The Fresno Bee’s Robert Kuwada identifies several potential candidates for Fresno State’s AD post, including Interim AD Rob Acunto, San Diego State Deputy AD for Revenue Generation Bob Moosbrugger, Eastern Washington AD Tim Collins, Eastern Michigan AD Scott Wetherbee, Northern Kentucky AD Christina Roybal, and Bulldogs Senior Assoc. AD for Development Tyler Mariucci. Kuwada also notes a statewide hiring freeze is and could continue to have a significant impact on all 23 Cal State campuses, as Fresno State cut institutional support last year by nearly $3M. “It was $15.5M in 2022-23 and $18.2M in 2021-22, and it is expected to be trimmed again next year.” Also from Kuwada: “The football stadium could be an issue. The past two athletics directors were unable to move forward renovation projects on what is now called Valley Children’s Stadium. Basketball, the other sport with the potential to generate revenue, is stuck playing in an arena where it not only receives no revenue from parking, concessions, suite leases or signage, but also pays for floor changeovers, for security and staffing on game days. The next two years, or the first two for the Bulldogs’ new hire, could be difficult, and the length of contract Fresno State is willing to offer could become an issue. The NCAA Board of Governors last night voted in favor of settling the House, Hubbard and Carter cases, and Yahoo’s Ross Dellenger notes that “college leaders believe the agreement staves off future legal challenges, binds at least for another decade the power leagues with the NCAA, and brings more regulation to the recruiting environment.” Tulane Sports Law Director Gabe Feldman: “This would be the biggest change in the history of college sports. Period. There have been significant changes and incremental changes. The NIL era has opened a lot of doors, but to have athletes share revenue with the schools would be not only monumental but would be contrary to what the NCAA has espoused for a century.” One component of the settlement that has flown under the radar involves a “new enforcement arm and governance structure for, at least, the power conference schools, allowing them to create and enforce their own rules,” per Dellenger, who notes the finalization of those details could take months. (link); Sources tell ESPN’s Pete Thamel it will be “at least six months'' until details concerning Title IX, NIL enforcement and roster caps are worked out, likely longer. “There also are expected to be several other steps before Senior District Judge Claudia Wilken can approve the settlement. … Wilken also needs to hold a preliminary hearing to review the terms of the settlement. Later, she would need to consider any arguments presented against it before formally ruling on the settlement. This all projects to take months to unfold.” (link)

House v. NCAA plaintiffs’ attorney Jeffrey Kessler responds to suggestions from attorneys in the Fontenot v. NCAA case that he and co-lead counsel Steve Berman are selling student-athletes short. He tells Sportico’s Daniel Libit: “Steve Berman and I have been fighting for the rights of college athletes for well more than a decade. We have negotiated numerous class actions. I have negotiated virtually every settlement in the NFL and NBA for players over the last 30-plus years. I negotiated the women’s [soccer] national team settlement for equal pay. I would like to think Steve and I know what we are doing as opposed to lawyers who have no experience in doing this and have so far done nothing more than file an action for two former athletes.” Kessler also says the settlement negotiations have been going on in private for over a year, but “for a long time the talks stalled while the NCAA and the conferences and schools decided whether or not they wanted to go forward.” Ideally, these negotiations are kept secret, but Kessler notes: “There are 60+ schools that the NCAA and conferences have to consult with, and those schools are not great at respecting confidentiality. I am not accusing anyone, but it is pretty clear all this information is coming out from various schools, athletics directors—so it has been very unusual.” (link)

The Athletic’s Scott Dochterman catches up with several Big Ten stakeholders to hear their thoughts on what happens after a House settlement, and Illinois AD Josh Whitman says the hope is to provide structure and continuity. “It certainly comes with a set of really unique challenges. But for people in positions like mine, I hope we’re viewing it as a tremendous professional experience and just a remarkable opportunity to really be on the forefront of change and help craft a thoughtful solution to what the future could look like.” That said, Whitman concedes that “nobody just has tens of millions of dollars sitting around unallocated. Every school is going to have to do some in-depth analysis and figure out what is the right approach for them and what makes sense on their campus. … The objective is not to figure out who can spend the most; it’s to try and figure out who can spend it the best. So how can we create a system that allows for some level of competitive fairness? And I think that benchmarking against what we’ve had in the last couple of years probably isn’t the right view to take on analyzing whatever this new system may look like.” Illini Football HC Bret Bielema adds: “For us as football coaches, if there’s a time for transition to happen, there never is never an ideal time, but I think now is good.” (link)

Nebraska AD Troy Dannen weighs in on the Huskers playing Friday Night Football: "We can be upset about it all we want, but we're cashing a pretty large check from our television contract every year – this is the price of that check. In order to fund what we want to do, you end up with a Friday night game here and there. … I know Friday night games cause a lot of heartburn for a lot of reasons. We think of high school football, just the logistics of a Friday night game in the middle of a college campus. There are gonna be a lot of challenges along with it. But I think the ability to put the Huskers in that stadium and our crowd in the national limelight for a night game is…well worth the challenges that lie ahead with it." Dannen also noted the “volleyball event last year might have been a good dry run for us and what it would look like during the week and how the impact would be. [It's] a challenge for our operations crew, but it's gonna be a great environment.” (link)

Houston’s operating budget for FY23 was $81.5M, the smallest among Power 4 schools, and while Cougars AD Chris Pezman says it’s up to around $97M now, he acknowledges that “our biggest challenge right now, honestly, is money. We’re trying to catch up to a lot of other schools that have had greater resources for decades. I would tell you right now we’ve got a pretty big hole to fill. …We have to figure out ways to do that in a challenging environment with NIL. That’s the challenge. That same dollar used to go to us; now it’s to the kids, a million different ways, capital projects. It’s a very difficult problem that nobody has figured out the solution yet.” Pezman says of former Football HC Dana Holgorsen’s buyout: “It’s a lot of money. It’s a heavy number. When we hired Dana, we were still on the outside [of the Power 4] looking in. We were trying to prove that we were investing and that athletics is important to us. We needed to do something like that. I don’t want to say to make a statement, but it was proof of commitment. Dana is a good coach. It just didn’t work.” Also: “If you look at UCF and Cincinnati, we are about $10M behind them on self-generated revenues. There’s not any reason for it. We could make excuses all day long, but until we meet or exceed that, we’re failing, and that’s on me.” More from Pezman. (link)

The U.S. Department of Justice and a group of states plan to file a lawsuit against Live Nation accusing the company of using its ticketing monopoly to suppress competition and arguing it should be broken up. Sportico’s Michael McCann contends that “whether a DOJ lawsuit would succeed and compel a company breakup are no slam dunks,” adding: “Expect Live Nation attorneys to argue that the government constraining or dismantling Ticketmaster would hurt, not help, consumers by depriving them of a superior product and service. … The presence of a consent decree would also be stressed by Live Nation attorneys in any DOJ litigation. Live Nation’s statement draws attention to a former federal judge monitoring compliance and how ‘there never has been and is not now any evidence of systemic violations.’” If the DOJ does file a lawsuit, McCann believes the litigation could take years, and “Live Nation has the financial wherewithal–the publicly traded company is worth about $23B —to play the long game and pay the necessary millions in attorneys’ fees.” More from McCann (link, link)

TV networks are increasingly leaning into their aging audiences, as the Wall Street Journal’s Isabella Simonetti and Joe Flint point out the “median age for TNT and Bravo viewers is 56, for HGTV it is 66, and even the once-youthful MTV’s median-age viewer is 51, according to Nielsen data. The cable news audience is even older, with MSNBC’s median age at 70, Fox News’s at 69 and CNN’s, 67. Among broadcasters, CBS’s median age is 64 and ABC’s is 66.” Now, rather than focusing on the demographics, networks are selling advertisers on the mass-market reach of TV. Paramount Chief Research Officer Colleen Fahey Rush: “Everybody uses credit cards and buys paper towels and buys insurance and buys phone plans, so those are not age-specific things.” Media companies also tout their streaming services as ways to reach younger audiences; however, the “influx of ad dollars into streaming hasn’t been enough to offset the decline in TV viewership.” NBCUniversal Global Advertising and Partnerships Chairman Mark Marshall: “For decades, we have transacted on age and gender, like adults 25 to 54, as if everyone in this whole segment is the same person buying the same products at the same time.” The goal, Marshall says, should be to find “people who are in the market for your product.” Disney President of Global Advertising Rita Ferro adds: “It’s a dated way of even talking about audiences across our media landscape.” (link)

Federal Reserve officials concluded at their most recent meeting they would need to hold interest rates at their current level for longer than they previously anticipated after a third straight disappointing inflation reading last month. According to a written account of the meeting, an unspecified number of officials “mentioned a willingness to tighten policy further should risks to inflation materialize in a way that such action became appropriate.” (link)

RedBird Capital Partners and Weatherford Capital announce Collegiate Athletic Solutions (CAS), a “purpose-driven, dedicated capital and business-building platform for public and private university athletic departments.” From the press release: “Anticipating a revenue-sharing model, the CAS platform and capital can help offset incremental, athletic-related expenses and, when needed, right-size operating structures. Understanding that every state has nuanced governance, financial, and legal structures, CAS has developed bespoke programs to meet the needs of both public and private universities nationwide.” Weatherford Capital Founding Partner/former Florida State QB/FSU trustee Drew Weatherford: “We are in the late stages of the competitive divide between athletic departments and programs. The impact of conference realignment, diverging media rights deals, and the advent of NIL and revenue sharing is creating a greater financial divide at both the university and conference level. History has proven that the universities that adeptly invest in their athletic departments consistently win and outpace peer institutions. Our mission at CAS is to offer athletic departments a unique capital solution to invest when and where they need it to compete at the highest level during this tenuous paradigm shift.” (link)

Weatherford tells Yahoo’s Ross Dellenger that “no school has said, ‘No, that is not something we would consider.” He also says CAS is in “deep conversations” with a “handful” of athletic departments but declines to name specific schools. At least three power conference ADs have confirmed as much to Dellenger with one AD saying: “If you want to compete at this level, private equity and capital is really important. I’ve been talking to these people for 10-12 months. I haven’t pulled the trigger. But is this what you are going to need to be successful and survive? Yes, it is.” Weatherford reiterates that CAS is seeking neither ownership stakes nor managerial roles within athletic departments; however, he notes CAS would aim to be advisers for presidents and athletic departments in managing revenue growth. Dellenger: “After all, they do have an incentive to see increases in a department’s revenue: They earn a percentage on any new annual growth. Over a 10- to 20-year period, that percentage decreases from, perhaps, 22% in the first few years to 2% by its end, as the firm meets its original principal investment. Weatherford describes this as taking a ‘revenue royalty.’ If there is no revenue growth, the firm doesn’t take a cut.” Weatherford: “They are not mandated to pay us back the money we give them. … I deeply personally believe in college athletics. As an ex-athlete, I owe a lot to it and so does my family. We believe in college athletics. I don’t like the fact that 10 to 15 teams have a chance to win a national title every year. I’d like that to be 40-50.” (link)

Sportico’s Eben Novy-Williams and Daniel Libit report CAS is “raising money and is already in talks with a number of other universities” and “plans to initially partner with five to 10 athletic departments, offering $50M to $200M to each.” In an email to Texas Tech AD Kirby Hocutt late last year, Cardinale wrote that the current tumult in college athletics has created “one of the most potentially transformative opportunities I’ve witnessed in my 30-year career in sports.” Novy-Williams and Libit also note CAS has one employee publicly listed on LinkedIn, former Big Ten Commissioner Jim Delany’s son, Newman Delany, who is listed as an SVP. The younger Delany requested from TTU a number of pieces of financial information in order to produce a “tangible TTU-specific analysis as the foundation for a constructive discussion.” Hocutt consequently sent an email to Red Raiders Deputy AD Jonathan Botros asking if he had “concern in sharing this type of general information.” Also from Novy-Williams and Libit: “CAS’ approach is different from traditional private equity, or even private credit. The group does not plan to take an equity position in any athletic department’s commercial venture, nor does it intend to secure fixed payments in return for the upfront capital. Instead, a source said, the deals will be structured with returns tied to new revenue generation.” (link)

Sportico’s Eben Novy-Williams notes there is a “misunderstanding in much of college sports regarding the nature of the talks between universities and private equity funds. Yes, schools are looking for infusions of capital, but I expect to see those talks yield significantly more private credit deals than private equity deals. … Private credit is likely an easier sell in public academia, and it would be backstopped via contracted media rights and football ticket sales, two fairly stable income streams for top college sports programs.” He also points out it’s important to know how much money athletic departments would need to borrow before striking a private credit deal. “Overestimating could leave a school with an excess of expensive up-front cash, with needlessly onerous terms on the back end.” To that end, if a House settlement is reached, schools would likely have a better sense of their budgetary needs moving forward, and “for better or worse, that’s likely enough to get the ball rolling on a new era of financing in college sports. The barbarians are at the gate, they’re just waiting for it to unlock.” (link)

ESPN and TNT have reached a five-year agreement for TNT to sublicense select College Football Playoff games beginning with the upcoming season. Specifically, TNT Sports will present two first-round CFP games during the 2024 and 2025 seasons and add two quarterfinal games each year beginning with the 2026 season through the 2028 season. ESPN will present all other CFP games on its platforms as well as continue to manage the sponsorship program for the presentation of the CFP. ESPN EVP of Programming & Acquisitions Rosalyn Durant: ESPN is pleased to sublicense to TNT Sports a select number of early round games of the College Football Playoff, an event we’ve helped to grow – alongside the CFP – into one of the preeminent championships. All 12 Pac-12 presidents and chancellors are expected to approve the terms of the House settlement, according to The Mercury News’ Jon Wilner. Campus CEOs will meet on a video call this week, likely Thursday, and are expected to give their stamp of approval. How the distribution reductions will play out among all 12 institutions with 10 leaving for other conferences remains unclear, but Eric MacMichael, an attorney for Washington State and Oregon State, tells Wilner the House case was “front and center in our thinking. We had to address that. It’s an existential case for the NCAA and all the (named) conferences.” Wilner: “In other words, WSU and OSU were wary of holding the bill for the 10 departing schools. And the 10 departing schools didn’t want to have to pay double damages, with the NCAA withholding their distributions as members of the Pac-12 and their new conferences. Details are murky. But according to an industry source, NCAA officials, conference commissioners and key attorneys have discussed how to handle the damages for schools that are changing leagues this summer. The source says: “The two (WSU and OSU) are not getting stiffed, and the 10 are not getting stiffed — they aren’t having their shares reduced twice.” (link)

Undergraduate enrollment increased by 2.5% this spring, according to a report from the National Student Clearinghouse Research Center. This marks the second consecutive spring that enrollments have increased and it builds on last fall’s 1.2% bump. Inside Higher Ed’s Liam Knox: “Most notably, spring enrollment in bachelor’s programs is up for the first time in four years at both public and private nonprofit institutions—and the 2.3% average growth rate is higher than the fall’s, a rarity. First-year enrollment is up by 3.9% overall, though it fell by 1.5% at private nonprofit four-year institutions. Graduate enrollment was up by 3% this spring, reversing last year’s losses. … For the second year in a row, undergraduate enrollment rose at [HBCUs] as well, and at an even higher rate: 4%, compared to 3.2% in 2023.” This spring also marks the first time since the pandemic that enrollment has increased across all four geographic regions. Georgia (6%) and Kentucky (5%) experienced the highest increases while only Washington and West Virginia had declines of 1% or more. (link)

Northwestern has retained Nations Group to serve as its owner’s representative and oversee the construction of a temporary athletics facility on campus. The temporary facility will house a majority of the Wildcats’ home football games, as well as soccer and lacrosse, during the 2024 and 2025 seasons while Ryan Field is overhauled. (link)

Seattle has begun work on the Wright Family Athletic Performance Center, a renovated space with brand-new equipment, including cable machines and two-sided weight racks to optimize space, as well as a new sound system and television displays. A new flooring system will include an offset turf surface. In addition, through a partnership with the College of Arts and Sciences, force plates and a camera monitoring system will be installed, allowing for enhanced biomechanics testing and research opportunities for the Department of Kinesiology. An additional 600 square feet will be dedicated to a fueling and nutrition station, rehabilitation space, and workstations for the athletic performance staff. (link)
