SEC Commissioner Greg Sankey to ESPN/SEC Network’s Paul Finebaum on the issues facing college sports: “You just look at the last 24 hours. … You have an announcement among three media entities about a new streaming service, you have the situation at Dartmouth, you have other court filings, you have this decision about the temporary restraining order not being granted in the particular matter involving the Tennessee and Virginia attorneys general. That used to be like six months worth of news in college sports. That's all compressed into 24 hours and that's just the cycle we work on. That's why I tend to think if we look at the big scheme of things from an NCAA level and focus on trying to have the right set of oversight, make adjustments around outcomes of court cases, deal with the litigation that is already in front of us, that's the proper focus. I think that the pursuit of some of these particular cases through the enforcement process distracts us from solving the big problems. I at least have an understanding of why people pursue these issues; it hasn’t made it awkward for me. I get to have direct conversations with a variety of constituents every day.” (link)

U.S. Senator Chris Murphy (D-CT) and Representative Alma Adams (D-NC) have reintroduced a bill that includes provisions designed to strengthen Title IX public reporting requirements for schools. USA Today’s Steve Berkowitz: “Per summary from Murphy's office, the bill "will help weed out reporting tricks by programs to skirt non-discrimination laws and make it easier for athletes and stakeholders to evaluate persisting gaps in athletic programs or use publicly available data in their claims against schools." More from Arizona Interim AD Mike Candrea, who addressed the possibility of cutting sports during yesterday’s presser by saying: “The escalation of football and (men’s) basketball have caused us to take a look at everything else and that the average is what 17 sports in the Big 12? I’m hoping that we don’t get to that point for a lot of different reasons. But I can’t say that that’s not going to be something that will be looked at. I don’t think cutting sports is the answer to the problems that we have right now. You have to look at Title IX — there are a lot of different things that go into this. Just because 17 is the number in the Big 12 does not necessarily mean that that’s the right number at the University of Arizona.” Candrea also noted UA is not the only school facing headwinds: “We’ve done a lot of the right things. But I think now we’ve put the brakes on and said ‘Wait. Moving forward, what do we need to do to make this thing work?’ That’s the information piece that I don’t have everything in front of me right now. But I promise you that we have very talented people here that have a passion for this place, that are going to make this place better. I go back to telling them all, ‘Let’s make it 1% better every day and we’ll crawl out of this.’” (link)

North Dakota AD Bill Chaves worries the attention being paid to the issues dominating college sports headlines is coming at the expense of March Madness. “The brackets have become a cultural phenomenon with the first week full of David vs. Goliath storylines with the second and third weeks traditionally focused on the sport’s blue bloods. We (in the industry) all get that, we all understand it and we all accept it. What I do not want to accept is that the issues that we are dealing with today, mainly at the highest level of college football, will impact a cultural phenomenon that our country loves and cherishes.” Chaves acknowledges that “we, at those other schools,” – namely, those in DI but not FBS – understand why the conversation is so focused on FBS, “but for the layperson not working in this every day or an elected official that is working on other and potentially greater issues, what they should grasp is that first weekend of March Madness is at immense risk. Chaves points out that the machinations to form a European Super League in soccer were thwarted in large part by the fans of the very clubs trying to create it. They did so in order to protect the FA Cup, which includes every team at every level in professional English football. “March Madness is the closest thing that Americans have to that competition, and it is worth protecting and preserving.” (link)

On3’s Pete Nakos observes there has been something of a reset in the NIL market, a sentiment shared by Florida Football HC Billy Napier, who noted today: “I think each cycle, the market changes, if that makes sense. I think we’ve seen an evolution. We’re talking about drastic change every six months since I’ve been the coach here if that makes sense. It took us a little bit of time there to get in position but I don’t know that there’s a number. I think that number grows every six months.” Meanwhile, an SEC player personnel staffer tells Nakos: “What I feel like, it’s kind of been a shift from – at first it was the recruiting front because the incoming guys caught the first wave. They were the ones to be able to capitalize on the era when everyone was trying to figure out what was going on. It seems to me there’s been a shift from the early stage to the retain portion. More people are seeing it’s about maintaining your roster and keeping your guys another year, rather than the young fellas who aren’t a proven commodity.” An SEC collective operator adds: “Kind of the law of unintended consequences: because of the portal, coaches now aren’t as dependent on high school recruiting.” (link)

Wichita State Softball HC Kristi Bredbenner, who is entering her 13th season and has led the Shockers to back-to-back NCAA regional appearances, joins MB Sports’ Matt Banker from the National Fastpitch Coaches Association Convention to discuss the most pressing issues in the industry, including the transfer portal, conference realignment and the preservation of Olympic sports. In discussing the value proposition of Olympic sports, Bredbenner tells Banker: “We get that we're not a gigantic revenue builder, but I will tell you what, women's softball is making some money for ESPN, and there's a lot of schools out there that are able to sustain some of their expenses with the revenue that they're bringing in from ticket sales and opportunities for sponsorships and things like that. It’s a growing sport, it's an emerging sport, but as it grows it also gets more expensive, so we all get it, and I think we're keeping a watchful eye on what this landscape looks like.” Bredbenner believes a regionalized model is viable but notes the challenge will be weather. “You’ve got a northern group that can only go down south. Who are they playing against and how is it benefiting them? … I think there's a lot of things that they can look at and if that keeps softball whole as a Division I body and avoids the tiers, great.” Full video. ESPN generated $4.07B in revenue domestically for its most recent reporting quarter, up 1% YoY. That figure increases to $4.84B with international tallies added in. The company also reported $255M in operating income. During the earnings call, Disney CEO Bob Iger addressed the announcement that ESPN will launch its DTC platform in the fall of next year: “We’re excited to offer a more unified streaming experience, which we expect will deliver strong benefits in terms of higher engagement, lower churn and greater advertising potential. When we launch our standalone ESPN service, we’ll also make it available on Disney+ for bundled subscribers, just as we’ve done for Hulu.” In an interview with CNBC before the call, Iger acknowledged he had not shared the ESPN-Fox-WBD super streamer news with any of ESPN’s traditional distribution partners. “I think in many ways they probably would understand—or should understand—that what we’re creating here is a distribution mechanism to reach consumers where they are today.” Sportico’s Anthony Crupi notes ESPN closed out 2023 with 70.2M subscribers, down 5% YoY. NFL spokesperson Alex Reithmiller, in fact, tells the Wall Street Journal: “We’re aware of yesterday’s announcement and are still gathering details to understand this proposed new streaming service.” Fubo, meanwhile, released a statement asserting that “every consumer in America should be concerned about the intent behind this joint venture and its impact on fair market competition.” Fubo added the companies “could dictate market terms in a manner that may not serve the broader interests of consumers” given their vast market share in sports programming. Cablefax’s Amy Maclean points out that “[Iger] says the sports [joint venture] is for those who want sports but don't want to sign up for a big bundle. It's also for those who have left the traditional bundle or may want to leave. Compare that to Fox CEO [Lachlan Murdoch] saying earlier today that Fox would not be launching this product if it thought it was going to significantly affect our pay TV affiliate partners.” (link)

Disney will invest $1.5B to acquire a stake in Epic Games as part of an agreement through which the two will “collaborate on an all-new games and entertainment universe that will further expand the reach of beloved Disney stories and experiences.” Per Disney’s release: “In addition to being a world-class games experience and interoperating with Fortnite, the new persistent universe will offer a multitude of opportunities for consumers to play, watch, shop and engage with content, characters and stories from Disney, Pixar, Marvel, Star Wars, Avatar and more.” Disney also notes that its mobile games have 1.5B global installs, and to date, nine Disney games franchises have each grossed at least $1B in sales. CEO Bob Iger: “Our exciting new relationship with Epic Games will bring together Disney’s beloved brands and franchises with the hugely popular Fortnite in a transformational new games and entertainment universe. This marks Disney’s biggest entry ever into the world of games and offers significant opportunities for growth and expansion.” (link)

Arizona Interim AD Mike Candrea met with the media today to discuss his appointment and says: “I think I bring maybe a different approach to the group. All I know is how to build a culture, and one of the big things in athletics and on your team is just solid communication. You’ve got to know what everyone’s doing. And looking in right now, those are some things that I'm trying to enhance a little bit is how do we communicate all of this information so that the right people are on the same page and anything that goes out of this office has been thought through.” Candrea also compliments former Wildcats AD Dave Heeke and remarks: “I really felt like this challenge right now was difficult for a lot of reasons that we really didn't have control over. When I got on the job, we had just hired six new head coaches. Well, that takes money, and so we have done a lot of good things to get our football program where it belongs. I think our basketball programs are in good shape. I look around the department, and we have some very good coaches that are doing great jobs, but there’s a price to pay that’s different than it was 10 years ago, five years ago.” Asked whether he has any interest in pursuing the permanent post, Candrea said: “At this time, no. I’m a band-aid right now, and I’m doing what Bobby Robbins would like me to do. RIght now I’m taking life day-after-day. After U.S. District Court Judge Clifton Corker noted yesterday that, despite denying the TRO request from the AGs of Tennessee and Virginia, the NCAA’s rules likely violate antitrust law by reducing athletes' market power, headlining attorney Tom Mars points out that “given the length of time that’s passed since the NCAA conducted an Allegation Review Board meeting and then met with Tennessee officials, one has to wonder whether the NCAA has ‘blinked’ and decided not to issue an NOA, which is typically issued shortly after an ARB meeting.” Sportico’s Michael McCann also weighs in on Corker’s ruling: “While the NCAA averted a judicial order that would have immediately compelled profound changes to amateurism in college sports, that order seems likely to be issued later. Unless the NCAA adopts a major restructuring along the lines proposed by NCAA president Charlie Baker—and does so soon—it faces the prospect of a federal judge ordering the association to change fundamental rules.” McCann notes Corker found “sufficient evidence” the NCAA’s NIL-recruiting ban “likely harms competition” and operates as an “absolute ban on competitive bidding, which the Supreme Court [has] found to be anticompetitive on its face.” (link, link)

The NLRB’s trial involving USC, the Pac-12 and the NCAA is set to conclude on Friday, and On3’s Eric Prisbell argues it could be more consequential than this week’s Dartmouth ruling. “Because the Pac-12 and NCAA are charged with being joint employers, the outcome could potentially open the door for athletes at public universities to be deemed employees of their conference or the NCAA.” The Dartmouth case, Prisbell points out, focused largely on the amount of control the school has over the players, something which has also been a focal point in the USC trial, and Tulane Sports Law Director Gabe Feldman notes: “I think [the Dartmouth outcome] certainly strengthens the case at the higher levels, where they are exercising more control, there is more pressure, there is greater travel and there are more benefits and compensation headed their way.” College Basketball Players Association Founder Michael Hsu adds: “There is also a chance they (the NCAA) don’t keep fighting this, they see the writing on the wall, and they can figure out a way to preserve most of their interests by allowing this [employee model] to happen.” (link)

+ Wake Forest has launched the $100M In Her Wake campaign to support Demon Deacons women’s athletics. The initiative will further enhance scholarship support; create new opportunities in personal, leadership and career development; and provide strategic investments in areas that create a competitive advantage for individual sport programs. Truist and other lead investors have already committed over $21M to In Her Wake this past year, and the department aims to surpass its $100M goal by 2029. President Susan Wente: “Support for women's athletics has advanced tremendously over the past few years, and we are aiming even higher. We know that the experience of being a student-athlete can have a transformational impact on the leadership trajectories of young women. 'In Her Wake' will enable Wake Forest to further harness and accelerate leadership development by enhancing Wake Forest's investment in women's athletics." (link)

Saturday Down South’s Matt Hayes contends the SEC-Big Ten joint advisory group signals the end of a “cold war’ between the two conferences, with one source saying: “This partnership, or whatever this becomes, doesn’t happen if Kevin Warren is the Big Ten commissioner.” One SEC AD adds: “There was significant damage there, that’s probably the best way to say it. When you have no idea what’s coming next, there’s no level of trust.” Hayes notes the crack became a canyon between the two leagues in 2020 when the Power 5 commissioners were attempting to figure out how to move forward with a non-conference football schedule during the pandemic. “During a conference call of the commissioners, and after the group was making progress, Warren interrupted the call and abruptly pulled out, declaring, ‘the Big Ten has to lead, and we’re leading right now.’” Conversely, Hayes points out SEC Commissioner Greg Sankey and Big Ten Commissioner Tony Petitti have successfully earned one another’s trust since the latter’s arrival, and “by moving forward as two conferences — not 10 conferences — the process of change in all areas is streamlined and avoids constant bureaucratic red tape (the NCAA, and the remaining conferences).” More from Hayes. The NCAA Committee on Women's Athletics today voted to recommend DI, DII and DIII sponsor legislation to add a national collegiate women's wrestling championship. If approved by the membership, women's wrestling will become the sixth sport to earn NCAA championship status through the Emerging Sports for Women program, joining rowing (1996), ice hockey (2000), water polo (2000), bowling (2003) and beach volleyball (2015). The recommendation also includes establishing a Women's Wrestling Committee, which would begin its work in January 2025 to allow time to prepare for a championship in winter 2026. NCAA President Charlie Baker: "The rise in sponsorship and participation numbers for women's wrestling is yet another proof point of the rapid growth of women's sports. The sport is also a growing Olympic pipeline, helping produce multiple medalists at the 2020 Games. The NCAA is excited to continue investing in the sport to help it grow and provide more opportunities for student-athletes." (link)

Fox CEO Lachlan Murdoch during today’s earnings call said of the new sports super streamer with ESPN and Warner Bros. Discovery that the “key market, the market that we will be driving toward, is currently outside the traditional pay-TV bundle today. … There’s tens of millions of [cord-nevers, a term used to describe those who have never had a pay-TV subscription]. This is a very large market and a large opportunity that we can address without undermining the traditional bundle.” Murdoch went on to say Fox has done “lots of sensitivity analysis and we would not be launching this product if we thought it was going to significantly affect our pay-TV affiliate partners. That’s really important to us. For the consumer who wants to get it all at an affordable price, the big bundle is still the best way to get that programming. … We are confident that this product will be additive.” (link); SportsPro CEO Nick Meacham contends that deals like this are “good for sports fans, but aren't as good for sports properties looking to build competitor tension on sports rights,” to which Crakes Media Principal Patrick Crakes responds: “While doubtful we'll see joint sports bidding in short/medium run, offering more scaled streaming options while keeping connected to still very large economics & reach of established PayTV bundle in theory expands attractiveness of established media for T1 live sports rights by reducing uniqueness of alternative lower viewed non-traditional digital platforms that are experimenting & building media businesses.” Crakes also points out that staying committed to networks’ distribution partners “requires their cooperation...In short run, product may be priced much higher (unbundled) than speculation suggests. Good news is the Charter-Disney deal offers cooperation in streaming...Otherwise, current PayTV economics are threatened.” When The Athletic’s Richard Deitsch submits he still sees a 44% increase for the NBA’s media rights, Crakes notes: “Possible. Pay attention to the CFP Playoff...Will be interesting on the number of partners and deal term front.” When Deitsch submits it would be “smarter for the property longterm to have multiple partners even through a sub license,” Crakes responds: “Suggest that's not always true. Resist idea of applying a one size fits all model to a diverse universe of platforms and properties during an era of exponentially accelerating evolution in media distribution. Every deal is unique and all the pieces matter.” (link, link)

ESPN will launch its DTC service in the fall of 2025, per CNBC’s Alex Sherman, who reports: “ESPN didn’t announce a price for the flagship direct-to-consumer service. Disney already has a sports streaming service in ESPN+, which ended the quarter with 25.2M subscribers, down from 26M a quarter ago. ESPN+ only has some of ESPN’s content and doesn’t include the network’s most popular live sports, including the full suite of Monday Night Football. … The [new] service will include all of ESPN’s programming and feature new personalization and integration with ESPN’s fantasy platforms and ESPN Bet.” (link)
