season tickets and attending games because it helps us to generate sponsors and it helps us to generate the metrics that will get us sponsors that will generate more money so that we don't always have to hit up our alumni. For me, that was one of the messages I wanted to send to our alumni was attending those games and not being a fairweather fan but making sure that we're consistent in that just because, again, it helps us to sell, it helps us to be able to present data to businesses that will support our program as well.” Lots more on Connect. + Nebraska Deputy AD/COO Haven Fields has agreed to a three-year contract that will pay him $325K annually. NU has also agreed to provide Fields with $40K in relocation expenses. CollegeAD reports the deal includes a buyout clause for the first two years in which Fields would owe a year’s salary if he leaves for another position. The buyout is waived if Fields leaves for an AD position. Fields would be owed any remaining salary if NU terminates the contract without cause within the first two years. USF AD Michael Kelly applauds the bipartisan efforts in the U.S. Senate to press the Department of Homeland Security to take action that would allow international student-athletes to participate in NIL deals. “The reason it's applicable obviously to us is of our 500 student-athletes, about 140 of them are international. And to not at least have the opportunity to start their business, to benefit from their name, image and likeness is tough for them and certainly somewhat of a disadvantage for us not allowing them to be able to do that. So, we're very hopeful that this bipartisan effort will help push that through, but it's really an interesting nuance. It’s something that we have to get solved that's out of our control, but it's another way that hopefully the federal government can come and find a logical solution for this because I certainly think it’s the right thing to do.” (link)

The Baseball Selection Committee this week sent a memo to coaches warning them against canceling games for RPI purposes. Outgoing Coastal Carolina AD Matt Hogue, who chairs the committee: “I wanted to let you know that we are concerned with the practice of canceling regular season games for reasons other than inclement weather. It is not the intent or spirit of the game to adjust scheduled games in an attempt to strategically impact selection data or metrics. … As you are aware, when selecting teams for the championship, the committee weighs all the available data and the complete body of work. The committee has kept, and will continue to keep, a watchful eye on team schedules and any known reasons for any cancellation. During the committee’s subjective evaluation of teams, games canceled to avoid the impact on mathematical metrics will be discussed and could have a negative impact on the committee’s evaluation of a team.” (link)

Premium experiences are becoming increasingly important at college sporting events, Proof of the Pudding CEO Adam Noyes tells SBJ’s Bret McCormick. Noyes says all of its F&B clients, including Georgia, Georgia Tech, Auburn, Alabama, Mississippi State and Wake Forest, are looking for any areas of their stadiums that they "can convert into a premium experience” amid increased demand from donors. “It starts from the time you drive on campus to what’s the parking experience, the entrance experience, and the wait to get to your VIP area.” Noyes calls this a “very food-forward time” and adds: “We don’t believe in chafing dishes. We think that’s where food goes to die. Food should be served in iron-clad pans with heat from below and above.” McCormick: “The second and third touchpoints are becoming a bigger part of the overall offering. Affinity clubs, like the one Legends is developing at Maryland or the Stadium Club acquisition that Oak View Group recently made, are increasingly prevalent as premium experiences move beyond football or basketball game days. At Auburn, Proof of the Pudding hosts alumni-suiteholder tastings on the 50-yard line of Jordan-Hare Stadium on the Friday night before a home game.” (link)

Capital One led all NCAA men’s basketball sponsors in brand awareness, according to the 18th annual NCAA Sponsor Breakthrough study from MarketCast, which found that 62% of fans identified Capital One as the organization’s official credit card. Buffalo Wild Wings enjoyed the next highest level of brand awareness at 55%, followed by Coca-Cola (45%) and AT&T (44%). Next was Home Depot, whose recognition level has improved since Lowe’s ended its 15-year tenure in 2021, going from 27% in 2021 study to 44% this year. Additionally, Geico reached an awareness level of 23% after returning as an NCAA sponsor in March, while Marriott earned a 24% awareness level in its first March Madness. (link)

Yahoo’s Ross Dellenger unpacks what a settlement in House v. NCAA would look like, noting that any settlement of the case comes in two parts: “(1) compensation owed to college athletes for universities using their name, image and likeness in broadcasts; and (2) a future compensation model featuring revenue sharing with athletes. The first is likely to cost college sports as much as, or more than, $1B in backpay (damages) owed to athletes over the four years preceding the NCAA permitting athletes to earn compensation from their NIL (2017-2020). The amount is likely to be paid over a certain stretch of time. The second is more impactful to the future of the industry: an agreement from, specifically, power conference schools to directly share revenue with their athletes and even buy their exclusive NIL rights.” Dellenger goes on to point out that a settlement would protect the NCAA from further lawsuits for a period of likely 8-10 years. The settlement is also expected to include other active cases, such as the Hubbard and Carter lawsuits. Meanwhile, Dellenger notes there are those who oppose a settlement due to the short-term nature of its protection from further litigation, the lack of a guarantee it will change the way collectives operate and slow player movement, and the looming prospect of student-athletes being designated as employees. James Madison introduces new AD Matt Roan, who says his “immediate priority is to immerse myself and to fit in. [Outgoing AD] Jeff [Bourne] said there's going to be a lot of change – I would be a fool if I came in and changed for the sake of change. For me, I want to look, I want to listen and I want to learn. I want to sit down with [members of the media], I want to get out and meet as many people as I possibly can to find out what’s important to them. There are head coaches that I haven’t had the opportunity to meet. … I look forward to looking, to learning, to listening and then we’ll put together a plan to help us be successful.” On his mentor-mentee relationship with Bourne: “I’ve probably gotten on his nerves. I text him a lot more than he texts me. I always have questions for him. With 25 years of success, there's nothing that I can offer him, but I have leaned on him certainly over the last five years. New FGCU AD Colin Hargis says he’ll take some time to learn about the people and processes that have helped the athletic department get to where it is. “When you look at the success they’ve had athletically…17 years of Division I, 100-plus titles, you can win here, you can recruit here, you can bring student-athletes here and you can be successful. It’s a really short but rich history, one that we can build on. … We have to be able to generate resources here to support our student-athletes, to support our programs and sports and the university in general. But I think there’s a huge opportunity for us to be successful as part of this campus that’s growing as the region itself is growing.” In contrast to NC State, his previous institution which had a 130-year-old athletic program, Hargis views FGCU like more of a startup, which has its own advantages. “That’s a great thing because we get to be a part of creating the blueprint instead of having to recreate it or rebrand it. A lot of the elements are the same, it’s just we’re at a different starting spot.” Hargis adds: “I think a lot of it is getting the message into these communities and telling our story, really focusing on the success that has taken place here. … Most of these people generally speaking are coming from the Northeast and the Midwest, areas that are driven by college athletics. That’s an opportunity that we can tap into. We don’t need to be everyone’s No. 1 team but we can be their second favorite team, their hometown team when they’re in Southwest Florida.” (link)

Yahoo’s Dan Wetzel wonders whether college football could pull off a headlining offseason event like the NFL Draft, and Sports Illustrated's Pat Forde observes that “it would require coordination and cohesion, and those are two things college sports does not have. The conferences would have to agree to work together. They would have to get television partners who would work together. They would have to take more control of their calendar – all these things that they have been completely unable or unwilling to do. But could you imagine if the conferences got together and asked the top 50 recruits in the country to all come to one place…and announce their commitments one at a time on live TV. Not in December, in the middle of everything else, but in February and you had a signing day that was actually like a show like that, especially if you could get them to keep their commitments quiet that long. That would be the problem, of course, people will be jockeying for scholarships. … We've seen [signing day] be huge in February before. You can make it bigger, you can do more with it, but again, coordination and cohesion would have to go into it.” Yahoo’s Ross Dellenger adds that even an SEC-only draft would be a marquee event, especially somewhere like Atlanta, Nashville or New Orleans. “Could you imagine all the SEC teams arriving there and they have their seats on the side of the stage and they’re picking these high school players? People would show up. I don't know if 700K people would show up, but people would show up.” Wetzel goes a step further and envisions an event with unannounced commitment switches. “You know what, the last three dudes went to Alabama, I’m going to Alabama. The Atlantic Hockey Association and College Hockey America will begin competing jointly as Atlantic Hockey America in 2024-25. Atlantic Hockey America Commissioner Michelle Morgan: “After nearly a year of work, I’m thrilled to unveil our new brand and graphic identity to signal a new era for our league. … Our new identity honors the rich tradition of our past and celebrates the bright future that lies ahead for our member programs.” The leagues have shared administrative operations since 2010 but have competed as separate entities. + Former Oakland Men’s Soccer HC Eric Pogue has filed a lawsuit against the university, alleging OU unlawfully fired him for having "debilitating" depression, forbade him from speaking about mental health issues with athletes, and subjected him to a sexist environment that stigmatizes men battling psychological problems, especially men who work in the world of sports. From the suit: "When the opportunity came to address OU athletes, Coach Pogue wanted to speak about mental health issues,“ but the university "did not allow him to speak on it. … Instead, (it) not only began placing more work restrictions – including those that other employees were not required to follow – but also began pressuring Coach Pogue to resign." OU says in a statement that it “categorically denies Pogue’s allegations and will vigorously defend itself in court. With an unprecedented number of student-athletes calling for a change in leadership in the Men’s Soccer Program, and a persistent unwillingness by Coach Pogue to provide hands-on mentorship and training that OU student-athletes expect and deserve, OU concluded that Coach Pogue lacked the ability to lead the program and a change had to be made." In light of UAB’s football team signing up with Athletes.org, AO Founder Jim Cavale tells Sportico’s Daniel Libit he hopes the news will help him get his foot in the door with other programs. Libit: “At the same time, the news gave rise to conflict-of-interest and other questions about Cavale’s initiative, which he launched just weeks after stepping down as CEO of INFLCR, and four years after he sold that company for an undisclosed amount to Teamworks. Cavale responds: “I don’t own INFLCR and I am not involved in it in any capacity. I have built businesses in the college athletics space for the last half-dozen years, so I understand how athletic departments work, who their leaders are and how their org charts work … We are trying to build a win-win on behalf of athletes. That INFLCR stuff is my past career that has given me context to really take a big risk and leave to do this.” Cavale also explains AO is not a union but is structured in a way that it could become one should the need arise: “We don’t know how that plays out, so instead of trying to figure it out now, we are offering them this value from the jump and putting them into chapters with flexibility of unionization as time goes on.” On the seemingly disparate principle of signing teams and coaches to AO, Cavale argues it’s not dissimilar to the NFL teams’ role in signing up new NFLPA members: “The NFL owners and NFLPA are looked at as adversaries because they negotiate a collective bargaining deal, but when all those guys get drafted last week, who do they automatically (become) members in? The NFLPA.” (link)

Rob Gag, founder of the Minnesota-focused Dinkytown Athletes collective, says it’s been a “massive challenge” to cultivate a base of donors willing to commit funding to NIL. The Star Tribune’s Jeff Day notes that “part of that is institutional — even if the University of Minnesota athletics department or Golden Gopher Fund wanted to share donor lists and phone numbers, the U's legal department has said it's not allowed.” Gag tells Day: "I am used to failure…with sales my whole life. I have never had no's like I did with NIL. People are warming to it but the people you need to sell, the demographic, is over 65. They have most of the money. They are just slow to warm on it. The collectives that are most successful, it's not from the collectives being incredible salespeople, it's because they're in alignment with the university's foundation, they're in alignment with the athletics department's foundation, and the dollars flowing that way." Gophers Deputy AD Dusty Clements adds: “It is a top priority for our coaches, that is our reality. We did a great deal of work: Athletes Village, the football stadium, other projects, the golf practice facility, wrestling update, all of that. Thank goodness the leadership of Minnesota made that happen when they did because we're in a spot now where we do have some bandwidth to focus [donations] on NIL." (link)
