+ Takeaways from the NCAA under the heading ‘Unresolved Issues’: “The settlement does not resolve the patchwork of state laws, many of which may conflict with the settlement. These laws will need to be preempted by federal legislation in order for the settlement to be effective. The settlement does not address ongoing efforts to designate student-athletes as employees under state and federal labor and employment laws. These efforts by the NLRB and plaintiffs' attorneys pose a direct threat to both the sustainability of sports programs (especially for non-revenue generating ones) and to the baseline of support provided to all athletes.” From A5 Commissioners & NCAA President Charlie Baker: “This settlement is an important step forward for student-athletes and college sports, but it does not address every challenge. The need for Federal legislation to provide solutions remains. If Congress does not act, the progress reached through the settlement could be significantly mitigated by state laws and continued litigation.” (link)

+ Sportico’s Michael McCann reviews the full House settlement filing, says “challenges loom.” Key notes: “Wilken will weigh the settlement against the complexity, expense and likely duration of continued litigation. This preliminary review could take several weeks or months. Wilken might urge or require the parties to modify their settlement during the preliminary approval stage. For example, if she believes the distribution of funds would overly advantage some athletes and overly disadvantage others, the parties might rework the math to comport with Wilken’s suggestions. The judge might also contest areas of the settlement that punt key specifics to future deliberations. While preliminary approval might require settlement revisions and court hearings, Wilken will likely grant it. It is rare for an antitrust settlement to be rejected at an early stage since the settlement’s claimants—college athletes—have not yet been heard in court.” McCann goes on to outline multiple examples of lawsuit settlements that have been rejected by judges for a variety of reasons: “...keep in mind, those details are very much subject to change at the judge's behest. The UFC settlement has changed a lot over the last few months. Don't rely on NCAA settlement details yet.” (link)

+ Of the nearly 600 American athletes competing at the Paris Olympics, 75% of them played in the U.S. college system. More than 800 athletes with NCAA ties will compete for other countries in Paris. In all, more than 1 in 10 of the 10,500 athletes at these Games played college sports in the U.S. The Associated Press’ Doug Feinberg and Eddie Pells: “None of this comes cheap. One estimate is that NCAA schools spend more than $5 billion a year on so-called nonrevenue, or Olympic, sports.” That level of spending, of course, could be changing with the impending House case shakeout. On that front, CEO of the USOPC Sarah Hirshland: “It is extraordinarily top of mind to us. We’re going to keep a close eye on programs being cut, or even talked about being cut. … We’re going to do everything we can to contribute to saving that system because it works beautifully for us and, frankly, it’s the envy of the world.” (link)

Barton AD Ken Tyler chats with The Wilson Times’ Paul Durham about his first year leading the Bulldogs, areas of growth and more. “We’re really excited about where we are and where we’re going, but the job of athletic director, really, over the last 10 years or so, has evolved a great deal. […] Really, you know, I’m running a mid sized business here and that’s the way that we approach it. But we always have to remember our why, and that is, you know, providing opportunities for student-athletes, enhancing the educational and academic mission of Barton College.” As for what lies ahead, BC’s addition of Field Hockey will replace the planned addition of Acrobatics and Tumbling, with Field Hockey serving as a better fit. There are a number of facility projects ongoing in Wilson, including a new multi-purpose locker room for the visitors side of Truist Stadium and an overhaul of the tennis complex. On the role of the Bulldog Club: “Really, we want people to understand that the Bulldog Club supports all of Barton athletics — and that’s a little bit of a culture shift, language shift from the way it used to be. […] We have a unique opportunity in athletics to help ourselves, a little bit anyway, even at our level, and so we’re going to be very aggressive in trying to do that. The landscape these days for small colleges is challenging, kind of like newspapers, and it’s competitive. The margins are extremely thin and so, we’ve got to watch every dollar, every resource and we’ve got to be careful. But I also — this maybe goes back to my days as a basketball player, you know, I was a scorer — and I want to play offense. I want to be aggressive.” More. (link)

At last month’s DII Legislation Committee, the committee adopted a number of pieces of noncontroversial legislation pertaining to NIL, eligibility, awards and benefits and more. On NIL, institutions are now allowed to “contract with third-party service providers to provide student-athletes the same support an institution is permitted to provide, the proposal does not permit institutions to contract with third parties to do what institutions are not permitted to do.” The committee will now allow student-athletes to participate in collegiate all-star contests, effective immediately, and compete in outside competition during the nonchampionship segment. Changes to awards, benefits and expenses bylaws will now eliminate the awards legislation, limits on complimentary admissions a school can provide to student-athletes for contests and more and allow institutions to cover student-athletes' unitemized incidental expenses for NCAA championships, meals and snacks to student-athletes at any time “on an occasional basis,” allow student-athletes to accept free or discounted equipment or supplies and more. NCAA Director of Digital Communications Chris Dion chats with Collegiate Sports Connect’s Stephanie Garcia Cichosz to discuss the association’s Made Here campaign tied to the 2024 Olympic Games, preparing and forecasting for the 2028 Olympics in Los Angeles and more.
