The DII Membership Committee officially welcomed Jamestown, Texas-Dallas and UC Merced into the expedited two-year provisional membership process, with Point Park to enter the three-year process. Allen, Edward Waters, Emory & Henry and Westmont have officially become full DII members, upping the division’s total to 293. USC Beaufort, Thomas More, Jessup, Menlo, Roosevelt, Sul Ross State and Vanguard all advanced in their respective process. (link)

The U.S. Third Circuit Court of Appeals today affirmed the dismissal of the NCAA’s motion to dismiss Johnson v. NCAA, thereby rejecting the NCAA’s “longstanding position that college athletes cannot be employees and athletes at the same time – an edict with major consequences for college sports in America,” according to Sportico’s Michael McCann, who adds: “At the same time, the Third Circuit ordered the district court to apply a different test to assess the athletes’ employment.” Specifically, McCann explains the three-judge panel instructed U.S. District Judge John Padova to “apply an economic realities analysis of the issue that is grounded in common-law (case precedent) agency principles. To that end, Padova should find that college athletes are employees if they (a) perform services for another party, (b) necessarily and primarily for the college’s benefit, (c) under the college’s control or right of control and (d) in return for ‘express’ or ‘implied’ compensation or ‘in-kind benefits.’” Notably, McCann points out that “given Padova’s findings in earlier rulings, it appears extremely likely he will conclude the athletes are employees. The NCAA could once again appeal, but if denied, the case would then move to pretrial discovery. That would be a momentous development. FLSA discovery tends to be public-facing, a factor that might incentivize the NCAA…to try to cut a deal.” Plaintiffs’ attorney Paul McDonald says the ruling “confirms what we've been arguing – that college athletes can be both students and employees. Because students are employees in work-study programs and athletes meet the same criteria, we're confident they will be found to be employees like other students." Tulane (DI) Sports Law Director Gabe Feldman adds: “Broadly speaking, this is another dent in the amateurism armor of the NCAA. The NCAA has been under attack in other areas of the law. This is a sign that employment cases are just getting started." McCann notes the case could take years to play out. The NCAA has released a statement on yesterday’s Johnson ruling, which reads: “Our focus remains on the ongoing effort we are leading to modernize college sports. The NCAA is expanding core guaranteed benefits for student- athletes to include health insurance, scholarships, academic counseling, mental health support, and career preparation. The Association is also advancing a proposal to allow schools to deliver far greater direct financial benefits to student-athletes. In modernizing college sports, student-athlete leadership from all three divisions agree that college athletes should not be forced into an employment model, which they expect will harm their experiences and needlessly cost countless student-athletes opportunities in women's sports, Olympic sports, and sports at the HBCU and Division II and Division III levels. We look forward to working with all stakeholders – including Congress – to continue to promote needed changes in the best interest of all student-athletes." (link)

The Men's Basketball Committee approved Indianapolis as the host site for the 2026 DII and DIII men's basketball championship games, as well as the semifinals and finals of the NIT. All five games are scheduled the same weekend as the DI Men's Final Four, which was previously awarded to the city. (link); Women’s Basketball will also host a joint championship for DI, DII and DIII in Indianapolis in 2028, pending DII and DIII approval. In another development that could impact NIL, U.S. District Court Judge Joan Lefkow has ruled that social media influencers can violate the law by failing to disclose a paid relationship with a brand. The ruling stems from a lawsuit brought by “two dissatisfied consumers of Blue Ice Vodka,” according to Sportico’s Michael McCann, who adds: “Mario Sava and Alin Pop accuse the vodka’s maker, 21st Century Spirits, and 10 influencers of violating the Federal Trade Commission Act (FTC Act), Florida and Illinois and California consumer protection statutes. The defendants are also accused of unjust enrichment, negligent misrepresentation and breaching express warranties. Sava and Pop, who seek for their lawsuit to become a nationwide class action and demand damages of ‘at least $11 per bottle,’ argue that marketing for Blue Ice is rife with falsehoods, exaggerations and distortions intended to mislead consumers. Among other grievances, Sava and Pop contend Blue Ice contains more calories than advertised” and isn’t “handcrafted” but is instead “industrially manufactured” by machines. McCann: “To illustrate allegedly problematic influencer behavior, one influencer apparently framed Blue Ice as a healthy alternative when stating she can make Blue Ice cocktails to contain fewer calories than an apple—a claim that doesn’t appear possible. … For athletes who influence, the case highlights that when they promote or amplify items to their followers, they should be mindful of potential lawsuits if they aren’t transparent about whether they’re being paid.” (link)
