ESPN’s Pete Thamel reports that “all sides are working to complete the longform of the settlement in the House case, which is expected to be finalized in the upcoming weeks and presented to Judge Wilken. A few details need to be hashed out in the near future, per sources. The range of roster limits being discussed is between 100 and 110, with the Big Ten (DI) lobbying for the higher side of that range. There’s discussion of a ‘phase in’ on this, so teams with giant rosters – think 130/140 – potentially don’t have to make immediate giant cuts for 2025. “There’s framework being discussed about the enforcement mechanism around collectives. Those details may not be fully hashed out until after the longform is done. Enforcement, always, is vexing for everyone. Don’t expect immediate clarity on how athletic departments will handle monetary distribution. That’s still a major topic, but not one required to be addressed in this settlement.” (link)

The MIAA is the latest to eliminate its intraconference transfer restriction. Commissioner Mike Racy: “I think the landscape of things have changed with the NCAA transfer rule. Obviously, the threat of litigation of having that type of policy puts the conference and schools at risk. […] The way I look at it as commissioner of the MIAA if we have a student-athlete that doesn't feel like they're getting what they need out of an athlete experience at at a particular Institution for whatever the reason, if we can keep them in our conference and let them have success someplace else, that's great. Not all of our institutions would feel that way but certainly someone that thinks about the MIAA as a brandand how we're perceived and our overall strength from sport to sport both regionally and nationally, we want we want the best student-athletes to come to the MIAA and we want them to stay in the MIAA and graduate from our MIAA schools.” Starting this year, the MIAA Network will add a new feature where institutions can designate contests as premium events, such as non-conference football games, which will allow unique pricing for individual game purchasers. Sportico’s Michael McCann and Daniel Libit break down Chalmers et al. v. NCAA et al and note that “effectively, the new lawsuit attempts to provide a vehicle for at least a subsection of former NCAA athletes who are time-barred from receiving House settlement money to seek recompense for the appropriation of their NIL that occurred within the statute of limitations. … The Chalmers plaintiffs seek actual and treble damages as well as a permanent injunction that would enjoin the NCAA ‘and any person acting through it from relying on any unenforceable assignment of publicity rights.’” Attorneys for the plaintiffs contend in an email to Sportico that “the anticipated settlement in the House case provides compensation for college athletes who competed since mid-2016. But the NCAA’s illegal conduct harmed and continues to harm many more former student athletes.” As for how the case may play out, McCann and Libit explain that “probable defenses include contesting the statute of limitations argument offered by the plaintiffs. In addition, the NCAA could cite First Amendment protections for use of newsworthy events. … Players could rebut that defense in several ways, including by stressing that pro athletes are routinely compensated for the use of their NIL in broadcasts and video. However, at least one federal appellate court, the U.S. Court of Appeals for the Sixth Circuit, has rejected players’ claims regarding use of their names and images on televised broadcasts.” (link)

Seton Hill DC Kevin May gets the profile treatment from ESPN’s David Hale for his innovation of “the flex” defense and how it has helped the Griffins’ defense go from middling to a squad that finished ‘23 fifth in sacks and tackles for loss. May’s system utilizes one down lineman and six other defenders in the box who could all pressure or drop into coverage, with May adding it calls for “non-traditional players aligned in spots where they normally don't align, and they have the ability to do a lot of non-traditional things. Every offense has a playbook with all different looks they're likely to see. They're not going to see a picture of our defense in there.” Hale: “At its core, May's defense functions like an algorithm, full of if/then commands that usually rely on the same basic underpinnings but with minor changes based on the look the offense presents. Each player has his set of rules and responses, refined over time, and when it's all clicking, those players who barely sniffed a Division II offer elsewhere look like absolute superstars.” Those players get slotted into four categories by May with the lowest level still working on the nuances of their position and the highest level veterans understanding every facet of the defense and what the offense is trying to achieve. HC Daniel Day: "It blows my mind that people don't want to run this. If you ran this at Alabama, with the best of the best, I don't know how you'd stop it. […] You won't see anyone practice the way we do anywhere at any level. But it's all because Coach May's biggest aspect to the players is you celebrate together. It's not just the plays, but how we practice, the culture he's built to allow these dudes to have some fun.” Lots more. (link)

Fitch Ratings has released its latest annual medians report for U.S. private colleges and universities, which shows that despite an increase in net tuition revenue growth, the “uphill battle continues” for the sector. Fitch Ratings Senior Director Emily Wadhwani: “Looking ahead, additional operating pressure is expected through with many institutions grappling with elevated costs and a fractured enrollment environment. Cash flows and coverage are likely to face continued pressure, particularly emerging from an admission cycle fraught with FAFSA issues this spring casting concerns over fall enrollment expectations. … Limited increases in tuition will be insufficient to mitigate still-elevated operating costs, which over time will further widen the credit gap between larger, more selective institutions versus their smaller, less selective and more tuition-dependent counterparts.” Strong balance sheets for these schools allowed for the available funds levels to hold steady in FY23 against expenses and adjusted debt. Further, Fitch’s release notes that “Leverage and liquidity medians returned to slightly better than pre-pandemic levels, a favorable development which will in time be tempered by still-narrow operating margins and hampered operating flexibility.” (link)

Tennessee (DI) professor Shannon Scovel discusses the role of equitable publicity in Title IX compliance and says there is this “presumed expectation that certain teams get certain coverage and certain teams get certain publicity support. So this is something as simple as cheerleaders – if they only cheer for the men’s football team and no women’s teams, that’s a potential violation. There’s more flyers promoting the men’s football team than the women’s basketball game – that’s a potential Title IX violation. And it all depends on how [schools] balance that promotion with other sports at the school and the gender breakdown of students at the school.” While media companies are not beholden to Title IX, Scovel notes the media’s “perception of interest is impacted on what they know, which is often a result of schools’ publicity – who are schools promoting in their press releases, who their school sports information director is sending pitches to journalists about certain athletes, who’s kind of in the public ethos, public discussion as an relevant athlete. And so a lot of that does fall on schools and yes, sports information directors overworked. They have a lot of things on their plate. But their job is to promote their athletes and the success stories of the student athletes on their campus, and they should be doing that in a way that celebrates men and women athletes.” In a study conducted by Scovel, she found that “80% of the 300 articles that were published during that [first week NIL was legal] that used the phrase ‘name, image, and likeness’ were about men – specifically men’s basketball players and men’s football players – and the argument that journalists [made] very subtly was that these are quote revenue-generating athletes. … These journalists were telling us which athletes were important, which athletes were ideal ambassadors, and why and which businesses should then sponsor these athletes.” Lots more.
