ACC Advancements…
+ The league appears to be nearing a new revenue distribution model, according to ESPN’s Hale and others. Hale: “The league's athletic directors left a second day of occasionally contentious meetings feeling optimistic that schools would coalesce around a plan that would afford a larger share of postseason revenue -- including from a soon-to-expand College Football Playoff -- to the teams participating in those postseason games rather than dividing it equally among all members.
+ While there are a number of models still on the table for what league officials are calling ‘success initiatives,’ Florida State [AD] Alford said there are scenarios in which a team making the College Football Playoff could add more than $10M in revenue annually.” Alford: "The ADs and the universities are very unified. So we're thrilled about being in this league, and we want to stay in it."
+ Miami (FL) AD Radakovich acknowledges there were some raised voices and a few profanities exchanged during an “airing of grievances” concerning recent reports of the “Magnificent Seven” exploring the fallibility of the ACC grant-of-rights. “People had to say where they were and why do you feel that way.”
+ Alford, meanwhile, says the discussion about potential departures was “probably overblown” and another AD says everyone has examined the GOR. “You'd be crazy not to. But no one is going anywhere.” More from Hale. (link)
+ Also from Alford, per Sports Illustrated’s Dellenger and Johnson: “There’s not a magic number. Really, we’re looking to make sure we’re competitive. … We’re the third-best media agreement right now, we want to stay the third-best. We've been able to compete with them being the third-best.” (link)
+ Virginia Tech AD Babcock confirms the Hokies and the other six members of the “Magnificent Seven'' discussed possible options for leaving the ACC. “I would classify it as a number of conversations, usually in small groups, on interpretations of grant of rights, of bylaws of the league, of options that may be out there. But as you know, the grant of rights has been looked at a lot of times by a lot of people.”
+ Babcock goes on to tell the Richmond Times-Dispatch’s Teel: “I absolutely feel for my colleagues (Monday) that were blindsided, and if the commissioner (Jim Phillips) was, him as well. These jobs are hard enough without something knocking you upside the head. There was probably a number of things said yesterday that needed to be said. I think the commissioner did a great job with it. You’ve got 15 schools and 15 different approaches. After the initial shock of some of the news reported, I think it was productive after that. … The tough thing about being an AD in times of conference realignment, real or perceived, is there’s nothing you can really say that’s the perfect answer. If you are undyingly loyal to your conference, which the ACC’s been great to us, then your fan base thinks (you’re ignoring reality). If you come out and say you want to keep your options open, you’re not exactly making friends in the room and with the commissioner.” (link)

Summit League Commissioner Fenton is optimistic about the league’s future despite the departure of Western Illinois but acknowledges that “there’s no doubt there are a lot of changes across the greater landscape of college athletics. The economics have changed drastically, especially at the highest levels, maybe not so much in the mid-major world that we live in. We’ve got to find a way together, as an industry, to continue to remain in a place where we can continue to operate together.” Fenton goes on to note that affiliate members not only help the league meet some minimum requirements for automatic qualification for NCAA postseason competition, but they also show the Summit League is a good option. “I think the nine members that are still members of the league would indicate that. The future is very bright and we look forward to stronger days ahead.” (link)

Cincinnati has inked an apparel deal with Jordan Brand for its men’s and women’s basketball teams, according to The Athletic’s Williams, who notes football and the school’s other sports will be outfitted in Nike gear, effective July 1. The two-year contract is with BSN Sports and expires on June 30, 2025. Financial details have yet to be reported. (link)

Former FBI agents Priestap and Triplett are expanding their risk advisory firm, Trenchcoat Advisors, into college athletics, according to SBJ’s Smith, who notes this “era of growing concern over sports betting, weapons on campus, facility protection, fraud and any number of other threats [are potentially] frightening for athletic administrators.” Priestap, who was a DFO at Michigan before joining the FBI, tells Smith he reached out to former Pittsburgh/Arkansas/Kansas AD Long before making the foray. Long has also joined the company as a senior advisor and is using his contacts in and knowledge of the industry to help generate business. (link)

As of May 16, the average college baseball game time is 2 hours, 50 minutes, down from 3 hours, two minutes last season. Vanderbilt HC Corbin voices his approval of the new action rules: “At first it feels different, but teams and individuals have a chance to calibrate themselves, I think you are going to see a more efficient brand of baseball.” Tennessee HC Vitello agrees. “The cat and mouse doesn’t interest me. So, I like when a batter stands in the box, he’s got his hands on the bat, the pitcher gets his sign, and let’s find out who’s better.” There are some detractors, though. Texas A&M HC Schlossnagle believes the action rules were implemented too soon. “First, we don’t even have pitch clocks in all the stadiums. We are supposed to have all the money in the world at Texas A&M and we don’t have a clock behind home plate. You can’t get the stinking things. D1Baseball’s Rogers updates the 2023 Dingermeter, and as he conveys via emojis, the numbers are eye-popping. As the season winds down, there have been 16,649 home runs hit so far, good for a clip of 2.25 per game. Through the same number of weeks last season, the Dingermeter registered 14,452 HRs for an average of 1.99 per game. Go back to 2019, and the Dingermeter, fresh out of the box, barely greased its gears, as a paltry 10,630 souvenirs left the yard for an average of 1.46 per game. (link)

The Ivy League has denied violating antitrust law as it relates to the league’s ban on athletic scholarships and has requested a dismissal of a prospective class action filed by current and former student-athletes. Lawyers representing the eight universities argued in a joint court filing that college athletic leagues hold the power in establishing regulations for financial aid and compensation of student-athletes. In this case, the Ivy League’s institutions argued they promote campus environments that do not emphasize athletics. Defense lawyers, meanwhile, argue the Ivy League schools cannot be considered a “market” for antitrust purposes, as they individually comprise just one of over 350 schools competing in DI. (link)

The Texas Tech-focused Matador Club will sign the entire Red Raider baseball team to “five-figure NIL deals.” The Matador Club has reached similar team-wide deals with the football and softball programs. A Matador Club board member says in a press release: “Our student-athletes represent Texas Tech with pride, and by signing each player to The Matador Club, we are not only investing in their future but also in the future of our community through service.” (link)

The Iowa-focused Swarm Collective has partnered with Exile Brewing Company on a custom-brewed beer called SWARM Golden Ale. According to On3’s Wittry, Exile Brewing Company will contribute 20% of the beer’s revenue to the collective. Exile Brewing Co-founder Tursi: “If this beer gets on the level of popularity as like our most popular beer Ruthie, you’d be looking at a donation for The Swarm of hundreds of thousands of dollars annually from Exile.” Also from Tursi: “We’re really viewing that 20% revenue share as almost like a marketing expense because you know, we know that there are so many Hawkeye fans in the state of Iowa. We feel like if they know that the beer they are drinking is going to benefit the student-athletes at the University of Iowa that they’ll be loyal to it.” (link)

Bearcats AD Cunningham: “Cincy Reigns has this incredible relationship that's been formed over the last couple of months. This all just came together. It makes so much sense to me. Arizona State AD Anderson says of the Pac-12 he is “very confident in the long-term viability. The 10 schools are solid.” Anderson also, per Speak of the Devils podcast host Denny, believes it will be the “summertime,” perhaps July or August, when a media deal is announced. After a grant-of-rights is signed, Anderson says the “notion of potentially looking at expansion makes sense” and mentions San Diego State and SMU. ASU has held no internal talks about other conference homes "because we are a solid important member of the Pac-12. No discussion about other conferences.” (link)

Meanwhile, Oregon AD Mullens sounds off on the future of UO and the Pac-12: “The Pac-12 has 10 outstanding members remaining and we’re one of them. I think the Pac-12 has served the University of Oregon well. I think everybody is aligned. I think there’s great confidence we’re going to end in the right place, is what I think. We’re in a new world of athletics and that resource base does matter, and we’re fortunate in the incredible support that we get. … We’re a good partner. We’ve always wanted what’s best for the whole and will continue to make sure that we’re representing the University of Oregon’s interests, but understanding that you are part of a conference. Clemson AD Neff with comments before the current ACC league meetings on the conference’s revenue distribution and the growing chasm with SEC and Big Ten, saying the Tigers have been able to remain competitive because of IPTAY support and a “pretty good return on investment” from Football HC Swinney. “There's a lot of decision-making of why we've been able to compete, it's just that the issue is in the not-too-distant future that order of magnitude of the gap or the distribution shortcoming – it takes on a different order of magnitude. So it's going to be really difficult as we look at the economics to invest comparatively how we've wanted to invest. I guess that's the way I'll phrase it. So that's what we talk about a lot, look at, and are being very strategic and thoughtful about how we approach the business and approach our investment towards expectations." (link)

The NCAA details its current efforts related to the growth of sports gambling, noting that President Baker instituted a national survey concerning sports betting among young adults between the ages of 18 and 22. “Those results are under review now and will be released in the coming weeks. The NCAA will conduct a more comprehensive national survey of student-athletes on sports wagering in the 2023-24 academic year.” Baker: “Advertisers may see this as an emerging market, but this could be an emerging threat to young people everywhere if we all don't work together." Meanwhile, NCAA CMO Hainline explains the NCAA Mental Health Advisory Group is modernizing the current Best Practices document. “Part of their updated focus is to address the potentially negative impact of social media harassment and abuse, which often springs from individuals who are involved with sport corruption or wagering. In addition, there will be updated guidance on management of gambling disorders." The NCAA also continues to leverage its resources in education and integrity services to protect student-athletes and the fairness of competition. To that end, NCAA Managing Director of Enforcement Hicks remarks: “Integrity efforts work best when the ecosystem is communicating and in sync. We'll continue to work with regulators and partners to act aggressively at ensuring the integrity of NCAA competition." Lots more. (link)

On3’s Maisel likens the NCAA’s current plan to lobby Congress for a federal NIL standard to pulling the goalie, writing: “In the last several days I spoke to officials at the NCAA and in four Division I conferences, looking for any planning for the possibility that Congress will continue to ignore the lobbying efforts of NCAA members across the country. No one knows of any such planning.” With no viable Plan B, Maisel submits this is the “same sort of non-planning that got college sports where it is today. … That makes it seem even more obvious that the NCAA should have some sort of strategy for moving forward without Congressional help on NIL.” Central Michigan AD Folan is confident in NCAA President Baker, saying: “We’re just getting started. Everybody is hopeful and realistic that there’s a lot of work to be done. We always find a way to figure it out. Evolve and adapt.” Maisel is less convinced. “We all know that society needs it. That doesn’t make it any more likable. Intercollegiate athletics need boundaries. If you want everyone in the choir to sound harmonious, give them the same hymnal.” (link)

James Madison sold a record 8,125 football season tickets by its May 15 priority deadline. As a result, JMU has put new season ticket sales on hold at least until the seat selection process is completed, at which point any remaining season tickets will go on sale. The previous record of 7,708 was set last year when 6,241 claimed season tickets ahead of the priority deadline. (link)

Billionaire St. John’s supporter Repole - notable for founding & building Vitaminwater & BodyArmor before selling both to Coca Cola - is re-engaging with the Red Storm after the hire of Men’s Basketball HC Pitino and says he is on board with providing NIL funding for the program. Repole had a previous public falling out with his alma mater after calling the environment around St. John’s under former President Gempesaw “toxic.” Now, he says Red Storm AD Cragg “is going to come down to Florida shortly and I’ve already made a commitment for basketball through the school and Rick is well aware of that. So that’s just through the athletic department and the school and helping with the needs that both basketball will continue to need as we continue to grow the program. … To me, St. John’s was getting incredibly close to being irrelevant and I think if they would’ve stayed with the current coach, it was just basically a matter of time, especially with Georgetown and other schools making such big moves. And the Rick Pitino move was like a Hail Mary that basically went from game over, irrelevant to NCAA Tournament, maybe Final Four.” (link)

Governors Highway Safety Association CEO/longtime West Virginia donor Adkins plans on pausing his contributions to athletics due to the university’s handling of Men’s Basketball HC Huggins, telling West Virginia Sports Now: “It’s painful as a longtime supporter of WVU to see this situation. I’m directing my donations away from the Athletic Department toward other parts of the University. … I’ve been in touch with WVU as a donor and a gay man. I’m disappointed in how they have handled this, but hope for the best.” Adkins goes on to say of Huggins: “Yes, people can change and grow. I hope he speaks out about what happened, shows true remorse and this serves as an opportunity to educate others.” (link)

+ Lawmakers in New York have introduced a bill amending the state’s NIL law, and Syracuse sports law professor Greene notes the “proposal is almost identical to the language in the recently vetoed Oklahoma bill.” Like the bill in the Sooner State, the New York bill expressly prohibits a conference or athletic association – and specifically names the NCAA – from opening an investigation or taking “any other adverse action” against a college for engaging in any NIL activity.
