+ Takeaways from the NCAA under the heading ‘Unresolved Issues’: “The settlement does not resolve the patchwork of state laws, many of which may conflict with the settlement. These laws will need to be preempted by federal legislation in order for the settlement to be effective. The settlement does not address ongoing efforts to designate student-athletes as employees under state and federal labor and employment laws. These efforts by the NLRB and plaintiffs' attorneys pose a direct threat to both the sustainability of sports programs (especially for non-revenue generating ones) and to the baseline of support provided to all athletes.” From A5 Commissioners & NCAA President Charlie Baker: “This settlement is an important step forward for student-athletes and college sports, but it does not address every challenge. The need for Federal legislation to provide solutions remains. If Congress does not act, the progress reached through the settlement could be significantly mitigated by state laws and continued litigation.” (link)

+ Sportico’s Michael McCann reviews the full House settlement filing, says “challenges loom.” Key notes: “Wilken will weigh the settlement against the complexity, expense and likely duration of continued litigation. This preliminary review could take several weeks or months. Wilken might urge or require the parties to modify their settlement during the preliminary approval stage. For example, if she believes the distribution of funds would overly advantage some athletes and overly disadvantage others, the parties might rework the math to comport with Wilken’s suggestions. The judge might also contest areas of the settlement that punt key specifics to future deliberations. While preliminary approval might require settlement revisions and court hearings, Wilken will likely grant it. It is rare for an antitrust settlement to be rejected at an early stage since the settlement’s claimants—college athletes—have not yet been heard in court.” McCann goes on to outline multiple examples of lawsuit settlements that have been rejected by judges for a variety of reasons: “...keep in mind, those details are very much subject to change at the judge's behest. The UFC settlement has changed a lot over the last few months. Don't rely on NCAA settlement details yet.” (link)

+ Of the nearly 600 American athletes competing at the Paris Olympics, 75% of them played in the U.S. college system. More than 800 athletes with NCAA ties will compete for other countries in Paris. In all, more than 1 in 10 of the 10,500 athletes at these Games played college sports in the U.S. The Associated Press’ Doug Feinberg and Eddie Pells: “None of this comes cheap. One estimate is that NCAA schools spend more than $5 billion a year on so-called nonrevenue, or Olympic, sports.” That level of spending, of course, could be changing with the impending House case shakeout. On that front, CEO of the USOPC Sarah Hirshland: “It is extraordinarily top of mind to us. We’re going to keep a close eye on programs being cut, or even talked about being cut. … We’re going to do everything we can to contribute to saving that system because it works beautifully for us and, frankly, it’s the envy of the world.” (link)

+ How will the House settlement impact Men’s Hockey, which will see its 18 scholarship limit shift to a roster cap of 26? College Hockey Insider’s Mike McMahon on the impact for DI and DIII schools: “I don’t think 26 players is enough. By my math, 13 teams carried 26 players or less last season. That means 51 teams carried more than 26 players. [...] Theoretically, more money will be available to the players even if the talent pool is about to get smaller. Not every school will fund 26 scholarships, but I don’t think anyone will cut from the 18 scholarships they already offer. If we assume the Power 5 schools in college hockey all start offering 26 scholarships, plus a few other non-Power 5 schools (BU? North Dakota? Denver?), there’s likely a minimum of 80-90 new scholarships available. As I wrote above, the actual number of roster spots will be reduced, but there will be more money available to those players who make the cut. […] Division III hockey will benefit, but it’s a trickledown. Those 80’ish players cut from D-I next season could end up going D-III. But there will be players at the bottom of D-III rosters who will now find themselves off a team because of it.” More. (link)

Ithaca highlights plans to add Women’s Wrestling as the department’s 28th varsity sport with competition slated to begin in the fall of 2025. AD Susan Bassett: “The addition of a sport program is an extraordinarily important decision for the athletics department as well as for Ithaca College. In consideration of IC's esteemed history and tradition of intercollegiate athletics competition, it is essential to take the long view on a decision like adding a sport. Understanding the national interest at the high school level, the opportunity for viable intercollegiate competition, facility needs, required staffing support from coaching to athletic training and athletics communication, and funding all go into the equation for our analysis. Post-pandemic we have had the chance to conduct these analyses and arrive at this monumental decision to add women's wrestling to Ithaca College's sports sponsorship.” (link)

NCAA Director of Digital Communications Chris Dion chats with Collegiate Sports Connect’s Stephanie Garcia Cichosz to discuss the association’s Made Here campaign tied to the 2024 Olympic Games, preparing and forecasting for the 2028 Olympics in Los Angeles and more. Dion on the association’s social media mindset: “It's about storytelling, about the values and benefits that the NCAA provides to student-athletes, as well as the exceptional performances and accolades that they achieve in their growth through the NCAA. We've really taken a different look this year and really narrowed it down to that. That narrow focus allows us to be very deliberate with our storytelling, be very purposeful, not chase things that don't matter, but also chase things that reinforce our values and celebrate these athletes on a different stage.” On the runway of these Olympics towards 2028: “I keep saying to our team this is our training ground. We've been in this partnership for quite some time, but we're really taking it way up a notch this year with this eye and focus on 2028. Wittenberg rolls out plans to eliminate the $17M deficit from FY23 which include $3M in staff cuts in FY25 and beyond and $4M in faculty cuts in FY26 and beyond, with consideration for changing its academic offerings.
