NCAA Legal News:

+ Hagens Berman attorney Steve Berman expects the full House settlement agreement to be filed on Friday: “We’re very close to wrapping. The amount of disputes right now are tiny.” Berman also tells the AP’s Ralph Russo the defendants have asked for the dismissal of Houston Christian’s (DI) pushback: “There’s no publicly filed agreement to be challenging at the moment. So we thought it was premature, among other defects.” More: “So the way this is going to work out is that at some point like 60, 70 days from now, after the notice goes out, if you’re an athlete, you’ll be able to get on a website and put your name in and the website will tell you how much you’re going to get out of the settlement.” (link)

+ Houston Christian’s motion to intervene in the proposed House settlement has been denied by U.S. District Court Judge Claudia Wilken. Wilken writing: “HCU’s arguments in support of its motion for intervention are essentially objections to the settlement agreement, which are premature because the settlement agreement has not yet been filed. But even if they were not premature, the Court would not consider them because HCU, as a non-class member, lacks standing to object to the settlement agreement. Accordingly, HCU may not re-package the arguments it made in support of the present motion to intervene as objections to the settlement agreement once the settlement agreement is filed for the Court’s approval.” (link); In response, Houston Christian attorney James Bryant tells Sportico’s Daniel Libit: “Obviously, we respect the judge and know she spent a lot of time trying to apply the law correctly. We don’t believe we have been heard. There are avenues we may be heard in and a possibility of further litigation at other times and places.” (link) 

+ Boise State (DI) law professor Sam C. Ehrlich via X (Twitter): “Interesting circumstances afoot in Fontenot v. NCAA...The plaintiffs filed an amended complaint adding 3 new members: Deontay Anderson (ex-Houston (DI)/Ole Miss (DI) football), Tucker Clark (current Colorado (DI) golfer), & Sarah Fuller (former Vanderbilt (DI) soccer **& football**).” Ehrlich also points out an addition to the pleading: “105. Defendants realize that there is no longer any defense for the concept of amateurism. They recently voted to move forward with a proposed settlement in the House case that would usher in a form of “revenue sharing” that ostensibly would be tied to NIL payments made by the NCAA’s members. But even if that settlement is approved, it would simply usher in a new, artificially low cap that is far below the revenue sharing that a competitive market would yield. While it is an admission that amateurism is not needed, it also simply substitutes one illegal price fix for another. 106. This case seeks to recover the full amount of compensation that these athletes truly deserve, and to enjoin Defendants from enforcing their illegal agreement in the future. It is not just about NIL but is about full revenue sharing.” (link)

Facilities & Fundraising:

+ Allegheny receives a $1.5M gift from International Automotive Components Group CEO/Football and Baseball alum Kevin Baird and his wife Lisa towards a new 10K square-foot football facility project which will include locker rooms, meeting rooms and more. AD Bill Ross: “This Center will benefit the entire athletic department. This major addition creates a domino effect. As the football program transitions to its new space, it allows us to relocate all of the sports teams that currently share locker rooms in overlapping seasons to their own dedicated locker rooms. Importantly, all coaches that use Robertson Athletic Complex, no matter what their sport, will be able to utilize the space for recruiting or team meeting purposes.” (link)

+ Millikin has begun work on the $12.3M David J. Rathje and Debra C. Rathje Athletic Center, which is set to open next summer. The project will include a new weight room, multiple team locker rooms and offices, training room and more. (link)

Team USA national governing bodies are increasingly looking to donors for funding, according to SBJ’s Rachel Axon, who notes the NGBs are attempting to boost fundraising efforts by “starting foundations; reviving existing foundations; hiring staff to bring in donations; or some combination of all of those.” Axon also points out that “for the 32 NGBs for which SBJ could compile complete data, a majority of them saw sponsorships make up a decreasing share of revenue since the 2018 fiscal year, while they were evenly split on whether their USOPC funding had increased or decreased as a share of revenue.” U.S. Speedskating Executive Director Ted Morris notes that “sponsorship is difficult right now, and it’s complicated by LA28 being the 800-pound gorilla. For the majority of the Olympic sports, we’re not big enough, we don’t have enough scale to resonate with the sponsorship environment. So much of the money is going to football, basketball, baseball, the big sports. … [In] fundraising, the possibilities are infinite.” U.S. Ski & Snowboard Chief Revenue and Philanthropic Officer Trisha Worthington adds: “I’ve been doing this a long time, and I am shocked at how many people do not understand that we’re not government-funded. I feel like a broken record, but if I don’t say it every single time, it’s a missed opportunity.” Several NGBs are hiring major gifts officers focused on increasing donations, and Axon reports that “USA Triathlon hired its first major gifts officer in 2022 and saw donations more than double over the previous year. It has since received an $850K donation to help women’s triathlon become an NCAA championship sport.” CEO Victoria Brumfield: “Those are real things that USA Triathlon just could not have done.” (link)
