George Washington AD Tanya Vogel plans to depart the university after almost six years leading the Revolutionaries. President Ellen Granberg: "Tanya has an incredible ability to create a culture of excellence, commitment, and respect among student-athletes, coaches, and staff. In every role she has had at GW, she has led with distinction, supporting our student-athletes with warmth, care, and tireless devotion. I am grateful for her work in advancing our Athletics Department, and I wish her all the best in the next chapter of her career." Santa Clara AD Renee Baumgartner announces that she will step down on June 30 after nine years at the helm in order to return home and attend to family health matters. Baumgartner: "My time here at Santa Clara University represents the pinnacle of my career. The progress we have made in building one of the finest Division I athletic programs in the country has been a testament to the caring and support of the entire Bronco family. I am so grateful for the support I have received from President [Julie] Sullivan, each and every one of the student athletes who have passed through our doors, and the committed staff, coaches and administrators, alumni and donors who make this an amazing place. It is time now, to tend to the needs of my family, after 40 years away from home, but I do so secure in the knowledge that Santa Clara Athletics will continue its climb." (link)

House Updates…
+ The ACC has joined the Big 12 as the second Power 4 conference to vote to settle the House and other related antitrust cases. League presidents and chancellors held the vote at their in-person meetings yesterday. ESPN’s Pete Thamel: “Sources have consistently indicated to ESPN that there's little resistance on the conference level, and the NCAA is also expected to pass the settlement measure.” (link)
+ Officials in non-Power 4 leagues continue to voice their displeasure with the proposed settlement terms. One source with knowledge of the meetings among administrators says: “We're way too early in this process, but there's been enough discussion about hard decisions that’ll have to be made. And if it comes back to hard decisions have to be made that negatively impact our student athletes’ experiences and opportunities because [The Power 5] didn't want to take on an additional amount that was a fair, rational amount, then shame on us as an industry.” Yet another non-P5 official wonders: “The big picture question for me – if this is 10-year payment plan, so is that a 10-year commitment that we're all going to be under the same umbrella for 10 years? I don't know. We just saw the Pac-12 dissolve. What happens if another conference doesn't survive the next 10 years? How is that payment schedule then altered?" Georgia State AD Charlie Cobb on the potential fallout: “It's a real simple thing – what's our annual participation number in terms of lost revenues? If it’s several hundred thousand dollars per year, we’ve got to make corresponding changes…and either we're going to find new ways to replace that income or decrease services.” (link)
+ Yahoo’s Ross Dellenger reports that if a settlement is reached, the damages will be distributed unevenly to “thousands of athletes who participated in Division I athletics in the four years before the NCAA lifted restrictions on NIL compensation in 2021. Plaintiff attorneys will use ‘allocation formulas’ to determine how much each former player receives. Some athletes will get an equal share from damages for their use in video games. Others, the more notable major conference college football and basketball players, will receive variable amounts based around the formula.” The formula itself has yet to be disclosed. Also unclear is the number of plaintiffs in the case. Dellenger cites three sources with direct knowledge who believe it will be between 10,000-15,000. “If 15,000 plaintiffs received equal shares, the average payment per athlete is about $180K over 10 years, when not excluding attorney fees.” Plaintiffs attorney Jeffrey Kessler declined to reveal what kind of attorney fees will be associated with the settlement, but Dellenger cites two sources who say the figure will be north of $100M. + While the House settlement appears to be gaining momentum, USA Today’s Steve Berkowitz notes a fourth antitrust case, Fontenot v. NCAA, presents a potential legal hurdle. A hearing in the case is scheduled for Thursday before U.S. District Court Judge Charlotte Sweeney in Colorado who is considering the NCAA and conferences’ request to have the matter transferred to California, where it likely would be folded into the House, et al. settlements. Lawyers on both sides of the House settlement believe the case will ultimately be moved to California, but if it’s not, plaintiffs attorney Garrett Broshuis, says in a filing that “it seems likely” that one of the plaintiffs “will opt out of any such settlement to continue to litigate their claims in this case … Plaintiffs expect that many other athletes will opt out as well and could seek to join this case to seek better and fairer terms for athletes.” The filing also described those reported terms as “alarming” and claimed that would involve “the displacement of one artificial cap on revenue sharing for another artificial cap.” It also took issue with the proposed damages payment amount and the impact of a 10-year payment plan on the present value of the proposed total of nearly $2.8B. Plaintiff’s lawyer Steve Berman: "These lawyers have sour grapes over coming years late to these issues and not being at the table. What their pleading fails to address is that the settlement will resolve their claims such that there is nothing left to resolve in Colorado.” More from Berkowitz. (link); Full court filing. (link)

North Texas AD Jared Mosley talks about publicly voicing his displeasure with the House settlement on X earlier this week and tells the Denton Record-Chronicle’s Brett Vito: “There are a lot of people talking about it. It’s not just me. If you stay silent in these situations, no one is going to come back to the table. At some point you have to voice your frustration and do your best. You are starting to see people ready to circle up and have conversations about what parts of this we can take into our hands and control our destiny instead of waiting to have it dictated to us what our new world is going to look like.” Mosley goes on to observe that the “Power Fours are looking at $1.4M to $1.5M a year. That is nothing to them. The proportionality is disappointing and frustrating. The schools at this level did not drive us to this place.” (link)

Auburn AD John Cohen talks about the Tigers’ new apparel partnership with Nike and says of student-athlete involvement: “Student-athletes are like everybody else, they all have preferences. Many of them did talk about how certain shoes, certain equipment fit them personally. And we listen to that as well. I will tell you that if we brought 100 of our athletes in this room, you’re not going to get a consensus. Our student-athletes gave us great information about the product on both sides. We listened.” Cohen on influences from other programs: “We’re not going to make decisions based on what others around us are doing. Under Armour worked for us for a long time. And again, we won championships in Under Armour. This was an internal decision, not necessarily a decision influenced by anybody around us.” (link)

Nebraska Football HC Matt Rhule believes reducing roster sizes would be an “awful thing” because “for every player that ends up with a with a high-end commercial, there's 100 players that are becoming better people by having played college football and being part of a team. And those are the people that usually end up running our country, running our corporations, running our businesses. I mean, we spend all this time talking about what great things college football does, and now if we take it away from a bunch of people, I would really really be sad. What I don't want is I don't want a world in which because we're playing the 17 games to win the national championship, which I’m all for, I don’t want teams loading up on seniors and juniors only. I don't want high school recruiting to die. I don't want walk-ons to die. … I hope the people that are making these decisions don’t forget about access. We need access for young people that really need it.” (link)

The Toledo Blade’s Dave Briggs analyzes former Toledo Football AC Craig Kuligowski’s $10M lawsuit against the university and acknowledges he “can’t speak to exactly what happened and how his dismissal was handled procedurally. Maybe a smoking gun will emerge. But the larger, more sensational charge of reverse racism in the Toledo athletic department strikes me as insulting as it is flawed and reductive. First, it is hard to imagine UT was looking for a reason to dismiss Kuligowski.” While Kuligowski’s “ego could be a handful,” Briggs notes that “no one could deny Kuligowski loved his alma mater and was a good coach. What’s more, he had just received a two-year extension in March 2022 and was celebrated as a member of the ‘22 class of the school’s athletic hall of fame. All the while, UT was cooking up a reason to dismiss him? That feels like quite the reach, and the reputed reason why feels like an even longer one.” Briggs goes on to characterize the “suggestion that UT athletics discriminates against white employees” as “laughable” and points out Rockets AD Bryan Blair has hired four HCs since his arrival, all of whom were white and two of whom were over 40.” Furthermore, there are 15 athletic department staffers with Asst. AD or Assoc. AD in their titles, 14 of whom are white, and Briggs notes: “These are just facts, not a commentary.” (link)

The Southern Conference has chosen Boost to be its website provider. SoCon Commissioner Michael Cross says when he took over in the role he wanted to ensure the conference was “engaging in good storytelling, engaging in the best communication mechanisms possible and moving your agenda and your messaging to the public and recruits and student athletes and their campuses forward in a really meaningful way.” Cross adds: “Every time we talked to [Boost], we came away really impressed with their forward-thinking approach to a whole variety of things.” Boost Co-President Nate Schnader: “What this will really look like is a completely updated, modern website platform. That platform itself will have things like user accounts and AI-generated content, AI-video clipping, the ability to show specific fans tailored advertising and content and commerce opportunities. It will also enable their staff to do much more with less, not only just the AI components with the automated writing and videos, but also, we really modernized a lot of the administrative things around Player of the Week voting and annual voting, which is a big part of what a college conference does.” (link)

The NCAA Softball Regionals averaged 258K viewers, up 6% YoY. Florida State-Auburn drew 566K viewers across all platforms, making it the most-watched regional matchup since 2019. Kentucky-Oklahoma State averaged 551K viewers, and Oregon-Oklahoma brought in 522K. (link)

Colorado Governor Jared Polis has signed into law a bill requiring public colleges and universities to submit reports outlining the transfer credits they accept and reject. Called the Institution of Higher Education Transparency Requirements, the law is designed not only to enhance transparency on colleges’ transfer activity, but also guarantee that more courses count toward students’ majors when they transfer from a community college to a four-year institution, or between in-state universities. Senator Janet Buckner (D-29), one of the bill’s co-sponsors: “This new law is a pivotal step towards creating a more inclusive, transparent, and student-centric higher education system in Colorado. By prioritizing the needs of students, we can pave the way for greater educational outcomes and economic mobility for students and families.” (link)

The NCAA Board of Directors has approved the recommended funding plan to finance $2.8B in settlement damages, according to Yahoo’s Ross Dellenger, who notes the Board of Governors will meet this week to consider final authorization. Dellenger also outlines the expected initial 10-year funding plan for $2.8B (figures could shift slightly): NCAA national office pays 41% ($1.1B). Schools pay 59% in distribution reduction ($1.65M). Of the school distribution, P5 is responsible for 40% ($664M) & 27 other leagues will pay 60% ($990M). Overall, the Big Ten is set to incur ~$165M in reductions, followed by ACC ($155M) and SEC ($122M). Dellenger: “Why is the ACC paying more than the SEC? The NCAA formula to determine a league's reduction is based on distribution that league earned. Most NCAA distribution is related to participation in the bball tourney. North Texas AD Jared Mosley on the proposed terms of the House settlement: “Nothing to see here, folks…just renegotiated a lopsided P4 CFP deal because of your ‘value’ yet you get the NCAA and all other conferences to pick up a settlement they had little to do with and no voice in how the settlement would work. [facepalm emoji] #P4math.” An X user points out the AAC has earned $385M via the NCAA Tournament, media rights and College Football Playoff shares over the last seven years and is incurring reductions of $36M compared to the Big 12’s $132M, and Mosley notes: “No victims here…student athletes deserve a portion of revenues. You just can’t take 90ish% of new CFP money and ignore other media rights and then ask everyone else to cover 60% of the liabilities in a settlement. Bad optics and math any way you slice it.” (link)

Big Sky Commissioner Tom Wistrcill joins John Canzano on the Bald Faced Truth podcast to discuss the terms of a proposed settlement in the House, Hubbard and Carter cases and says the Power 5 and the NCAA “decided how the payment structure would work without any of the rest of the 27 of us being represented either in the lawsuit or in the room when those decisions were made. So, it's really put us at a disadvantage here because we’re basically being told to pay something that we had no input in.” Wistrcill also points out that while settlement talks have been going on for months, “we just found out about this two weeks ago. So, that’s why [the sudden alarm]. According to what we’ve seen, 94% of the money is going to go to Power 5 football and basketball players. Well, we’d love it if 94% of that money came from the Power 5. We just think that's a non-starter and so we're trying to…come up with something we think they'll be amenable to, which is rather than us paying 60% of it, how about we pay 40% of it? It’s still very unfair, and it's still very taxing and penalizing to our member institutions, but at least you can somewhat see that it's shared pain. It doesn't seem like shared pain right now, and that’s why we’re putting up such a fight.” Big Sky presidents and chancellors, Wistrcill continues, are “fired up right now about this” and are “contacting their state legislators, contacting their national congress and senators. We’ve got a lot happening behind the scenes here. … The challenge becomes – let's take the state of Oregon – so anything in this that is less money for Portland State means that Oregon and Oregon State have to pay more, and that's not always a popular thing. But it's back to is this proportionate to the revenue increases that these schools are going to see in the future? Plus the money is going to their students. Georgia QB Jaden Rashada has filed a lawsuit against Florida Football HC Billy Napier, prominent UF supporter Hugh Hathcock and former Gators staffer Marcus Castro-Walker over a failed NIL deal that would have allegedly paid Rashada $13.85M. The suit accuses Napier, Hathcock and others fraudulently induced Rashada to attend Florida with no intention of following through on their financial promises, per CBS’s John Talty, who adds the suit specifically claims “fraudulent misrepresentation and inducement, aiding and abetting fraud, civil conspiracy to commit fraud, negligent misrepresentation, tortious interference with a business relationship or contract and aiding and abetting tortious interference. … Hathcock (on behalf of himself and Velocity Automotive), Castro-Walker and Coach Napier orchestrated and executed a fraud upon Jaden and were substantially and knowingly assisted by one another in carrying out the fraud. Each of their individual schemes would not have succeeded without assistance from one another." Gators Senior Assoc. AD for Strategic Communications and Broadcast Production Steve McClain says UF does not comment on pending litigation and that “the UAA will provide for Coach Napier's personal counsel, and we will direct all questions to those representatives." Sportico’s Michael McCann notes Rashada’s lawsuit “attempts to hold those connected to an NIL collective liable for allegedly engaging in a bait-and-switch,” and “in the coming weeks, the defendants will answer the complaint and deny wrongdoing. Among possible defenses, the defendants might argue there was no formal or enforceable deal in place, or that Rashada engaged in conduct not compliant with the contract, therefore breaching terms of the contract. To counter Rashada’s allegation they possessed malicious intent, the defendants might say they were simply unable to make the money work. The defendants will likely also emphasize that Rashada had agent representation in the matter, a fact that could rebut any insinuation UF took advantage of him. They might also introduce exonerating forms of evidence, such as text messages that counter Rashada’s narration of facts. No matter how the case shakes out, it’s a reminder that while NIL has brought new opportunities for athletes, the inability or unwillingness of the NCAA to police NIL for fear of antitrust liability has left a vacuum. While states have adopted NIL statues that ostensibly protect athletes, those statutes tend to lack meaningful enforcement mechanisms.” (link)

Penn State has released two draft renderings of the planned $700M renovation to Beaver Stadium following approval of the project from the PSU Board of Trustees. Nittany Lions AD Pat Kraft: "I believe that Beaver Stadium is one of the most iconic buildings in all of sports, so [the renovation] keeps Beaver Stadium around for generations to come. It will provide an increased revenue stream for us. I think we will continue to have the best gameday experience in the country. And I think it's a building now that we can use, much like we did with the Luke Combs concert [in April], for far more than just seven or eight days in the fall." As part of the project, Beaver Stadium will undergo significant infrastructure repairs to address aging steel supports, concrete issues, and a "deteriorating press box with minimal investment since 1960." Fan Nation’s Mark Wogenrich also notes stadium circulation will be improved with widened concourses and the addition of 24 elevators and 12 escalators. Restroom capacity will increase by 15%, and concession locations will increase by 70%. As far as capacity, Kraft says: “We will be over 100,000 for sure. … We want everyone to be able to have an opportunity to come to the games, and over 100,000 fans is really important. It’s part of our DNA. So we will continue to try to have it as big as we possibly can." (link, link)

Texas State and University Federal Credit Union (UFCU) have signed a 15-year, $23M agreement to name the Bobcats’ football stadium UFCU Stadium. In addition to the naming rights, UFCU will open a full-service branch inside Texas State’s Lyndon B. Johnson Student Center. Bobcats AD Don Coryell: "We at Texas State are ready to make a statement. Georgia Southern will rename its football stadium as the Allen E. Paulson Stadium at Evans Family Field in recognition of a $3M gift commitment from the Evans family. The gift, which is the largest in the athletic department’s history, will be used for upgrades to the stadium and enhancements within the football program. Vanderbilt unveils the new premium seating spaces as part of the FirstBank Stadium south end zone renovation project. Fans can now make $150 deposits to be included in the initial seat selection for spaces in the Commodore Club, Field Club, loge boxes, living room boxes, south end zone suites and Commodore suites.
