Two more lawsuits have been filed against the NCAA. Rutgers men’s basketball student-athlete Jeremiah Williams, who transferred from Iowa State this offseason but has remained in “eligibility limbo as he awaits a ruling after violating the NCAA’s gambling policy, filed a lawsuit against the NCAA on Thursday seeking an injunction to become immediately eligible in time for Saturday’s game against Michigan,” according to NJ.com’s Brian Fonseca. According to the complaint, the NCAA suspended Williams for 15 games on January 31, and attorneys for Williams argue Williams “has already served his 15-game sports-wagering suspension in anticipation of that announcement.” Williams has sat out all 20 games the Scarlet Knights have played this season. The NCAA is arguing that “because its now-unenforceable transfer rule was in effect during the first nine games of the season: (a) those nine games do not count against his sports-wagering suspension; (b) Plaintiff must therefore serve his entire sports-wagering suspension based on games played after December 13, 2023, rather than receive credit for the nine games he sat out before that date; and (c) Plaintiff is therefore not eligible to play beginning with Saturday’s game and will not be eligible to play for Rutgers until February 18, 2024.” (link); Additionally, Manhattan MBB student-athlete DeJuan Clayton, who transferred from Cal, is seeking another year of eligibility on a medical hardship waiver. The complaint also contends Clayton “was forced to endure harsh and egregious treatment” from the Cal coaching staff. (link)

Seminole Boosters President & CEO Stephen Ponder joins the Warchant Town Hall to discuss the renovations to the west side of Doak Campbell Stadium. Ponder says FSU has spoken with 1,750 of 3,000 season ticket holders in the top three “zones” according to the points priority system about how the renovations will impact the pricing and their seating placement and notes that 16% of the season ticket holders on the stadium’s west side account for 40% of the season tickets. “For 2024, we will have a reduced capacity…and everyone who was a season ticket holder in 2023 will have a seat in 2024. We're going to have about 7,000 temporary seats on that west side. We will start at the field and go up with those temporary seats and then we're going to start construction for 2025 from the back wall of the suites and come down.” Ponder goes on to note that 10% of the stadium’s current capacity is premium seating, and that figure will increase to 13% when the project is completed in 2025. “That group of 13% is funding roughly 80% of the total capital contributions needed, which is 50% of the project. … We needed the revenue piece in order to be able to” improve the stadium for everyone. Extra Points’ Matt Brown continues his look into the tax-exempt uncertainty surrounding collectives and notes that “since 2023, more than 40 NIL collectives have shut down, merged or relaunched under a new name. While some of the consolidation had nothing to do with the IRS, several collectives decided to reclassify or merge with other entities after the memo.” For instance, the Clemson-focused TigerImpact ceased operations at the end of 2023, and Executive Director Bobby Couch explains: “We thought, ‘Hey, this is inevitable,’ and then our lead counsel basically said that you just need to shut it down.” Ohio State-focused Cohesion Foundation Founder Gary Marcinick adds that he stepped away from the collective at least in part because he wasn’t comfortable discussing potential contributions when those contributions may not be tax-deductible for donors in the future. “The IRS ruling kind of put a cloud over it.” Meanwhile, Hail! Impact, which supports Michigan student-athletes, received IRS approval in September, three months after the IRS released its memo, and Brown notes Hail!’s business model is what separates it from others. The collective gives 70% of its charitable gifts to charities and 30% goes toward its operating expenses. Those percentages were initially the other way around, and President Chin Weerappuli explains: “What we realized after the initial conversations with the IRS is that directly giving dollars from the nonprofit to student-athletes is what they’re cutting down on. … There were discrepancies in how the payouts were made. The amounts were not considered reasonable or market rate, and so that’s what the IRS was really trying to snuff out.” More. (link)

Commissioner Josh Fenton: "College sports is at a critical conjuncture. It is important for NCAA conferences and member institutions to create a model that is aligned with the educational missions of our campuses, focused on the experiences and well-being of our student-athletes, and sustainable to allow for broad-based and equitable opportunities. Texas Tech posted $146.8M in revenue and $136.4M in expenses during FY23. The department’s revenue jumped from $110.3M in FY22 in large part due to a significant uptick in contributions, which increased from $28.75M to $56.25M YoY. Red Raiders Deputy AD/CFO Jonathan Botros indicated FY23 was an outlier, however, in that Tech used contributions received in previous years to pay more short-term debt on facilities projects. For example, it “recognized $7.7M in contributions to pay short-term debt on the Whitacre Center for Athletics Administration, a $9.4M project that started in 2020, and activated $5M in contributions to pay on the new Tech baseball team facility, a $14.5M undertaking,” per the Lubbock Avalanche-Journal’s Don Williams. Botros: “Instead of us showing the dollars that came in, let's say three years ago, toward this project, we showed them once we actually paid the commercial paper on them. A lot of that money sat in accounts, and this was something we did on many accounts. The interest rate environment was so positive for us the past several years that it was more advantageous to bring in donations toward facility projects and let that money sit because the interest earnings on it were more than the interest expense on construction. The department had ~$111M in debt in 2015, and Botros says the department will have shrunk that figure to $52M by the end of FY24. (link)

Nevada reported $49.5M in revenue and $49.53M in expenses during FY23. Nevada SportsNet’s Chris Murray notes this marks the third consecutive year the department has received at least $13M in direct institutional support after typically receiving $3M-$3.5M pre-COVID. Murray adds: “FY23's $13.3M in direct institutional support is expected to be the Wolf Pack's new norm moving forward as Nevada has prepared its FY24 budget to land around $50M, athletic director Stephanie Rempe told Nevada Sports Net on Wednesday.” Meanwhile, the Wolf Pack’s FY23 expense total is the most in history and a 9.5% YoY increase. The biggest YoY expense increases came from support staff (from $6.073M to $7.258M) and coaching salaries (from $8.216M to $8.838M). On the revenue side, UNR reported $7.502M in ticket sales, an increase over the previous year's $7.326M. Other major revenue streams aside from direct institutional support include direct state support ($4.836M), donations ($3.592M), the Mountain West media rights distribution ($3.335M) and student fees ($2.867M). + As construction continues on improvements to Booth Memorial Stadium, Kansas Football HC Lance Leipold says the players are excited about the opportunity to play home games at different venues next season, including Arrowhead Stadium. Speaking more broadly, he notes the $300M price tag is indicative of the momentum of the program and desire from donors and adds: “I think we'll hit even far north of [$300M] when the whole project of what's going to be done is completed. And I think it's really going to give us a chance to keep this thing on firm footing and build it for years to come. … What I found out upon my arrival is we’ve got a lot of passionate people that have been starving for some success on the football field, as well as supporting our basketball program and our other sports. Once we were able to give them a taste of success, I think things accelerated.” (link)

The NCAA finished FY23 with $1.3B in revenue and $870M in net assets, according to Sportico’s Eben Novy-Williams and Daniel Libit, who note the record-setting figures are largely attributable to the NCAA’s investment portfolio, which returned $63M after losing $72.3M in FY22. As of August 31, 2023, the NCAA had $815.3M of financial assets available within one year of the balance sheet, based on meeting $45.8M in cash needs, $29.6M in accounts receivable and its investments. Media rights revenue increased slightly YoY to $945.1M from $940M, likely due to escalators in existing contracts. Meanwhile, the NCAA reported distributing $670M to its DI members (up from $657M in FY22) and spending $192M on its DI championships programs and NIT tournament (up from $170M in FY22). (link)

Tennessee AD Danny White today released the following statement: “The NCAA generally does not comment on infractions cases (emphasis his) because there is a rule against it; however, that has not stopped them in the past from leaking information to the media as they did this week about us. Their actions made this ill-conceived investigation public and forced us to defend ourselves. It is clear that the NCAA staff does not understand what is happening at the campus level all over the country in the NIL space. After reviewing thousands of Tennessee coach and personnel phone records, NCAA investigators didn’t find a single NIL violation, so they moved the goalpost to fit a predetermined outcome. They are stating that the nebulous, contradictory NIL guidelines (written by the NCAA, not the membership) don’t matter and applying the old booster bylaws to collectives. If that’s the case, then 100% of the major programs in college athletics have significant violations. This is obviously silly and not productive, as is blaming the membership whenever they are challenged. We need to be spending our time and energy on solutions to better organize college athletics in the NIL era – something that NCAA leadership failed to do back in 2021. Student-athletes, prospective student-athletes, coaches, and administrators across the country deserve better, and I refuse to allow the NCAA to irrationally use Tennessee as an example for their own agenda.” (link)

ACC Commissioner Jim Phillips sits down with the Richmond Times-Dispatch’s David Teel for a wide-ranging interview and says he can’t discuss specifics of the litigation between the league and Florida State or whether that relationship is salvageable: “We will have to see where this goes, as we know it’s a process that could be lengthy. With that said, I can share that we will make every effort for our Florida State student-athletes, coaches, teams, and other administrators that have nothing to do with the legal elements to have a first-class experience as a member of this incredible conference. I’ve been really adamant with my staff about that. The reality is we have this legal issue going on, and we’ll deal with that and provide the necessary resources to make sure the ACC is protected and positioned to defend what we believe is right, and then on the other side of it, those kids deserve to have a really good experience in the ACC, and we are committed to making that happen, as we do year in and year out for all our schools.” Teel notes the disparate identities of the ACC’s members means there are varying perspectives on not just the FSU legal dispute, but also on the myriad challenges facing the industry. Phillips subsequently points out that it’s a “microcosm of the world. There’s just such chaos now in society and certainly in our space in college sports. So getting frustrated about it, or woe is me, that’s just so counterproductive. You try to (tackle it) head on; you try to deal in facts; you listen to the membership, and you try to drive in the direction they believe you should go.” (link)

Arizona President Robert Robbins talks with the Arizona Daily Star’s Ellie Wolfe about the university’s financial crisis and says he regrets the way the university handled its communication efforts: “I think we should have probably tried to prospectively address the misinformation that, you know, we didn’t lose $240M. There’s no fraud, there’s no financial malfeasance. I would have probably done a better job of doing communications around that.” Robbins says he has approached the situation as he would in his capacity as a cardiothoracic surgeon, and part of his diagnosis here involves asking: “How much does the university writ large value the market value of strong athletics?” Not only does having a strong athletics program attract students who want to experience big game days and school spirit, it also helps with fundraising across the university, Robbins notes, adding: “For universities that haven’t been to a bowl game in a long time, the amount of giving to the university dramatically goes up.” That said, Robbins acknowledges the “model of college athletics is broken. The patient is in the ICU and is in critical condition.” Cutting sports, Robbins says, is still on the table, outgoing Wildcats AD Dave Heeke’s comments to the contrary notwithstanding. More. Former Alabama Baseball HC Brad Bohannon “violated NCAA wagering and ethical conduct rules when he knowingly provided insider information to an individual he knew to be engaged in betting on an Alabama baseball game,” according to a Committee on Infractions hearing panel, which adds: “After he was fired by Alabama, Bohannon failed to participate in the enforcement investigation, in further violation of NCAA rules. The school and enforcement staff agreed that the violations in this case occurred when Bohannon communicated — via an encrypted messaging app — with an individual he knew to be engaged in sports betting activities and provided insider information about the starting lineup before notifying the opposing team. Specifically, Bohannon texted, ‘(Student-athlete) is out for sure … Lemme know when I can tell (the opposing team) … Hurry.’” Penalties include a 15-year show-cause for Bohannon, and Alabama will retain EPIC Global Solutions to provide a comprehensive gambling harm and student-athlete protection education program for student-athletes, coaches and athletics administrators. Arizona State is nearing an agreement with the NCAA to resolve an investigation into alleged ASU football recruiting violations. CBS’ Dennis Dodd reports the “school is expected to agree to findings of major violations in the case, which revolves around recruits being brought on campus during the COVID-19 recruiting dead period in violation of NCAA rules. A further postseason ban is not expected to be among those penalties. ASU in August self-imposed a postseason ban for 2023 in hopes of mitigating future penalties. On the table are potential show-cause penalties against former coach Herm Edwards and members of his staff, sources tell CBS Sports. That group includes current Las Vegas Raiders HC Antonio Pierce, who is considered a central figure in the investigation.” (link)

Leaders of The Collective Association, which counts Spyre Sports Group among its members, are meeting in Orlando this week to convene its inaugural summit, where Yahoo’s Ross Dellenger notes the conversation will surely include the inexorable conflagration between Tennessee and the NCAA. Oncoor President Russell White tells Dellenger the “NCAA is grasping at straws. This is just them trying to hang on to whatever they can. They’ve passed some new rules contradicting old rules. They make it real murky to operate in this space.” SANIL Founder Jason Belzer adds: “If you move the restrictions, there is no longer any reason for the schools to follow any rules. It’s going to be really bad. We know the system needs reform, but there are a lot of student-athletes going to be hurt by this. There are a lot of athletes who have poor representation. And now every kid is going to be an open-market free agent? It is absolute chaos. That’s a disaster.” Meanwhile, Walker Jones, executive director of the Ole Miss-focused Grove Collective, insists collectives aren’t anti-enforcement, but notes collectives and student-athletes are in precarious positions because of outdated policies. “Take, for instance, universities. There are inducements to regular students every day for academic performance in terms of research grants and scholarships. Why should student-athletes be any different?” More. (link)

In his decision to dismiss Ole Miss football student-athlete DeSanto Rollins’ $40M lawsuit against Rebels Football HC Lane Kiffin, U.S. District Court Judge Michael Mills found that Rollins was unable to clear sovereign immunity exceptions or prove that his alleged mistreatment by Kiffin was “motivated by gender or racially-based” discrimination. “Although Kiffin’s conduct in the meetings was certainly offensive and imprudent, it is more akin to immature insults and indignities than to behavior going ‘beyond all possible bounds of decency.’ … Both the University and Kiffin in his official capacity enjoy sovereign immunity, which they have not waived. Thus, this Court will only have jurisdiction if Congress has validly abrogated the defendant’s immunity.” Mills also found that Rollins, who maintains he was kicked off the team, “has offered no evidence that he was medically cleared to return or that he made any effort whatsoever to resume team activities after the March 21 meeting. Consequently, the evidence shows that it was up to Rollins when or if he resumed team activities—the decision was entirely his own.” Rollins plans to appeal. (link)

The Men's and Women's Soccer Rules Committee proposed substitution rules changes for men's competition, effective for the 2024 season. Specifically, the committee recommended that no reentry be allowed in either half once a player leaves the game via substitution. Additionally, teams will have six moments to make substitutions in a game, and substitutions can occur during any stoppage of play. Teams would be awarded an additional moment to make substitutions in overtime. The committee also recommended stopping the clock on all substitutions in the last 15 minutes of the second half and in overtime periods. Additional recommendations include expanding video review for potential PK situations, straight red card situations, offside violations and fouls that deny obvious scoring opportunities. Also, the committee is proposing using the sudden-victory format for postseason play. (link)

The SEC will change its postseason Baseball model starting at the conclusion of the 2024-25 season as all 16 programs will advance to a single-elimination tournament featuring a double bye for seeds 1 through 4 & a single bye for 5 through 8. The event will be held over six days in late May. (link)
