The Dartmouth men’s basketball team voted in favor of unionization by a vote of 13-2, and Sportico’s Michael McCann and Daniel Libit report that “immediately following the vote, Dartmouth filed a 51-page appeal of the NLRB regional director’s Feb. 5 decision and director of the election. In the filing, the university argued that regional director Laura Sacks, by determining the school’s basketball players were employees, made an ‘unprecedented, unwarranted, and unsupported departure’ from legal and board precedent. The basketball players will now have an opportunity to file a response to the appeal, and both parties also have until March 12 to file objections to the election. Barring those, it would then be up to Sacks whether to certify the election or to hold an additional hearing. … The appeal will be heard by the agency’s five-member board, which currently has one vacancy. There is no timetable on how long the board will take to decide, but no decision is expected for months.” Big Green student-athletes Cade Haskins and Romeo Myrthil: “Today is a big day for our team. We stuck together all season and won this election. It is self-evident that we, as students, can also be both campus workers and union members. … It’s time for the age of amateurism to end." A statement from Dartmouth reads, in part: “For Ivy League students who are varsity athletes, academics are of primary importance, and athletic pursuit is part of the educational experience. Classifying these students as employees simply because they play basketball is as unprecedented as it is inaccurate. We, therefore, do not believe unionization is appropriate.” Business of College Sports’ Kristi Dosh subsequently notes: “The big question: is Dartmouth prepared to vastly change their control over these athletes to avoid having athlete employees? From the amount of time spent in practices and meetings, to dictating their schedules both on campus and on the road, to rules governing how they conduct themselves, all that would have to drastically change.” (link)

More analysis from McCann: “This is the start of a wave. And I think this is something that is going to be really interesting to see play out in terms of employment rights and also how schools respond, how the NCAA responds. Do they declare Dartmouth is ineligible for sports? We'll see. Will schools convert teams to club teams and there are all sorts of possibilities ahead. This is about fundamentally changing the relationship between the athletes and their school.” (link)

The NCAA in a statement indicates that “NCAA and student-athlete leadership from all three divisions agree college athletes should not be forced into an employment model. The Association believes change in college sports is long overdue and is pursuing significant reforms. However, there are some issues the NCAA cannot address alone, and the Association looks forward to working with Congress to make needed changes in the best interests of all student-athletes. (link)

Arizona State President Michael Crow sent an “unsolicited” email to The Mercury News’ Jon Wilner about how the Sun Devils are going about their AD search and explained: “We are making some design changes and updating our models for operations and systems before we make a decision on a new AD, so it is for us a careful and deliberate process. ASU is in a great community, a great institution, it is a complex and exciting job, and we will find a great AD.” Crow also offered several bullet points to further highlight the overall strategy: “Can you build and maintain college sports as college sports? Not professional sports at colleges. Can student athletes be treated better, and like other students (NIL for instance) and still be student athletes? Can student athletes have better life outcomes, regardless of their incoming family circumstance?” Crow also addressed the issue of university support: “We are operating ASU athletics in a way where it is an integral part of the university, not an add on, or an addendum. Meaning, what you call university subsidy is something that to us is no different than how we operate the rest of the university financially. Some units cover the costs, some don’t. All are just a part of the university and help it to be successful overall.” More. (link)

Oregon, in its response to a Title IX lawsuit filed late last year by a group of 32 current and former women’s beach volleyball players and rowers, argues it has no control of collectives, specifically the Ducks-focused Division Street. The plaintiffs contend UO has systematically deprived them of equal athletic financial aid and other resources, including those that empower their ability to earn NIL money, and Sportico’s Daniel Libit observes their lawsuit is the “first ever to invoke alleged discrepancies in NIL opportunities as the basis of a Title IX noncompliance.” Libit adds: “By insisting on its separation from Division Street, the university is setting up a fight—including a battle over discovery—to determine the nature of the relationship between Oregon and Division Street.” UO also took exception with the complaint’s “specious comparison” between the resources provided to women’s volleyball and football, noting: “[G]iven the unique nature of football, as a full contact sport and given the size of the team, it has a larger coaching staff, takes chartered flights to away games because the team and staff fill a full flight, is required to stay at a hotel the night before home games, and has a large team meeting room for studying game footage and other team preparation.” More from Oregon’s response. Sunday’s Iowa-Ohio State women’s hoops matchup averaged 3.39M viewers on Fox, marking the largest audience for a regular season women’s game on any network since Connecticut-Tennessee in January 1999 (3.88M). The broadcast peaked at 4.42M viewers. Overall, Sports Media Watch’s Jon Lewis notes that “regardless of gender, the game ranks second among all college basketball games this season behind only a Michigan State-Arizona game on Thanksgiving that had a direct lead-in from the NFL (5.18M) — topping even the first Duke-North Carolina game this season (3.20M). Including the NBA, it ranks sixth for the season.” For the weekend, the game finished behind only the NASCAR Cup Series at Las Vegas (4.36M) — as the most-watched sporting event on any network. The previous high for this women’s hoops season was the first matchup between the Buckeyes and Hawkeyes. (link); Fox Sports President of Insights and Analytics Michael Mulvihill notes women’s college basketball is now averaging a “little bit bigger” audience than Men’s CBB on FOX (981k vs 946K). Women’s CBB is up +48% on FOX this season and up +60% across all national networks. Meanwhile, USA Today’s Dan Wolken asserts that “men’s college basketball is a very flat, relatively unappealing product right now. Coaching legends are gone or diminished. Temple has received the largest gift in athletic department history from alumnus Stanley Lefkowitz and his wife, Debbie, to endow and create the Debbie and Stanley Lefkowitz ’65 Director of Athletics position. While the amount has yet to be specified, Owls AD Arthur Johnson says: “There is no overstating the significance of this gift, and we are incredibly thankful to the Lefkowitz' for their continued faith in both Temple and our athletics program. An endowed athletic director position is very rare within the NCAA, and Temple can now count itself among the schools that carry that unique distinction. This speaks volumes with regard to the transformative nature of this gift.” (link)

Mercedes-Benz Stadium is unveiling its newest premium spaces today, the Chairman’s Lounge and Stadium Club, both of which will be ready in time for the start of the 2024 season. According to SBJ’s Bret McCormick, what was “one large open space has been divided into two floors; the Stadium Club sits in the bottom half and the Chairman’s Lounge above. … The Stadium Club will have room for up to 200 guests with an elevated, all-inclusive F&B menu and limited reserved seating and tables. The membership-only Chairman’s Lounge above will become a physical extension of the stadium’s most premium 100 level and have seats for 154 guests, including in-seat, personalized service.” Pricing has yet to be finalized, and naming rights and sponsorship opportunities will be available for both. + South Dakota has promoted Assoc. AD for Business and Finance Gina Mockler to Senior Assoc. AD for Internal Operations/SWA. Mockler already oversaw budget and finance for USD athletics and added oversight of the equipment room last year. In her new role, she will add oversight of compliance, strength and conditioning, athletic training, and the USD mental health program. The former USD volleyball player will also serve as the sport administrator for her former team as well as women's basketball. (link)
+ West Virginia and Football HC Neal Brown have agreed to a one-year extension that keeps Brown under contract through the 2027 season. Mountaineers AD Wren Baker: "I am pleased with the progress I've seen in our football program since arriving last year. Northwestern is reportedly drawing inspiration from the 16th hole at the Waste Management Open as it considers temporary options during the Ryan Field rebuild. According to Darren Rovell, the Wildcats have a 15-20K capacity in mind for the interim setup on Lake Michigan. Doing so, Rovell adds, could allow the football team to continue playing at home rather than at neutral fields while construction is underway. (link, link)

Fairleigh Dickinson has opened the Panos Fueling Station, named in honor of former women's basketball student-athlete Catherine L. Panos, who, upon her passing following a courageous battle against cancer in 2022, left a gift to FDU to help current and future student-athletes. Situated within the Rothman Lobby of the Bogota Savings Bank Center, the fueling station will be accessible to student-athletes daily. Knights AD Bradford Hurlbut: "We are so grateful that Cathy Panos has left her mark on FDU with this generous gift. Cathy's story will be shared with future generations of Knights. Her legacy will forever be preserved, while simultaneously enhancing the experiences of our current student-athletes.” (link)

Liberty has been fined $14M by the U.S. Department of Education after an investigation found the university failed to comply with federal Clery Act requirements and administrators had discouraged victims from reporting crimes. As part of a settlement agreement with the department, Liberty will also spend $2M on campus safety improvements and compliance enhancements and remain on postreview monitoring through April 2026 “to ensure that the school executes on promised improvements. Despite agreeing to the settlement, Liberty in a statement asserts that “many of the Department’s methodologies, findings, and calculations were drastically different from their historic treatment of other universities. Liberty disagrees with this approach and maintains that we have repeatedly endured selective and unfair treatment by the Department. The University concurs there were numerous deficiencies that existed in the past. Examples include incorrect statistical reports as well as necessary timely warnings and emergency notifications that were not sent. We acknowledge and sincerely regret past program deficiencies and have since corrected these errors with great care and concern.” The fine is the largest on record for Clery Act violations. (link)

Expansion of the NCAA Men’s Basketball Tournament is unlikely to go beyond 76 teams, according to The Athletic’s Dana O’Neil, who is told by one administrator briefed on the conversations: “We’re not talking about 96. There is little to no appetite for 96 teams, or really even 80.’’ O’Neil points out that expansion is on the table at all because “college basketball administrators fear that, if the tourney is left untouched, it will inspire power conference schools to at least consider their own postseason. Fox already is creating a counter to the NIT.” The administrator adds: “The NCAA has to be proactive. Expansion — modest expansion — may be the only way to keep the tournament we all know and love alive.” Meanwhile, the question of money remains, and O’Neil notes: “Some, fearing an Armageddon scenario, worry [adding more schools without CBS/Turner adding more to the pot] will lead power-conference commissioners to push for a restructuring of the automatic bid process, which is, of course, the very lifeblood of the everyman tournament.” (link)

Asked what the Atlantic 10’s next move is after losing Massachusetts to the MAC, Extra Points publisher Matt Brown says the “only A10 expansion candidate school that I'm aware of right now is the College of Charleston. The UMass departure didn't catch anybody by surprise in A10 land and I haven't heard anything to suggest their expansion plans have dramatically changed post-UMass.” (link)

The formation of a college football super league could happen “in the next few years,” according to On3’s Andy Staples, who observes the following as it relates to the Big Ten and SEC’s attempts to secure first-round College Football Playoff byes: “This would be a ploy to protect the commercial viability of the Big Ten and SEC championship games, which are cash cows but essentially become anachronisms once the 12-team CFP begins this season. By guaranteeing those games have stakes none of the other conference title games can have, the Big Ten and SEC guarantee those games remain valuable to network partners. They also cement the stacking of the deck against the other leagues, which probably is bad for business if you’re trying to pretend everyone has the same chance. If you’re going to go that far, I said [on Friday], just go ahead and get to whatever super league alignment you’re headed for and cut out the middleman. The further this goes, the more it feels that’s what might actually happen.” In fact, UAB Football HC Trent Dilfer believes the super league will happen in less than two years, and Staples notes: “It was interesting in part because Dilfer is a sitting FBS head coach and in part because he came to college football after a long stint as an ESPN NFL commentator. He knows quite well some of the people who pull these levers.” While there are still several questions to be answered – student-athlete employment chief among them – Staples adds: “Most of us have assumed these things would happen more slowly and have been proven incorrect multiple times. Perhaps we should prepare for them to happen quickly.” (link)

The Mercury News’ Jon Wilner posits that “on the surface, the [3-3-2-2-1] College Football Proposal proposal sounds bad and looks worse for the Big 12 and ACC, codifying them as lesser than their peers in the most public of fashions. But they should take the deal in a heartbeat, then go celebrate together.” Wilner points out the format “assigns the ACC and Big 12 two-thirds the value of the Big Ten and SEC. That’s a greater valuation than they would receive in any other metric central to the sport. Once all the schools switch conferences this summer, the Big 12 and ACC won’t have two-thirds as many major college football brands as the Big Ten and SEC. They won’t have two-thirds the TV ratings or two-thirds the media rights revenue. (The total will be closer to half once all the new TV deals kick in.) And they certainly won’t claim two-thirds of the CFP berths previously earned.” Meanwhile, alternative scenarios threaten to further marginalize the leagues because, according to Wilner, “in a format with no guaranteed bids, the Big Ten or SEC would gobble up at least four and possibly five spots. Both scenarios are worse for the ACC and Big 12 because of the likelihood that, in an average year, they would not generate two playoff-worthy teams.” That said, Wilner believes the ACC and Big 12 should tell the SEC and Big Ten to “pack sand” if this model comes with guaranteed top seeds for the latter two conferences. “Give on revenue. Give on governance. Give on some other aspect of the format. But take the 3-3-2-2 format, then pop the champagne.” (link)

Kennyhertz Perry attorney Mit Winter tells SBJ’s Ben Portnoy that “based on the NLRB decision in the Dartmouth [case], I don’t see how the L.A. regional office is going to reach a different decision at least with [athletes] being employed by the school [in the USC case]. In my view, the factors that led the NLRB to say Dartmouth men’s basketball players are employees are much stronger in the USC case.” Illinois law professor Michael LeRoy agrees, adding: “Conceptually what that does is it takes all of the major programs — the Alabamas, the Georgias, specifically Southern states where there is no collective bargaining for the public sector — and taps on a magic wand and says, ‘You are private for the purposes of collective bargaining, because the work is being controlled ultimately by these private organizations called the NCAA, Big Ten, SEC, whatever. That’s why this has a more seismic impact, whereas the Dartmouth case is a little more narrow and would apply probably more likely to small private schools, the Ivy League, etc.” (link)

Missouri State President-Elect Richard Williams was asked whether he will have any involvement in personnel decisions among campus and athletic department leadership before he officially takes over and says: "That will probably depend on where the board is at and with [President Clif Smart]. I imagine that if it's going to affect the future, that they might consult me a little bit but I definitely realize that President Smart is the president to the end. … I don't want to step on any toes. But I believe from that interview when I spoke with [Smart] that he will want to include me in things that might affect the presidency. I'm really going to allow the board and President Smart to include me as they see fit." Williams also says his role as president will be "to support Kyle Moats and what he's doing with intercollegiate athletics” and that he'll use his role to determine the resources that are needed to do that and figure out "where does intercollegiate athletics want to go?" Commissioner Matt Burgemeister and MAAC Deputy Commissioner Jessica Grasso at the 2024 NCAA Convention for a conversation about creating conference-wide consensus among various stakeholder groups, engaging SAAC and including student-athletes in the governance process, and building a robust pipeline of the next generation of conference leaders. On the topic of building consensus, Grasso explains: “I think you touched on it, the meeting before the meeting, the conversations ahead of time. You have to identify the personalities of the individuals you're speaking with – your ADs, SWAs or coaches. How do they work? How do they tick? Because ultimately when you get the decision…by the time it gets to the final stamp of approval or or non-approval you’ve vetted all the questions, the inquiries. The Ole Miss-focused Grove Collective has launched the March To Victory Bracket Challenge through which it seeks to raise $10M and surpass 10K members by the end of March. The challenge involves a 16-region, bracket-style tournament that pits different areas of the country against one another to see who can raise the most money in support of Ole Miss athletics. Rebels AD Keith Carter: "We can't wait to get this new campaign underway and celebrate the spirit of March Madness in a fun and innovative way. Army West Point announces several senior leadership changes, including the promotion of Executive Assoc. AD/SWA Tricia Brandenburg to Deputy AD/Chief Leadership Officer/SWA with sport oversight responsibilities including men’s soccer, women’s basketball, wrestling, softball and football (secondary). Additionally, Senior Assoc. The survey, conducted in partnership with Quantum Workplace, took into consideration metrics such as compensation, benefits, confidence in co-workers, and trust in senior leadership. In the category of Leagues/Teams/Governing Bodies with under 50 employees, the Northeast Conference was awarded the silver medal.
