Outgoing LEAD1 President/CEO Tom McMillen tells Sportico’s Daniel Libit that building consensus among ADs has become increasingly challenging: “It has become a lot more siloed. It is not as inviting an atmosphere as when I started. … Athletic directors rarely come together, and I don’t think that is good for the industry.” McMillen goes on to say: “In the beginning, it wasn’t so legalistically focused. We were focused on academic misconduct, a lot of internal NCAA issues, regional scheduling—a lot of things dealing with the enterprise. Now, we spend so much of our time watching and observing and monitoring these legal issues.” The lack of meaningful action from Congress has also been a point of frustration for McMillen, who notes: “If you go back to the earliest NIL bills, they were simple, in retrospect. And all of a sudden, the issues morphed, and they got more complicated. It has been a moving target.” While he says he favors college athletes making money, McMillen explains that “if I were playing God, I would take this vast sum of money on the table and find ways to redirect it to HBCUs. I would amplify the idea that this (college sports) is one of the greatest professional development machines, and I would have gone much further. The big vision of college sports is that we don’t have a half-a-million but a million college athletes. We create more opportunities, do more for underprivileged schools. That is kind of where I would like the system to go, and I don’t think it is out of the question.” (link)

Patriot League Commissioner Jennifer Heppel tells the Richmond Times-Dispatch’s John O’Connor she understands the speculation concerning potential expansion to include William & Mary but adds: “It predates my time. Conversations between the Patriot League and William & Mary have been going on for decades. I personally have never been involved in any conversations. They are a great institution.” Speaking of expansion writ large, Heppel says: “That is something that, as of right now, we’ve had no further conversations, but certainly I understand why there’s speculation.” That said, she believes the addition of Richmond makes the league more desirable for other FCS programs. “We’re small. We’re seven institutions. So I think sometimes that level of success has flown under the radar. Richmond’s acknowledgement of that and understanding and belief that it’s a fit for them, not only institutionally but athletically, really validates what we believe we know about ourselves.” (link)

North Carolina Superior Court Judge Alyson Adams Grine granted a temporary restraining order that bars the North Carolina Board of Trustees from holding closed sessions to discuss UNC’s athletic department “financials, budgeting, deficit, or ongoing or future conference alignment and related strategic planning.” The decision comes a day after attorney David McKenzie filed a complaint arguing the financial health of a public university’s athletics budget “is undeniably a matter of public concern.” McKenzie argues that if UNC athletics is running a deficit, there are three likely ways to fill the revenue gap: get more money from UNC students, get more money from North Carolina taxpayers, or get another athletic conference to pay UNC more. While Grine’s order didn’t specifically address McKenzie’s arguments, she found he had raised “specific facts” that reveal “immediate and irreparable damage will result if the TRO does not issue.” (link)

Florida State is asking the NCAA to reduce the penalties it incurred as part of an adjudicated case concerning NIL recruiting violations. The Seminoles are requesting an elimination of the scholarship reductions – five total during the 2024 and ’25 seasons – the limit on recruiting days and a fine of 1% of the Seminoles’ football budget. In its letter to the NCAA, the school states: “FSU should not be the only institution penalized simply because it was first in the queue, the violations for which it is responsible were more limited, and it cooperated fully to resolve the case.” (link)

Texas A&M inks a new five-year, $47M apparel contract with Adidas, according to The Eagle’s Travis L. Brown, who reports the term began July 1, 2022, and runs through June 30, 2027. Former Aggies AD Ross Bjork says the contract was finalized in August of last year and adds: “In the market of sports apparel and college athletics, it’s really a top-15 deal. In a suppressed market, with Under Armour being out of the market, there’s two players: it’s Nike and Adidas. And when we went through the negotiation, it was clear that Adidas was the best option, financially – equipment, apparel, all the components that they do from a marketing standpoint. And they’ve just been a good partner here at A&M.” The Aggies will receive $3M per year in base compensation, plus $6M in products. Adidas also will provide a guaranteed minimum royalty payment each year, beginning at $380K, followed by four years of $400K and another $380K in the final year of the deal. In addition to the $47M, Adidas will provide A&M $1M a year for mutually agreed upon marketing initiatives. (link)

Nebraska is changing the timing and sequencing of its $450M in renovations to Memorial Stadium. Rather than starting with the south side of the stadium, Huskers AD Troy Dannen says the first focus of renovation will shift to the east and west sections of the stadium behind the team benches. Dannen wants to put chairback seating on both sides. “The rationale for that, quite simply, is the east and west has the potential to monetize itself.” The unveiling of chairbacks would occur no sooner than before the 2026 season, and Dannen believes re-seating season ticket holders requires a full year of notice. Meanwhile, Dannen tells The Athletic’s Mitch Sherman he’s preparing for a $20M line-item expense in the annual budget. “Urgency is not the right word, but (there’s) demand to make sure we can support the costs of college athletics moving forward. So it’s a high, high priority. We’re starting from a great place, but that doesn’t mean we’re there.” NU still plans to install a new Wi-fi setup in time for the 2024 season. Dannen also notes he would consider requesting public funds in addition to fundraising. “At some point in time, I will ask everybody for everything once we have a financial model that doesn’t compromise our ability to compete in the new world of college athletics.” (link)

The Athletic’s Stewart Mandel and Jayna Bardahl examine college softball’s growing popularity, and Oklahoma HC Patty Gasso recalls her first years at the helm when the dugout at the public park at which they played was too small for the team. Now, the Sooners play in the $48M Love’s Field. “Every day we come out when there’s a crowd, it’s still a wow moment for us. We’re still trying to get used to this. I think everyone is just in disbelief, to be honest.” When the NCAA held its first softball national championship in 1982, the sport was dominated by teams on or near the West Coast, but as more teams began sponsoring the sport, more AQs were awarded. Former UCLA HC Sue Enquist: “I was the loudest person that said, ‘Crappy idea. We need the best teams in the postseason.’ They’re like, ‘No, we’ve got to build the sport nationally.’ “Fast forward to 2005. Carol Hutchins and her Michigan team came and upset us in the finals. And for the first time ever, you have a snow belt team win the championship. Now, all the big schools in those eastern conferences, SEC, ACC are like, ‘Sh–, we can win!’ And the sport exploded.” Enquist adds part of the attraction of college softball is the players’ transparency. “Would we be as popular a sport if we were just a bunch of robots out there being super competitive? Probably not. We’re an individual sport that is really camouflaged as a team sport. When I get up to the plate it’s an individual sport. There aren’t nine people getting in the box with me.” More. + ESPN College GameDay host Rece Davis says he spent around 250 hours recording about 30,000 audio samples for the game. (link)
+ ESPN’s Michael Rothstein offers an inside look at how the game was made, including the establishment of a “pageantry database, which became a rolling list of traditions and idiosyncrasies for all 134 FBS programs. They asked schools for help, added what they knew from their own college football fandoms and even scoured fan forums to find things they may have missed – or to learn that a school no longer did tradition X or hand signal Y.” Rothstein also notes the majority of the 150 stadiums in the game had to be built from scratch. “While there were some pieces from NCAA Football 14 they could use, those stadiums and mascots were built on a different engine for a different console. Not much would translate, so they had to start from the beginning. Building an empty stadium took about a week depending on the venue, with Syracuse's JMA Wireless Dome among the trickiest because it was indoors and cavernous, so lighting had to be set up a bit differently than other schools. [Production Director Christian] McLeod called it ‘the perfect storm of stadiums.’” In total, EA received tens of thousands of assets from schools in addition to their own work. They asked for and compiled touchdown celebrations for each team and stadium, how players celebrate after turnovers, how teams run out of tunnels, crowd hand signals, chants on key downs and details for stadiums, mascots, cheerleaders and uniforms. McLeod: "We want to make sure that, again, everybody's team is somebody's favorite. Texas and Texas State need to feel the same when you're playing as them if you're a fan of that school." Lots more. + Extra Points publisher Matt Brown explains why college sports games may be limited to consoles and not make their way to PCs and notes the short answer is: “The juice, right now, isn’t worth the squeeze.” PC games are particularly challenging to port because they require a “different level of testing and continuous support.” Furthermore, AAA sports titles are overwhelmingly played on consoles. “Specifically, multiple people familiar with EA’s offerings suggested that north of 80%, and for some titles, north of 90% of the game’s player base, plays on consoles.” Further still, a disproportionate number of PC gamers live outside North America, where college football doesn’t have the same appeal as the NBA, FIFA, etc. “Throw in the fact that publishers also need to be concerned about how the PC mod community could cause problems with college and athlete intellectual property licenses, (not to mention cheating in online play) and you have all sorts of compelling reasons for a major sports publisher to pass on a PC port.” (link)

ESPN’s Pete Thamel & Dan Murphy have more on a potential House case settlement. Most notably: “Sources told ESPN it would take a minimum of six months, and likely longer, to hash out the unsettled details. Revenue sharing with players is not expected to begin until fall 2025 at the earliest. [...] Multiple sources -- in the House and Senate and on either side of the political aisle -- have told ESPN in the past week that a settlement this year is unlikely to spur any immediate action from Congress.” Plaintiff co-counsel Steve Berman comments on the annual opt out clause for new student-athletes, which many are pointing to as a continuing major liability for the NCAA: “What plaintiff lawyer would take that case on behalf of one student? It's unlikely [a future student would sue] because these students are going to get a lot of money, and that lawyer would have to challenge an approved settlement agreement.” (link)

North Carolina Interim Chancellor Lee Roberts declines to go into too much detail about a potential House settlement but says Title IX is an “important wild card in all of these settlement conversations. In the discussions that I've heard, there's a lot of uncertainty about how any settlement would affect Title IX. Obviously, it's an important legal obligation of ours. It's also an important obligation, an important commitment of ours away from our legal commitments. We have some of the best women's sports teams in the country here at Carolina. And so our obligations under Title IX are crucial to us." Asked whether he’s concerned UNC may have to cut sports, Roberts responds: "I think it's too early to say. I've certainly heard that speculation, but I would have to see what the final settlement would look like, if there is a settlement." (link)

South Dakota AD Jon Schemmel talks about taking over during such a tumultuous time in college sports and says: “On some levels it is more of a draw for me to come in and know that things are very fluid and inconsistent. I think I'm certainly somebody that will provide a lot of energy and juice to a quiet room. Having said that, I think when all hell breaks loose and things scatter, that's usually when I'd like to think I'm at my best and my calmest.” Schemmel says of striking a balance between fundraising for facilities or encouraging donations to NIL that the “lifeblood of recruiting is still the same. You have to have facilities. It's about the student-athlete experience, and you have to have great coaches. And then what we're trying to balance that with is donors that can really give six-, seven-figure-type gifts, really trying to get them and talk to them about impact. If you can have an endowment or give $100K or more over five years, or $10M or anything like that, those are the people we really need building the foundation, building facilities. And then I think just empowering donors to choose and educate themselves on what the options are. Whether you're giving $100 a year or $50 a year, or up to $5K or $10K a year, is this about legacy for you? Or is this about impact? If it's about impact, those dollars might be more impactful in one of the annual funds so teams can travel better, eat better, whatever it is, or NIL.” Full Q&A. (link)

Athletes.org Co-Founder Jim Cavale breaks down what the potential House settlement means for the future of college athletics, noting once an agreement is announced it will start roughly a nine-month clock. That window “will be the opportunity for college athletics leaders at the school and conference level to involve their athletes in agreeing to the terms of the future of college athletics, whether it's revenue-sharing or whether it's other things that athletes should have the opportunity to speak into, such as transfer rules, practice time per week, length of the season, how many games they play, postgrad medical coverage, mental health resources. All of those things have been decided by the schools and their leaders for a long time without the athletes, but now there's an opportunity once the settlement’s initiated for the schools to involve the athletes in that conversation. … If the leaders in college athletics don't involve the athletes in the setting of those terms, it's a can kicked down the road” with more lawsuits to follow. Cavale goes on to say: “If you're a college athletics leader, you have a choice to make. You can do nothing, let this play out, let the others figure it out – that's what college athletics leaders have done for a long time, which is how we got here – or you can get in front of this, you can allow your athletes to be educated on this. You can empower them to be educated on this and you can allow for your athletes to sit at the table and have a perspective that they share and negotiate with you on.” More from Cavale. (link)

Former Vanderbilt Men’s Basketball HC Jerry Stackhouse was paid over $4M during calendar year 2022, according to The Tennessean's Aria Gerson, who reports Stackhouse earned a base salary of $3.4M along with $340,082 in bonuses and incentives, $277,567 in retirement and deferred compensation, $22,163 in other compensation and $1,830 in nontaxable benefits. In the 2021 calendar year, Stackhouse was paid $2.976M in base compensation and $3.197M in total. Meanwhile, Vandy reported Football HC Clark Lea's base salary as $2.984M in 2022 while his total pay was $3.189M, which also includes bonuses, deferred compensation and benefits. After being let go in December 2020, former Football HC Derek Mason received $2.166M in both 2021 and 2022, bringing his total severance paid in those two years to $4.333M. Commodores AD Candice Storey Lee was paid a total of $960,167 in 2022, up from $948,464 in 2021. Lee's base pay increased from $693,323 to $771,615, but she received less money in bonuses. In 2021, Lee received $189,313 in bonuses and in 2022 she received $112,500. (link)

Extra Points publisher Matt Brown breaks down Utah’s decision to partner with JMI, whose CEO Erik Judson notes schools “don’t hit MMR free agency all that often,” in part because the contracts are often structured in a way that gives incumbent companies a financial advantage. “And if they do hit free agency, schools aren’t always interested in really going through a competitive bid process. I’ll give credit to Utah. They were legitimately willing to consider a change.” Judson views Utah as an athletic department going through a major transition, “not just because the college sports industry itself is changing, but because the brand itself is changing. It’s in a new conference. It is a growing brand and a deeply ambitious brand.” As such, Judson saw this as an opportunity not just to help sell more billboards and NIL partnerships, but to set up a deeper, consultative relationship on multiple levels, one where they could give more specialized attention. Judson adds that success entails more than just increasing revenue. “We really took the time to get to know Utah and their market, which is important, because the multimedia rights strategies really depend on the specific goals of the school.” Brown notes that moving into a new era, Utah will “want new tools to help them figure out how to market themselves to ticket holders, brands, and the greater Big 12 community. They’re betting that a smaller firm will help them achieve those goals than doing it themselves, or working with the largest firms that can offer the most scale.” (link)

With the introduction of helmet communications and tablets on the sidelines for the upcoming football season, one Group of 5 DFO tells FootballScoop’s John Brice: “We’re hiring an IT consultant to travel with the team, a university IT person to travel with us. Somebody with more knowledge about fiberoptics and copper in the stadium.” The DFO adds, however, that hand signals will still be used, at least this season. “We’ll be doing both until we’re absolutely comfortable with it. Another G5 DFO says: “I’m going to be heavily reliant on my video guy to translate (issues), to put it in English. We want to try to get ahead of as many problems as possible before Game 1 arrives, when a tablet goes down or headset doesn’t work.” With only one player per team allowed to have a green-dot helmet (denoting they have the communication technology) on the field at once, one ACC AC says on defense that “we’re going to put it in our Mike, but he’s not on the field as much on third down. So, we’ll probably have it in our safety’s helmet as well. Either way, those guys are gonna have to have two helmets.” Another source confirms there will “have to be a lot of second helmets involved to switch out at a moment’s notice.” (link)

Ingham County Circuit Court Judge Wanda Stokes has dismissed with prejudice a lawsuit filed by Set The Expectations Founder Brenda Tracy against former Michigan State Football HC Mel Tucker. The suit centered around text messages between Tracy and her friend, Ahlan Alvarado, that were released by Tucker and his attorneys last year, and Stokes dismissed six of the suit’s seven counts saying attorneys for Tracy's nonprofit had not met legal standards for the lawsuit to proceed to discovery. Stokes also ruled the remaining count was moot because a protective order previously agreed upon between the parties will remain in place. The protective order bars the release of specific information related to sexual assault, harassment or gender discrimination victims that may be on Alvarado's phone. An attorney for Tracy says Tucker and his attorneys have “destroyed” Set The Expectations: "North Face pulled out the second that it realized that text messages and everything else were being released. North Face won't work with Set The Expectations anymore. Nobody will work with Set The Expectations. They have essentially destroyed Set The Expectations." (link)

Under Armour announces a broad restructuring plan after North American Q4 sales plunged 10% to $772M, and the company predicts the trend will get worse throughout its current fiscal year. CNBC’s Gabrielle Fonrouge reports Under Armour also saw profits sink by more than 96% during its fiscal Q4, compared with the year-ago period. Also: “It’s unclear how many employees Under Armour will lay off as part of the restructuring, but the plan is expected to cost between $70Mand $90M, a portion of which will be used for employee severance and benefits costs. The company declined to share more information with CNBC about its restructuring.” Net income for Q4 was $6.6M, down from $170.6M a year earlier. Sales dropped from $1.4B last year to $1.3B this year. (link)
