Yahoo’s Ross Dellenger reports that “after a lengthy and robust discussion Monday over several proposals,” the DI Board of Directors is “recommending to the Board the original proposal – not the ‘alternate plan’ – to finance the $2.77B settlement damages. The DI Board of Directors will meet this week to potentially approve the NCAA’s framework on payment of the $2.77B in back damages: 60% from school reduction; 40% from NCAA office. Under the plan, P5 reduction will pay 40% & 27 other leagues will pay 60% of $1.65B over 10 yrs. The DI Board of Directors’ approval of the financial framework would be the second of a three-step process in the NCAA’s authorization of settlement terms. The NCAA Board of Governors, which manages litigation matters & is set to meet this week, represents the final step. A reminder: The power conferences, each listed as a defendant in the suit, each must gain approval this week in votes from their presidential boards – an expectation, barring something unforeseen.” (link)

Florida State AD Michael Alford had this to say when asked whether there’s any chance of salvaging FSU’s relationship with the ACC: “I’ll say you run out every ground ball. That’s the baseball analysis for you. We’re going to continue to run out every ground ball. But what we do know is analytics and we do know the revenue gap coming in the future and how it’s just going to get worse and worse.” During an appearance on College Sports on SiriusXM, Alford also said he expects to see more conference realignment in the coming years. “You’re seeing networks really consolidate the major brands of college football. And they want brand on brand being played against each other. And that’s something that we see. That’s something that we think is not finished. We think there’s even more change coming in the upcoming years, and we’re taking this day by day. … I wish it would go back to 2005. I really do, because I had a great experience. But times have changed, and you can’t look back. You’ve gotta look forward and you’ve gotta anticipate what changes are coming. You’ve got to prepare yourself and your institution to be able to adapt quickly and be prepared on the forefront for those changes.” (link)

The Big Ten brought in $880M in revenue during FY23, surpassing the $853M in revenue reported by the SEC for the same year. Sportico’s Daniel Libit notes the Big Ten distributed roughly $60M to each of its members, with Maryland and Rutgers earning slightly less than the rest of the league’s members. The conference also spent nearly $5M on legal fees and $439,647 on lobbying activities to “discuss student-athlete initiatives with elected officials.” Also from Libit: “Former Big Ten Commissioner Jim Delany, who retired from his post in June 2020, was still the conference’s highest-paid employee, earning a total of $5.8M. About half of Delany’s take-home was from bonus or incentive compensation, while the other half was reported as retirement or deferred compensation. Delany continues to be on the Big Ten’s payroll as an outside consultant and was paid $400K as an independent contractor in FY23. The conference’s highest-paid independent contractor was law firm Mayer Brown, which earned $2.2M.” Former Commissioner Kevin Warren earned $3.7M and received a bonus for negotiating the league’s new TV deal; however, that bonus amount was not disclosed on the return. More on the Big Ten’s FY23 finances from USA Today’s Steve Berkowitz, who notes the league operated at a deficit of just over $17.5M for the year, but still reported net assets totaling $247M. In addition, the conference paid BLACCA Enterprises, LCC, of Madison, Wisconsin just over $750K for consulting services. Big Ten CFO Laura Anderson tells Berkowitz the firm is operated by former Wisconsin Football HC/AD Barry Alvarez, and that it worked on media rights and other matters. (link)

The SEC distributed between $51M and $51.8M to each of its 14 members during FY23, according to The Athletic’s Scott Dochterman, who adds the league paid out around $718M to its members overall, up from $698.5M the previous year. The conference generated nearly $852.6M (up $50.5M YoY), with $544.4M coming via its media rights deals and $274M coming from postseason participation. After expenses, the league had a $29.43M surplus — $9.5 million more than in FY22. It ended the fiscal year with more than $191.1M in assets. Commissioner Greg Sankey’s compensation was reported to be $3.6M. The Athletic’s Stewart Mandel notes the SEC’s distributions were “about $9M per year less than B1G, but that gap will narrow next year when SEC’s new ESPN deal kicks in.” (link, link)

Fresno State has officially opened its AD search, and the San Joaquin Valley Sun’s Daniel Gligich notes that any interested candidates must hold a bachelor’s degree and at least five years of senior level experience in college athletics administration. Additionally, the Bulldogs prefer candidates have a master’s degree or equivalent and at least five years of experience as an AD. According to the job posting, the salary range is $340-400K. Freshly minted Stephen F. Austin AD Michael McBroom’s three-year contract includes a $250K base salary along with $10K for moving expenses and a membership to Piney Woods Country Club, according to CollegeAD. McBroom can also pick up a $1,500 bonus for any regular season or tournament conference championship, $5K for finishing in the top 100 of the Learfield Directors’ Cup standings and between $2,500 and $10K for meeting certain GPA and APR metrics. Should SFA part ways with McBroom without cause, he would be owed 50% of one year’s base salary. McBroom would owe the same amount should he leave for another AD position. (link)

Georgia AD Josh Brooks says Sanford Stadium’s south-side construction project is on budget and is expected to be completed on time before this fall. “We’re still looking good for everything being on time for the season. The new press box and the new suites will be completed on the southwest corner and the old press box will be a new premium (donor) area.” Meanwhile, Phase two of a $48M expansion and renovation of Foley Field, UGA’s baseball facility, will get underway as soon as the season ends, and Brooks quips: “That’s a good key to success: You try to schedule construction projects to begin when a season is over and, ultimately, what happens is that team will go as long and far as possible (in the postseason). So that’s been a good rule of thumb.” Brooks also confirms that groundbreaking of the recently approved $59.8M track and field facility will begin in August and is expected to be finished in the spring of 2026. Brooks: “This obviously has been a very busy, busy time for us with facilities. We’re wrapping up some, we’re in the middle of some and we’re about to start some projects. So, this has been probably – the last six months and the next six or 12 months – our busiest time from a facilities standpoint maybe that we have ever had.” (link)

Fanatics has filed a lawsuit against Arizona Cardinals/former Ohio State WR Marvin Harrison Jr. accusing him of breaching a “fully binding and enforceable contract,” which the company calls a “binding term sheet.” Harrison and his father maintain Harrison Jr. does not have a contract with Fanatics. According to the suit, Harrison Sr. asked for a copy of the term sheet in April, then told the company that the two sides do not have an agreement. After ESPN’s Pat McAfee recently reported this disagreement is why Harrison Jr. has yet to formally join the NFLPA, Harrison Jr. posted multiple clips of McAfee’s show on social media. Per Front Office Sports’ Margaret Fleming, “Fanatics claims in the suit that Harrison revealed confidential information to ESPN and reposted the videos, which it calls ‘misleading.’” (link)

Stratechery’s Ben Thompson explains that Netflix’s NFL deal is unique in that it will bolster customer acquisition but not necessarily mitigate churn. Thompson points out that this is the only package the NFL has agreed to that doesn’t do both, which works for Netflix because Netflix already does a good job of holding onto its subscribers. “What the company wants to do is acquire customers, specifically for its ad-supported tier. … Netflix not only wants to figure out a way to reach the parts of the market that have never been interested in streaming, but also get scale for its ad network.” And, as one emailer pointed out to him, “what better time is there to teach grandma and grandpa how to stream than on Christmas Day when everyone wants to watch the football game?” Thompson doesn’t believe Netflix should change its brand promise of being customer-first or move customers to the ad tier, “but that only makes the challenge of getting scale in their ad business more pressing. At this point, I think my overall conclusion on this deal is clear: a single-day NFL package is, unlike most of the other NFL deals, one that is primarily useful for customer acquisition, not churn mitigation. The CCA22 – the group of non-FBS DI conferences – is submitting an alternate damages payment proposal to top NCAA governing boards, according to The Athletic’s Nicole Auerbach, who reports: “They're asking to either delay a final decision on the financial breakdown or adjust it to ~60/40 Power 4/non-P4. The alternate proposal is going to the Board of Governors, Board of Directors and both finance committees. As noted previously, the current proposal calls for the Power 4 to be responsible for 40% of the reductions over the next decade in NCAA distributions with the rest of DI on the hook for the other 60%. Kennyhertz Perry attorney Mit Winter believes it’s unlikely a judge would certify a House settlement with the reported terms because it includes future student-athletes not represented in the lawsuit. "Based on my experience with litigating class actions, that would be extremely unusual, and I don't think it's legally possible. A class-action settlement can bind absent class members. But it can't bind those who are not class members at all." On3’s Eric Prisbell reports plaintiffs' attorneys Jeffrey Kessler and Steve Berman are not concerned with the legality of the opt-out element, as they believe they have set up a mechanism (the annual opt-out opportunity for future student-athletes) through which the class will be certified. Baruch College Zicklin School of Business law professor & sports antitrust expert Marc Edelman is skeptical this mechanism will protect the NCAA from future lawsuits: "While a union can negotiate for a future revenue share that may be exempted from antitrust scrutiny based on the non-statutory labor exemption, there is no legal support for allowing a non-union group to negotiate for this kind of settlement without allowing for future antitrust challenges to what remains of the restraint." Boise State law professor Sam Ehrlich also weighs in: “It seems that the idea is to bind athletes indefinitely while only allowing them a chance to object each year – and you have the lead attorney (Jeffrey Kessler) openly saying those objections will go nowhere – and the whole idea of that feels like a major due process problem to me. The whole thing to me feels like a roughshod attempt to replicate a collective bargaining agreement, but without any of the legal powers and protections given to a formal collective bargaining relationship." Florida State has filed a petition in the North Carolina Supreme Court to appeal its initial loss in the courtroom against the ACC. Along with denying FSU’s appeal of the venue of the lawsuit, the North Carolina Business Court also denied the school’s motion to dismiss. FSU has consequently asked the state’s Supreme Court to review the initial decision and “whether the trial court lacked subject matter jurisdiction due to the ACC’s lack of standing when it filed the initial complaint.” The suit on why Florida is the appropriate venue: “The only subject matter of this dispute (according to the ACC) is FSU’s intellectual property rights (FSU Media Rights) to all of FSU’s home games played in Tallahassee and broadcast from Tallahassee using FSU facilities in Tallahassee for the next twelve years after FSU leaves the ACC. What could possibly be more Florida-centric?” FSU also asserts the “ACC had long planned behind the back of FSU to sue FSU, and been laying-in-wait for the opportune time to spring its hip pocket complaint on the FSU Board in Mecklenburg County, all for strategic advantage.” (link)

Evansville has received a $3M gift commitment from alumni Kyle and Ashley Freeland to support the construction of a baseball clubhouse which will be known as The Freeland Clubhouse. The gift is believed to be the largest in the athletic department’s history. Purple Aces AD Ziggy Siegfried: “Aces Baseball is on the rise, and this transformational gift by Kyle and Ashley Freeland further accelerates our success in the Missouri Valley Conference and nationwide. I have always stated that we are a sleeping giant at the University of Evansville. A big part of that is the fact that we have Purple Aces like Kyle and Ashley Freeland who are willing to invest in our future.” (link)

Texas A&M Baseball HC Jim Schlossnagle talks about plans for an $80M upgrade to Blue Bell Park: “The renderings we’ve seen to this point, if we’re able to do that, holy cow. That’s going to be awesome, and I can’t wait for the public to see that.” He describes a “360-degree concourse where you can walk everywhere” complete with a “drink rail” ideal for packed, marquee games, which occur frequently in the SEC. Schlossnagle adds: “At the current time we’re planning on staying in this footprint, so we have physical limitations as to how far out we can go. We can certainly go up, but you also have the sun to deal with (sitting in) right field.” (link)

The Athletic’s college football staff surveyed numerous coaches, NIL collective officials, agents, personnel staffers and players who have transferred on a variety of transfer portal-related topics, including player retention, collectives’ war chests, what players do to earn NIL and more. Collective CEOs agree that the percentage of funding allocated for retention and signing new players from the portal varies by year with Collective CEO 4 saying: “It’s definitely a lot cheaper to retain than it is to recruit, so we start there. And then we build off our budget and start in like December and try to keep our kids, and then whatever is left, we use to go get portal kids. It’s not that the budget is allocated a certain way, we’re just retention first and then we kind of see where we are.” GM 2 observes: “Most kids don’t want to leave their teammates, don’t want to be a quitter, so there is some loyalty. Then there are cases where some player with a sixth-round draft grade will come and claim they are being offered a million bucks to go somewhere — well, you should take it. If you’re getting offered that, you should take it. You have to know the kid you’re dealing with.” As far as how well collectives are funded, totals vary widely, with Collective CEO 6 noting this year’s football allocation was around $1M and CEO 1 indicating a total budget of $14.5M with roughly 80% earmarked for football. By and large, collectives pay student-athletes for in-person appearances at charities, social media posts and/or virtual appearances. CEO 5: “Live near campus, not get arrested, must show up and perform the charitable service. They also have to take a photo of themselves at the venue and upload it to our portal for proof.” Lots more. (link)

Former Toledo Football AC Craig Kuligowski has filed a $10M lawsuit against the school alleging he was “because he was the wrong age and the wrong race.” The suit notes that Rockets AD Bryan Blair stated in an athletics department-wide meeting that Blair wanted Toledo to hire “more coaches who were representative of current student-athletes” and argues that “it was clear that by ‘representative,’ Blair, as an agent of the University, meant younger and black or African American.” Kuligowski contends that as a former Toledo student-athlete he was particularly representative of the Toledo student body. The Atlantic 10 concluded its annual business meetings last week, during which NCAA President Charlie Baker provided an update on the current state of the NCAA, NIL legislation and the legal cases facing the Association. Baker also discussed the potential expansion of the NCAA Men’s Basketball Championship and the potential allocation of funds to support a revenue distribution unit for selection or participation in the NCAA Women’s Basketball Championship. ADs and coaches “strongly supported the future expansion of the men’s and women’s NCAA tournaments. Given the parity in the sport, there was support, (and a recommendation) for combining the current NIT/WBIT into the expansion review of the current field of 68 teams selected for March Madness.” League officials also discussed the payouts associated with the potential settlement of the House, Hubbard and Carter lawsuits and believes that “as a basketball-centric Division I conference, the recommended payment model disproportionately and significantly impacts the A-10 future revenue.” Commissioner Bernadette McGlade: “This is a crucial time in college athletics and the athletic directors and coaches were able to take a deep dive on the critical issues impacting the future of this industry. The opportunity to talk directly to President Baker was important for the basketball coaches and athletic directors as they shared the importance of March Madness access and the desire to see the NCAA tournament expanded.” More from the meetings. SBJ’s Bret McCormick examines Legends’ new partnership with Alum to “develop buildings in America’s college football hotbeds that contain residences, private membership clubs, meeting and event spaces, restaurants and, in warmer climes, outdoor pool clubs.” Through a services agreement, Legends will “operate the year-round membership clubs and restaurants and help Alum develop relationships with the college athletics world. Alum is offering a home-share program in which owners’ residences can be rented out when not in use, with Alum handling everything from booking to cleaning and maintenance.” Alum COO David Vialli: “There are bits and pieces of this all over the place — not one place where this all comes together. All the pieces that you have to go find for yourself, if they exist, we’re just putting it all under one roof.” The plan is for Alum to develop buildings containing roughly 90 to 100 condominium units in 25-30 locations at a rate of roughly three per year. The developments are expected to cost around $80M each, and Alum memberships will cost between $149 and $200 per month for access to the restaurant, club and event space and amenities, and priority booking for units (when they become available). Non-club members also will be able to rent the units. Planning is already underway for several locations, including Ann Arbor, Auburn, Norman and Athens. (link)

ESPN Bet appears poised for rapid growth, according to SBJ’s BIll King, who points out that “open for only 17 days and half the weekends in November, ESPN Bet more than doubled the combined handle of Barstool in 10 trackable states, taking in $464.6B in wagers. Rapid growth continued through December, with ESPN Bet taking a combined 8% share in those 10 states, nearly tripling the 3% that Barstool held in October.” However, the company has since slid back to the same position Barstool held for Penn a year earlier, and Penn Entertainment CEO Jay Snowden emphasizes that ESPN Bet’s plan is to realize acceptable ROI based on achieving market shares of 10% to 20% by 2027. “We never said that was Month 1. There are several constituencies out there that are wanting to declare success or failure after six months. I think that’s wild.” VP of ESPN Bet and ESPN Fantasy Mike Morrison adds: “We’ve already had significant impact in the market. We established a new brand virtually overnight. … We’ve just begun to develop what will be a market-leading experience from a product and technology standpoint across both platforms. I really like our hand here.” Snowden notes ESPN Bet’s value proposition lies in the convergence of sports media and sports betting, something the company is uniquely positioned to offer. “You can imagine how much more personalized we can be in everything we’re putting in front of an ESPN media/ESPN Bet shared account user. And that goes to fantasy and your fantasy roster, too. When you set your lineup each week, we may have a player prop offering for you of how many TDs Pat Mahomes is going to throw because he’s your starting quarterback.” Lots more. (link)
