The NCAA aired a new PSA during the pregame for last night’s Super Bowl, utilizing commercial inventory that had previously been used to promote March Madness, per SBJ’s Ben Portnoy. This year, the association chose to tout its recent efforts, as NCAA SVP of Business Performance Brian Higgins tells Portnoy: “We thought with all the other things we were doing in the national office — to do more for our student-athletes and hopefully change some of the image of the NCAA — that it would be a better use of that 30-second spot to talk about the holistic student-athlete model and the mental health services that are going to be available for students.” (link)

Distribution of the Pac-12’s intellectual property rights continues to be a subject of talks between Washington State and Oregon State and the 10 outbound members, and one person involved in the process tells JohnCanzano.com’s namesake: “We are continuing to work through the exact language. The goal is to arrive at a place where both the conference and the departing schools are able to use the archival material.” Another notes that the “conference owns all the IP and there’s value to it.” At least two documentary film production companies, including one from Amazon Studios, are already inquiring about a project documenting the league’s downfall, and another source tells Canzano: “The idea of a documentary was briefly discussed. Somebody is going to do this, we think. You’re either involved with it or you’re not. If we want to see it done accurately, we should probably be engaged.” Other unknowns moving forward include the fate of the Sam Ramon production facility, what happens with the Pac-12 social media channels, and who owns the league’s data. “Meanwhile, Commissioner George Kliavkoff continues to represent the Pac-12 at meetings. Someone has to show up, I guess. But he’s in the way of whatever comes next and nobody I spoke with expects Kliavkoff to be on the job after June 30. The archival video footage isn’t the most important element to any of the involved parties. Nor is the operation of Pac-12.com, the data, or the conference’s Twitter account. Kennyhertz Perry attorney Mit Winter points out that under federal law medical residents are classified as both employees and students and often unionize and collectively bargain. Extra Points publisher Matt Brown points out there are examples of unionization in some states but “a closer look at the realities of graduate student and medical resident unions would not make me excited about emulating anything about that for other workers. The deck is not stacked in their favor.” OSKR Founder Andy Schwarz also weighs in: “This is why I keep saying the NCAA should let athletes unionize and then take advantage of how fragile and difficult to organize that union would be.” Winter believes it wouldn't be as difficult as some people assume. “We wouldn’t be talking about every college athlete or even every DI athlete in a given sport.” Schwarz replies: “I think the very first union contract would be decent and represent a high-water mark. At the next negotiation, the ‘owners’ would lock out the athletes until they begged to return, a la when the Pac-12 athletes threatened a boycott so Larry Scott canceled the season. … Sure, both sides lose in a work stoppage. Which side has more to lose from losing a season – the guy with a four-year college or the school with 150 years and running?” (link, link)

Related, former NFLPA Executive Director DeMaurice Smith was paid $7.85M in 2023, his last full year on the job, according to Sportico’s Eben Novy-Williams and Daniel Libit, who also note the union’s net assets now stand at $781.3M. Nebraska drew a record 15,042 fans for its women’s basketball upset win over Iowa yesterday. (link); After the game, Hawkeyes HC Lisa Bluder tried to get into the media room, according to KGAN’s Owen Siebring, and was heard shouting on an external microphone: “We’ve got a flight to catch. This is bulls–t. This is not Big Ten protocol. … They play music while you shoot free throws and now this?” Siebring notes the visiting team is traditionally supposed to go to the podium first. Louisville Women’s Basketball HC Jeff Walz voiced his displeasure with the officiating in the Cardinals’ loss at Syracuse yesterday. Down by one with less than five seconds left, UL fouled to stop the clock. WDRB’s Eric Crawford: “You see it at the end of every game when a team needs to foul. Two hands extended, maybe a semi-wrap up, and a whistle. Almost every game. Except this time, when the whistle blew, the official raised both arms, crossed, to signal an intentional foul.” Walz: “It was a God-awful call. It was terrible officiating. They should be embarrassed. But you know, I'll get my fine. I'm sure I'll get a letter of reprimand. But at this point, somebody has to start holding the officials accountable. That call was the worst call I've seen in my 29 years of coaching. If we’re going to start calling that, every foul at the end of a game when a team has to foul, it’s intentional. Every foul is. We all know it is. But to call it in a one-point game with 2.5 seconds left, it’s just awful. It's atrocious. It's embarrassing. It's embarrassing for our league. But we'll never hear anything about it because it's such a sacred society that we can't ever reprimand publicly an official, God forbid. But we'll reprimand coaches and players will be called out. But there's three people out there, God forbid, if we came out and we actually said a league made a statement that it was a blown call, a bad call. We won't do that.” (link)

Boise State Softball HC Justin Shults sat down with D1.ticker’s Matt Roberts at the 2023 NFCA Convention to discuss the growth of the sport and how to sustain success overall while maintaining parity in the changing landscape. Shults points out the transfer portal is a double-edged sword, through which people are “getting approached probably unethically, But I think at the same time I've been able to build a culture and to create a product that we're proud of, and part of it's the people who didn't buy into that blue-collar way. It was actually faster for us to allow them to go find a new home, so I think the portal is good. … The rich are going to get richer, but for us it’s how do you find the right recruits whether it's portal or high school kids, and then your job is to keep them. I think as a mid-major or whatever we're going to call ourselves, our job is to create an environment that they want to stay.” Shults notes that while there are NIL opportunities for softball student-athletes, that’s not the focal point of his recruiting pitch. “The focal point is coming in with that chip on your shoulder…and do you want to be a part of something that's different because right now it's easy to hit the portal, go join a super team and play. + Michigan is expected to hire Chicago Bears Chief of Staff Sean Magee as a Senior Assoc. AD/GM for football, according to 247Sports’ Matt Zenitz. Magee served as Assoc. AD for Football for the Wolverines from 2017-21 and “helped build the Wolverines from a roster, staff and culture standpoint,” Zenitz notes, adding that an SEC school had also been targeting Magee for a Deputy AD role. The shortened two-year bidding window for NCAA championships led to the Greater Raleigh Sports Alliance to present bids largely for sports it has hosted in the past, namely men’s basketball, College Cups, golf, gymnastics and the DII College World Series. The News & Observer’s Luke DeCock notes there have been talks about the GRSA presenting bids to host other events, including wrestling, a volleyball regional and the Frozen Four. GRSA Executive Director Scott Dupree: “I’m pretty confident we would sell out (wrestling) and make it a successful event. I just think it creates potential complications. We decided to focus on men’s basketball. I know we’ll look at wrestling again next time. … I can’t say it for certain, but I can say it with a good deal of confidence, a lot of these decisions would have been made differently in a four-year window. That would have given us, in a big-picture kind of way, a lot more flexibility, a lot more options. In a four-year window, our final bid package would look different. I couldn’t tell you exactly how, but different.” (link)

Puck’s John Ourand and Matt Belloni unpack the ESPN-Fox-Warner Bros. Discovery sports bundle and Ourand notes that “at least one league is looking into whether the networks even have the rights to carry their games on this new platform. It’s clear that they aren’t taking this lying down. … What has particularly struck me during my time in Vegas this week is how little anyone actually knows about this plan—even from the companies involved. We don’t have a name. We don’t have a price point. We don’t know who’s going to run it. We don’t have an official launch date. All we have is a lot of angst from leagues and distributors who were kept in the dark about all of this.” They also discuss Endeavor’s planned divestments as majority owner Silver Lake continues raising money to take it private. While WME, the agency, isn’t likely to be going anywhere, Belloni says On Location “seems the most likely to go, according to people I’ve talked to.” (link)

The Wall Street Journal’s Joe Flint, Isabella Simonetti, Jessica Toonkel and David Marcelis take a comprehensive look at the ESPN-Fox-Warner Bros. Discovery sports bundle and observe that “with the streaming venture, Disney, Warner and Fox have decided to leap into a new business even if it accelerates cable’s collapse—with the real risk that what they are building won’t be anywhere near as lucrative. As one rival executive put it, they are tearing down the house to put a shed in the backyard.” Former ESPN Chairman Steven Bornstein agrees: “It just further decays the bundle, which is the lifeblood of these companies. I would be concerned if I was sitting at Disney and Fox and Warner Bros. about being part of something like this.” Crakes Media Principal Patrick Crakes, however, contends: “We’re doing what should have happened slowly over 20 years all at once now. This is not going to save anybody, but it’s a start.” Flint, et al. go on to report that “a number of private-equity firms, including TPG, have expressed interest in possibly investing in the new company,” though it remains unclear whether Disney, Fox and WBD want financial partners. Before the new streamer can become fully realized it will have to pass muster with federal regulators, which is not a given, according to former FTC Chair/General Counsel William Kovacic, who asks: “How do you assure that you get collaborators who have a common interest to schizophrenically step aside and go after each other’s throats” when competing for content rights? Sportico’s Michael McCann & Daniel Libit break down potential arguments coming in Tuesday’s Tennessee + Virginia case against the NCAA. Notably: “...even if the judge agrees on the underlying legal issues of the case, obtaining an interim remedy can be tricky and requires threading a needle. Judges often find if a TRO isn’t warranted, neither is a preliminary injunction; both require a showing of irreparable harm (among other factors). [...] To boost their argument, the Attorney Generals warn the stakes now are altogether different. While a TRO would have lasted until there is a PI hearing (literally one week—from Feb. 6 to Feb. 13), a PI would last until a trial. No trial date has been set and likely would not occur for months, or longer. So Skrmetti and Miyares stress in their new brief that the amount of harm suffered by players ‘will balloon’ if forced to wait ‘until the end of trial.’ [...] expect the NCAA to argue they still lack a credible argument for irreparable harm since the kinds of damages at stake are either curable by monetary damages (compensating the athlete for earning less in NIL than they might have without NCAA restrictions) or too speculative and conjectural for legal redress (maybe a recruit would have picked a different school and had a different athletic career and life in a different world of NIL).” Lots more. Tennessee has retained Bill Burck of the Washington D.C.-based firm Quinn Emanuel Urquhart & Sullivan to take on the NCAA. Burck is known for previously serving as President George W. Bush’s special counsel, sending Martha Stewart to jail and representing New England Patriots owner Robert Kraft, among other notable names. Burck and his team of attorneys will “provide legal counsel and investigate” matters “in connection with allegations of rule violations by the NCAA.” Burck charges $2,250 per hour and his junior associates have an $880/hour rate, but the lawyers have “agreed to discount our standard hourly fees by 15% for this matter,” according to the contract, which was signed on December 4, almost two months prior to reports that there was an NIL investigation going on. Also of note is the Vols changing lawyers, having previously retained Bond, Schoeneck & King for its prior NCAA investigation. The Knoxville News Sentinel’s Adam Sparks observes: “This time, UT retained a lawyer who specializes in white collar crimes and government and regulatory litigation. It relates well to the Tennessee attorney general’s federal lawsuit, which is challenging the NCAA’s rules under antitrust laws and running parallel to the NCAA investigation into the university. NIL rules are being challenged as unlawful in a case that could reach Washington, where Burck is a seasoned insider.” (link)

Samford AD Martin Newton sits down with Southern Conference Assoc. Commissioner for Brand Strategy and Broadcast Dave Friedman to discuss Newton’s work on the Men’s Basketball Committee. The strategy of on-conference scheduling, Newton says, depends on the level of the team. In Samford’s case, the key is to schedule wins. “We’ve got to try to get as many wins. You want your winning percentage for your conference to be as high as possible. I think our winning percentages in our conference non-conference was somewhere over 50. 53% somewhere in that neighborhood. Realistically you'd like to be in that 60% range, if you could, of winning your non-conference games, and so in our level that's important.” For the Power 6, Newton notes it’s important for teams to challenge themselves, “That you get good Quad 1, Quad 2 opportunities, that your strength of schedule is strong so that you're not just playing a cupcake schedule, that you then rely on your conference to pull you up.” As far as the role injuries play in the committee’s deliberations, Newton points out there is consideration of how players who miss time and come back and change the construction of a roster. “I'll give you another example that's changed. We had the transfer rule that changed in December and now all the sudden you had some teams that had somebody that was sitting out that they weren't expecting to play, and they became eligible before conference play and that changed the dynamics of that team. So those are all things that you've got to consider and, again, that's why it's really important to do your homework of not just looking at the analytics, but also watching the teams…so you can see the full body of work. The Harvard Crimson’s Jo Lemann and Tyler Ory provide this update on the Harvard Football head coach search: “After The Crimson reported on Thursday that McDermott offered the head coach position to Andrew Aurich, a tight ends coach at Rutgers University, Harvard football alumni and players expressed concern about Aurich’s hiring, citing an expedited search process and Aurich’s lack of head coaching experience. Many said they preferred one of the two internal finalists for the role, particularly Scott A. Larkee ’99, the team’s current defensive coordinator. The hiring has still not been publicly announced by the College and Harvard is currently completing a background check on Aurich, according to a person familiar with the process.” Consequently, former Harvard football student-athlete Joseph Mattson ‘99 spoke out: “Many people, myself included, are either pulling back contributions that they’ve promised to the program, or deciding not to contribute further to the program.” Gilman Gear President and Harvard football alumnus Neil Gilman “said that he recommended Chip Kelly, the outgoing head coach at UCLA, but felt he wasn’t pursued strongly enough, despite Kelly expressing interest to Gilman about the role.” The school does not comment on personnel matters or hiring processes. UNC Asheville is facing a $6M budget deficit that must be closed by June 30 and will “curtail” adjunct faculty as it seeks to cut costs, according to Chancellor Kimberly van Noort, who says the shortfall has been caused by a 25% decline in enrollment the last five years. If the deficit is not reconciled, van Noort warns it could swell to $8M next year. “Are we in what is called financial exigency? No, we are not. This is not an existential crisis. But we are addressing it now before it becomes one.” (link)

Marshall President Brad Smith told the board of governors this week that the school’s deficit has been reduced from $28M to $22M, primarily thanks to growing enrollment, tuition, fees and residential housing. Further, an additional $3M has been identified by faculty and staff which would reduce the structural deficit as the current fiscal year concludes. Smith: “I’m pleased to tell you that our financial plan is working. If we stay on the course and continue to execute well, we see a pathway to a strong and sustainable university.” (link)

Extra Points publisher Matt Brown is skeptical the SEC-Big Ten joint advisory group will have the impact on the current state of affairs that many are predicting: “The idea that the Cleveland States and Hofstras of the world are somehow holding the Big Ten and SEC back from meaningful reform is…not accurate in the autonomy era. There is very little that the major conferences actually really want to do that the NCAA legislative process is preventing them from doing. The NCAA governance process is Kafkaesque, and everything takes longer than it probably should, but that’s not the real barrier here. The problem is that the Big Ten and SEC aren’t actually in charge. They can’t come up with a policy reform, by themselves, that will stand up to legal challenges. There are too many antitrust liabilities, too many labor law liabilities, and now, too much political benefit at stake for state AGs to take a whack at the NCAA piñata whenever good ol’ State U is inconvenienced. The court system is now, fundamentally, in charge of college sports. Reform might make a pit stop at the Rosemont offices of the Big Ten, but its actual destination is in Congress and courtrooms.” (link)

247Sports’ Chris Hummer caught up with 15 four- and five-star football recruits who anonymously disclosed either exactly or close to what they’ll receive in NIL compensation. Responses ranged from a “few thousand dollars a month” to $1M per year with most falling in the low- to mid-six-figure range. Hummer notes the first year of a contract is usually guaranteed at a certain number, but there are often incentives for players to raise their NIL payments based on how they play. Meanwhile, a few players noted their NIL payments could go down if they don’t perform well. Beyond cash, players often also receive additional incentives like a leased vehicle. Recruit 2, who reports he will make $400K per year, tells Hummer: “The way I have it, the first two years are 400 guaranteed, and after my sophomore year I can ask to renegotiate based on how I play.” As for what players are required to do to earn the money, responses varied from appearing at charity events and social media posts to just being on the team. Recruit 6, who will earn $72K per year: “It’s a collective thing. Just be part of the team, everybody gets it.” Recruit 14, who reports a deal worth $500K per year, says the reports of multimillion-dollar contracts are exaggerated. “People get paid to play. But the numbers that you be hearing are outrageous. … People are just lying and pushing it past what it is.” More from Hummer. (link)

Playfly has released a new study called the Playfly College Football Fan Score, which SBJ’s Ben Portnoy describes as a “combo of in-house metrics married with those accrued through a strategic partnership with Vision Insights to help quantify fandom and commercial viability in major college football.” There are two separate top 25 rankings, one for the Power 5 and one for the Group of 5, and they take into account passion (measured by enrollment and fan base size, attendance and viewership, team performance, fan engagement and participation and fan commitment) receptivity (fans’ responsiveness to advertising) and marketplace (mix of media and advertiser demand and athletic department revenue). Playfly CEO Michael Schreiber: “All these rankings all over the place, and most of them are performance-based, or coach salary-based. Nothing is really [written] on the marketing and commercial side – and that's where we live. So we thought it would be really interesting and useful to release those rankings." Playfly Head of Research Gregg Liebman adds: “Doing custom research, getting fans’ sentiment about the overall direction of the league, and sharing that with the industry – it was incredibly positive. ... A lot of those insights had not really been shared, and we're proud of sharing that and the health of the overall college landscape is really strong.” (link)

Reports have Amazon getting rights to exclusively stream an NFL Playoff game in 2025. (link); Further, NFL Commissioner Roger Goodell fielded questions from the media over the past week, including one regarding if/when the league will make the Super Bowl streaming-only. Goodell: “Certainly not in my time. … One of the secrets to our success is we are really committed to broadcast television. … I think it’s the reason you will see 200M people watch this game here in the United States, because it’s on broadcast television.” Goodell also noted that this season’s Dolphins-Chiefs playoff game on Peacock not only outdrew last year’s broadcast game in the same window, it also “reduced our average age of the audience by almost 10 years. Youth audiences are going to those platforms and those apps, and we have to make sure our content is there. We still have over 90% of our games on free television. No other league, no other sport comes close to that. When we were in the ‘80s, when we moved to ESPN and we went to pay TV, there was the same outcry. But what we did is we created a platform that fans can engage with, have access to, that is actually beneficial to the consumers because that’s where they are. We have to fish where the fish are.” (link)
