SBJ’s Ben Portnoy outlines a memo sent by NCAA Managing Director of DI Jenn Fraser to the DI Council & DI Board of Governors in late April that included talking points for engagement with Congressional leaders on areas where the NCAA “could use congressional help.” Included were enhancing student-athlete welfare, improving NIL outcomes for college athletes, protecting college athletics as a broad pathway to education and opportunity, protecting Title IX and women’s sports, plus competitive fairness and effective government. Mountain West Commissioner Gloria Nevarez comments: “I’m optimistic that President [Charlie] Baker has done the work and people have a greater understanding of the conflicts and issues and how nuanced they are. I also feel optimistic they would be in favor of some type of protection proposed by President Baker, but right now there’s so much going on, I don’t know if they have the time or the political will to get it done. But two out of three — political understanding and support — is really a much better place than we were a year ago.” Earlier in April at the Men’s Basketball Final Four, Athletes.org co-Founders Jim Cavale & Brandon Copeland met with Power 4 ADs, NCAA reps, media executives & some notable AO athletes to candidly discuss what the future could hold. Copeland: “This conversation was a private discussion for different perspectives to be heard and for everyone to see what’s really at stake here. While a House settlement would not solve college sports’ issues involving NIL, the transfer portal and pay-for-play, The Athletic’s Seth Emerson notes that “it’s a key step, as revenue sharing would have a domino effect on NIL and perhaps the portal: Schools directly paying athletes can alleviate donor fatigue. There could be ways to use revenue sharing to convince players not to transfer. And the willingness to even turn to revenue sharing could be a step toward actually getting help from the government.” Emerson also observes that the willingness of administrators to agree to a settlement represents a significant “vibe shift” within the industry. “Power-conference commissioners have been willing to engage, and not just the most powerful two, per multiple sources within the industry: The Big Ten and SEC may be the two richest conferences, but they haven’t been the sole driving force toward a settlement. College presidents generally were the most reluctant, but during the past year there has been, as one official put it, ‘an evolution in thinking.’” Emerson cautions that major changes are not inevitable at this point, “but things are moving, tentatively, in that direction.” (link)

The World-Herald’s Evan Bland chronicles the career path of Nebraska AD Troy Dannen, and gets comments from several folks with whom Dannen worked along the way. Former Big 12 Commissioner Bob Bowlsby: “He’s a very persuasive guy and he’s very likeable. He builds strong relationships and he will at Nebraska, too. It won’t be very long before he’ll know everybody’s children’s names and what the spouses do and who’s related to who. He’s a very, very good relationship builder.” Northern Iowa Football HC Mark Farley: “He’s probably won a lot of battles he wasn’t supposed to win in his career. He has the tenacity to go after something because he believes he can get it. I don’t know that he thinks he can’t get something done — he has that mindset that he’ll get it done. … What Troy did was build relationships and then carry our story over to the president’s office. He told our story about what was needed to be successful. … He probably has a great an understanding of the big picture of college athletics — of what’s going on, of what the future holds — as anyone around.” Former UNI Assoc. AD Jean Berger: “One of the things I most appreciated about him was he could make a decision. Sometimes in athletics and academics we study things a lot and talk about it and then the study gets put on a shelf. But he would make a decision and then that’s what we would do.” Lots more. (link)

More on the move of Missouri State to Conference USA as reports have indicated the Bears have the backing of an individual donation of $5M to pay the NCAA’s transition fee. FootballScoop also reports “the school has raised $1 million toward a $4.2 million effort to upgrade the football team’s locker room and weight room and has started a push to upgrade the school’s 17,500-seat football stadium.” HBCU Gameday’s Wali Pitt: “While the nuance of the FCS to FBS move can feel complex when you’re lost in the numbers. Missouri State heading to the C-USA provides the clearest blueprint of what it would look like for FCS HBCUs to leap into FBS football in the current landscape of the NCAA.” Pitt goes on to mention North Carolina A&T, Hampton & Tennessee State as HBCU programs that could fit the mold. Texas Tech announces a $5M gift from Dallas businessman and alumnus John Billingsley and his wife, Harriett, with the funds specifically going toward the south end zone and Dustin R. Womble Football Center project. The iconic bell tower in the south end zone will be named in honor of Billingsley. (link)

While UConn will buy the center-court circle, Purdue will purchase select panels of the 2024 Final Four court from this year’s title men’s hoops game. The panels will be made into various collectibles and sold through a third-party memorabilia vendor. South Carolina did something similar with the women’s court this year, purchasing it from Connor Sports for $86,946 and partnered with Artsman to sell off pieces of it. (link)

+ The Green Bay Press Gazette’s Scott Venci reports that Green Bay Men’s Basketball HC Sundance Wicks is in “deep talks” with Wyoming to become its new HC. Wicks has informed Phoenix leadership of his intentions to speak with the Cowboys, something that is required as part of his contract. (link)
+ Nicholls State AD Jonathan Terrell announced the hiring of alumnus and former team captain Kristy Helmers as HC for Colonel women's soccer. Helmers spent the past four years as an AC at Friends (NAIA). (link)
+ Indiana AD Scott Dolson will look for a new HC for the Hoosiers women’s tennis program as Ramiro Azcui will not return. (link)
+ A record 31 new HCs were hired this football offseason, while 529 coaches across 134 FBS teams changed jobs, according to 247Sports’ Brandon Marcello. Overall, 35.9% of 1,474 FBS positions changed via new hires or promotions, up from 34.8% during the 2022-23 cycle. This year’s 134 teams averaged 3.9 new coaches on staff, a slight jump from 3.8 last year. Meanwhile, the number of departures for the NFL rose for a second straight year with a record 34 college coaches making the jump to the pros this offseason. That's an increase of 88.9% compared to two years ago. On the flip side, 23 NFL coaches were hired in the FBS, down 4.2% from last year. Within the college ranks, 78 coaches went from the Group of 6 (including Washington State and Oregon State) to Power 4 (+30% YoY), while 74 moved from the P4 to G6. Finally, 141 coaches went from one P4 to another while 97 coaches changed positions within the G6. Marshall HC Charles Huff on the state of affairs: "This next chapter is going to look a lot different than previous chapters. This next chapter is not going to include some of the constants that we've had for many years. … It's not necessarily the quality of life that drives some coaches to the NFL or out of the business. It's the change in the landscape now because of NIL, the transfer portal. Head coaches are now transforming more into CEOs instead of play-callers and football-only guys. The New York Times announced that it added 210K digital-only subscribers to end Q1 2024 with an adjusted operating profit of $76.1M. That amounted to a 40.9% YoY increase and was driven mostly by digital subscription revenue growth. Now with 10.55M total subscribers across print and digital, the goal is to grow that number to 15M by 2027. While the NYT saw a decline in overall ad revenue, digital advertising was up 2.9% thanks in part to The Athletic, which had 4.99M total subscribers by the end of the quarter, up 1.72M YoY. Revenue was also up 33% to $37.2M during that time, but the site still lost $8.7M during the first three months of the year. For comparison, in Q1 of 2023, The Athletic lost $11.3M and in Q4 it lost $4.4M, but “the company remains resolute that The Athletic is on the road to profitability.” (link)

In the second installment of a two-part interview with 247Sports’ David H. Murray, Mississippi State AD Zac Selmon confirms the baseball and basketball programs are part of MSU’s facilities master plan. “You always think maybe Dudy Noble can't be better. That's if you compare it to other people – and there is no comparison in college baseball to Dudy Noble – I think that's the great thing about State. We're not comparing to other people, we're comparing against ourselves and how do we make it better? So the master plan is all elements of how can we make it better for student-athletes, but also new fan amenities, new seating options that will really take Dudy Noble to another level. The same with Humphrey Coliseum. We're undergoing a renovation there for team locker rooms. Both the men's and women's teams' locker rooms are getting revamped and will be ready for next season. Also, the training room there. But we're also looking at everything from scoreboards to in-game elements, to what is the next phase the team will need in three-to-five years.” Selmon says the Bulldogs have had “positive conversations” with Adidas about what their future partnership could look like, “but also I think with some of the momentum that we've had there's always going to be interest in Mississippi State. So hopefully we can announce some things soon. But those conversations are ongoing. The last time I met with Adidas in-person was at the Final Four this year." More from Selmon. (link)

Bailey & Glasser attorney Arthur Bryant, who has represented more women athletes in Title IX litigation than any attorney in the country, tells On3’s Eric Prisbell that any type of revenue sharing will require men and women to receive equal treatment and benefits. Bryant explains that when it comes to "straight-out payments" – like scholarship dollars, for instance – "equal" means proportional. "If 60% of the student-athletes are women and Title IX applies, they basically need to receive 60% of the revenue-sharing dollars shared.” However, Kennyhertz Perry attorney Mit Winter believes that if Title IX factors for college athletics are strictly applied to market-based payments, Title IX does not apply to those payments, although Prisbell notes there won't be a firm answer until either the U.S. Department of Education weighs in or the issue is litigated. As such, athletic departments are likely to proceed with caution on their end, leaving room for collectives to continue serving an important role. Winter: “Some schools will still likely make NIL payments through third parties. Not only because they don't want to try and replicate everything that collectives or other third-party entities do. But because they view it as providing some insulation from Title IX [because the third party is outside the school's umbrella] and providing other liability protections." (link)

A report released Thursday by the U.S. Government Accountability Office found that during the 2021-22 academic year, 93% of universities had female athletic participation rates lower than their enrollment rate. Meanwhile, 63% of schools had participation-enrollment gaps of 10% or more. The athletic participation rate for collegiate women overall was 14% less than their enrollment rate. Sportico’s Daniel Libit: “The report also took to task the federal sub-agency responsible for overseeing Title IX compliance—the Department of Education’s Office of Civil Rights—concluding it has made only limited use of available Title IX data in its oversight purposes and is slow in its monitoring processes. GAO based that conclusion on a review of OCR case management data from 2008 to 2022. Even when schools entered into formal agreements to improve Title IX compliance, OCR routinely dragged its feet to provide feedback. For example, in 10 of 26 cases GAO reviewed, the Office of Civil Rights took more than a year to review and approve a school’s plans to get into compliance; in five cases, OCR went silent for over five years.” Bailey & Glasser attorney Arthur Bryant: “This report confirms the sad, shameful truth. Most colleges in America are violating Title IX and depriving women of equal opportunities to participate in intercollegiate athletics. The federal government isn’t enforcing the law and making them comply like it should. So this illegal sex discrimination is continuing. Rice will add women’s golf to its portfolio of sports, thanks to a $5M commitment from former Owls women’s basketball player Lynn Laverty Elsenhans and her husband, John. Elsenhans, who has served multiple terms on the Rice Board of Trustees, spent 28 years working at Shell and another four at Sunoco, retiring as CEO in 2012. Owls AD Tommy McClelland: “In our conversations with Lynn, she made it very clear that this was a sport she wanted to support, and it is one that made sense. 25 schools in the state of Texas compete at the Division I level. 24 of them have women's golf. Rice was the only one that did not... until now.” A search for a head coach will begin immediately, with the team first competing during the 2026-27 academic year. (link)

Two days after announcing that Florida A&M was the recipient of a $237M donation, FAMU President Larry Robinson notified the Blueprint board that the school was no longer interested in pursuing $15M in additional funding for Bragg Stadium improvements. The board, made up of all 12 city and county commissioners, approved $10M for major renovations to Bragg in 2020 and last year the school asked for an additional $15M. In a letter on Monday to Leon County Commissioner Carolyn Cummings, who chairs the Blueprint board, Robinson thanked the agency, but added: “However, at this time we are withdrawing our request for additional assistance from the Blueprint Intergovernmental Agency for Bragg Memorial Stadium. We look forward to continuing to work with you, the Blueprint Board of Directors and Blueprint staff in other ways going forward.” The school put the Batterson Farms Corp/Gregory Gerami donation “on hold” on Thursday, according to the Tallahassee Democrat’s Jeff Burlew, who notes “It's unclear whether FAMU's decision to backtrack on its most recent Blueprint request was directly related to Gerami's would-be donation.” (link)

JohnCanzano.com’s namesake wonders if UCLA’s potential annual $10M “Calimony” payment to the Golden Bears will result in some regret making the Big Ten move. Canzano: “The ‘Calimony’ payment, if approved on May 14, will run through 2030. That’s a $60 million hit to a university that justified blowing up 108 years of history by announcing it was operating at a financial disadvantage in the Pac-12. [...] Had UCLA stayed in the Pac-12, a potential media-rights deal would have captured the Los Angeles market. That’s 5.9 million TV homes. Remember the $30 million per school offer ESPN made to the Pac-12 CEO Group in the fall of 2022? It might have easily been $40 million per school with LA still part of the deal. Also, the Bruins might have used their new-found leverage to seek a lopsided share. UCLA wants to be Ohio State. I wonder if they’ll end up more like Rutgers.” (link)

BYU AD Tom Holmoe shared a message with fans through the Royal Blue Collective emphasizing the importance of NIL: "It's a crucial time for BYU athletics with our transition into the Big 12, while simultaneously charting our course for the future amid the shifting landscape of college athletics. There are a lot of important factors and considerations for us to weigh. One crucial element for us to pay close attention to is the transfer portal. Our coaches have done a very good job in this ever-changing environment of mining the transfer portal for student athletes who are the right fit for BYU and will bolster our teams. Transfers have helped us become increasingly competitive in the Big 12. With the success that we're seeing, more portal athletes see BYU as a great place to continue their efforts to achieve their goals and dreams, both athletically and academically, at the college level. JohnWallStreet examines the reasons behind a coup attempt within the MLBPA, noting the union has generally been perceived to be the strongest in professional sports. To wit, it’s the only major professional league without a salary cap. However, JWS points out that the “lack of a cap means the absence of a floor. And MLB clubs spent just $2.9B on free agents this past offseason, down from $3.9B last year. The situation, which can serve as a lesson for the players associations in college sports, illustrates the need to have seasoned business professionals as union leaders. The problem, JWS points out, is that the “former players and labor lawyers historically tasked with running these entities are often unqualified to maximize their commercial efficiency.” He points to the following example: “RedBird exited OneTeam at a $1.9B valuation in ’22. The MLBPA could have done the same, or sold a portion of its equity at the time. And might have–had leadership recognized the ongoing macro trends. … Borrowing against its lucrative stake and buying out RedBird, or forcing the private investment firm to retain its interest through the end of the lockup period (see: 2027) were among its other options. Instead, the union never hired a banker and relied on its board to evaluate the opportunity. The group settled on a preferred equity structure that included $250M of variable interest rate debt and $500M in preferred equity. Naturally, interest rates have since skyrocketed, and the mid-teen IRR guaranteed to OneTeam’s new investor consortium has become an anchor on a once fast-growing business. The decision likely cost the players hundreds of millions.” More. (link)
