The NFLPA and Rev. Al Sharpton release a statement denouncing the NCAA’s refusal to pay student-athletes, noting the “13th Amendment abolished slavery and involuntary servitude ‘except as a punishment for crime whereof the party shall have been duly convicted.’ … The NCAA argues that ‘amateurism’ should be given the same deference and legal effect as the 13th Amendment ‘slavery exception.’” The statement continues to assert that the “NCAA’s comparison trivializes the historical significance of the 13th Amendment. It implies that college athlete labor belongs to the NCAA and its member schools in a manner repugnant to all college athletes, particularly to African-American descendants of slaves. … The NCAA and its member schools should do the right thing and pay college athletes on an hourly basis, just as is the case for fellow students who work in campus offices, dining halls, libraries and as support staff at NCAA games.” Full statement. The Mercury News’ Wilner asserts the Pac-12 athletic departments “should not, under any circumstances,” be on the hook for the $50M in overpayments from Comcast. Instead, Wilner argues the distributions from Comcast, which are expected to be withheld to make up for the overpayment, “should be covered by the university presidents using campus reserves. After all, the presidents are responsible for this mess, not the athletic directors. The presidents have oversight of the Pac-12 Networks. The presidents control the auditing process. The presidents hired former commissioner Larry Scott, approved his organizational structure and allowed him to establish a media company with an inadequate system of checks and balances.” Per that organizational structure, Wilner points out the ADs were not in the chain of command. Georgia has declined its invitation to the White House to celebrate the Bulldogs’ football national championship, explaining that it “first received on May 3 an invitation for the Bulldog football team to visit the White House on June 12. Unfortunately, the date suggested is not feasible given the student-athlete calendar and time of year. However, we are appreciative of the invitation and look forward to other opportunities for Georgia teams moving forward.” The Athletic’s Emerson: “The White House engaged Georgia in discussions over a date early this spring, a source briefed on the scheduling talks said, but the two sides could not agree on a date, going back and forth until the May 3 invitation.” (link)

Radford AD Lineburg has been dropped as a defendant in a lawsuit filed by a former baseball student-athlete who claims he was mentally and verbally abused by former Highlanders HC Kuhn. The suit alleges the former player was targeted by Kuhn as retaliation “for leading a group of players to complain about his season-long verbal abuse, indifference to players’ mental and physical health, and racial animus.” (link)

Alabama A&M has formed a task force to oversee game day operations for its most prominent football matchups, including the Magic City Classic against Alabama State, which takes place annually at Legion Field in Birmingham. Specifically, the task force, chaired by Bulldogs AD Bryant, is charged with “reimagining how game-day operations can be more impactful and advantageous” forming a “plan to secure regional and national sponsors and other promotional activities.” The announcement comes after AAMU signed a four-year agreement with the City of Birmingham to participate in the Classic through 2026, for which each school will receive $500K; however, as reported previously, the Bulldogs opted not to enter into an agreement with the Alabama Sports Council (ASC), the nonprofit entity that oversees production of the Classic, through which A&M and Alabama State would have each received an additional $700K annually for the four years. + Altius Sports Partners is partnering with Coaches+ Media to create and develop content, per SBJ’s Smith, who reports the “property is designed to amplify coaches’ unique stories and values of leadership, education, inclusion, service and advocacy.” The partnership will include the development of philanthropic projects, instructional videos, and media collectibles, and will also offer coaches opportunities to create their own content through the Coaches Creator platform. Noting that nothing has been finalized, Marchand adds additional context: “Besides sources with knowledge of the situation saying ESPN is in the pole position, McAfee recently tweeted out a picture of a meeting he had with Disney CEO Bob Iger. On Monday’s show, McAfee said he was up to something, which he said would be announced in the next 10 days. That timeline just happens to perfectly correspond with Disney Upfronts, which are scheduled for May 16.” (link)

The Field of 68 announces the Field of 68 Tip-Off, a three-year men’s hoops series featuring Charleston, Liberty and FAU. The round-robin event will officially launch next season in Boca Raton before moving to Charleston in 2024 and Lynchburg in 2025. Cougars AD Roberts, who spearheaded the event, says this will “give us a unique opportunity where we can have a scheduling strategy where we can come together, give two of us a neutral site and road opportunity against a high-quality Quad 1, Quad 2-type opponent. And then hopefully this spurs some other folks to join us around the country. … I think it’s a way for us in the mid-major space to really use each other, use our talents, use our investments and give us a platform with an entity like Phillips 68 that maybe when it comes to March and that committee’s sitting around the room and they’re looking at some of us mid-majors compared to maybe a team that’s sub-500 in a Power 6 league that maybe we get the nods for the effort we’re making in the non-conference.” (link)

Vivid Seats’ Q1 net income was up more than 800% YoY to $30.3M with Q1 revenues increasing from $130.77M to $161.06M YoY. Vivid’s earnings per share of $0.15 topped analysts’ estimates of $0.06. (link, link)

Genius Sports’ Q1 revenue rose 13% to $97.2M, beating Wall Street analysts’ expectations, per Sportico’s Coffey, who also notes the betting division’s sales grew 30% to $64.7M. Overall, Genius finished Q1 with a loss of $25.2M, an improvement from last year’s $40.2M and says it expects revenue to come in at $400M for all of 2023, about $8M higher than had been expected. NCAA President Baker pens an op-ed in The Hill touting the recent passage of the Holistic Student-Athlete Benefits Model and noting the NCAA “lacks the legal clarity” to address issues that remain, such as NIL laws that vary by state and continue to change. Therefore, Baker contends a national NIL standard is needed. “As President of the NCAA, I am ready to make needed change but, in this instance, Congress is the only entity that possesses that ability. We need Congress to act. Should Congress step in to address a small but critically important set of threshold issues such as establishing national NIL guidelines and affirming student-athletes’ unique, non-employment-based relationship with their universities, I am confident in our ability at the NCAA to fulfill our mission supporting 500,000-plus student-athletes each year.” (link)

Sports Illustrated’s Dellenger reports there is growing bipartisan support for an NIL bill among federal lawmakers, with whom NCAA President Baker continues to meet. Specifically, Dellenger notes the Senate Commerce Committee is working to schedule another hearing on the issue; an early draft of a bill from Senators Tommy Tuberville (R-AL) and Manchin (D-WV) is finished and has been reviewed by several college sports executives; and a narrow NIL-based bill is expected soon from Congressman Bilirakis (R-FL), the chair of a House Committee on Energy and Commerce subcommittee, which likely controls legislation around college athletics within the House. LEAD1 CEO McMillen: “I think there is a greater interest in it, and Charlie Baker has been well received, but I’m not sure it’s at the level of a must-pass bill. How do you get this in front of members? I think they’ve got to do it the old-fashioned way. The 1,200 schools have to start calling their reps and tying up the phone lines and emailing them and making a lot of noise here to get this on the docket.” McMillen also believes time is of the essence “because if you get too much into next year, it gets caught up in the [presidential] election mode.” (link)

AAC Commissioner Aresco doubles down on his stance against Power 5 branding, arguing that “is the corresponding media-driven P5 designation that has consigned over half of FBS football to a perceived second-class status. The P5 label is the culprit. This circumstance has affected the American Athletic Conference far more than the other so-called G5 conferences because, by virtually any measure-investment, enrollment, television exposure, size of markets, and especially athletic success in football - the American is most like the P5 conferences, and should not be victimized by a label. … We reject the concept of a P5-G5 divide that creates a caste system, that suggests second-class citizenship for five FBS conferences and also often excludes FCS and Division I conferences entirely from the discussion. Within the arbitrary and self-selected categorization of P5, we are and have been clearly a P6 conference, but we will transition to a more generic ‘Power’ branding that can be supported by real accomplishments or debunked by lack of them.” Full letter. Missouri State President Smart tells the Springfield News-Leader there’s “not a question in my mind that, at some point, Missouri State will be playing FBS football. But it's gotta be the right move at the right time and that's just what we're trying to figure out. … What are the financial requirements and what are the revenue changes that would offset some of that? [Bears AD Moats] is always evaluating and engaging in those conversations. It just hasn't been the right fit yet or the right time." More Smart: “If you picked any of the other five conferences, other than football where we'd have to ramp up in terms of facilities and staffing and a variety of other things, we'd be competitive in soccer, baseball, traditionally in volleyball and women's basketball, Our facilities are as good as anybody's, our coaches are as good as anybody's and we could certainly compete at that level.” (link)

South Carolina AD Tanner hopes to release plans for the development of nearly 900 acres behind the Gamecocks’ football facilities this summer. Tanner says the school received interest from over two dozen developers and informed them the land is a blank canvas. “We have a lot of land. Is it big enough for a golf course? Could be. Is that something we will do? I’m not 100% sure. The Post and Courier reported last week that the land might be used for student housing, a technology hub and hotels, and Tanner notes that when a plan is finalized, the university will continue to own the property and could potentially realize $1B in private investment. It could also receive funding through revenue sharing with the developers and use that to upgrade Williams-Brice Stadium. Tanner: “We could use a lot more suites and club spaces. We added four club spaces during the pandemic, and that’s been a fruitful investment for us as well.” (link)

UH AD Pezman: “As we inch closer to July 1, we feel the increased excitement and interest from our fans. Fresno State launches the Elevate campaign, a “transformational, multi-year vision for the modernization of Fresno State's athletic facilities, including Valley Children's Stadium and other venues.” The estimated goal for the campaign is $250M, and in addition to significant renovations to Valley Children’s Stadium, the campaign plans to support a fully renovated and expanded Duncan Athletic Building; a renovated Ricchiuti Academic Center; an expansion of the Ricchiuti Strength and Conditioning Center and more. Iowa Racing and Gaming Commissioner Director Ohorilko tells Action Network there is no evidence of suspicious wagering activity involving any Iowa or Iowa State sporting events. “We review the types of wagers that come in and how suspicious they are. We have no reason to believe that there’s anything like that here.” As such, betting markets on the Hawkeyes and Cyclones are expected to remain open unimpeded. Ohorilko says he is unaware of any wagers Iowa and Iowa State student-athletes or staff may have placed, noting that the state’s auditors combed through wagering data across the Iowa and Iowa State marketplace and found no evidence of malfeasance. The Biden administration is inviting dozens of NCAA men’s and women’s national championship teams to College Athlete Day at the White House on June 12. The announcement comes the day after the Biden White House invited Connecticut and LSU to celebrate their men’s and women’s national championships on May 26. (link)

Summit League Commissioner Fenton interprets a recently passed law in North Dakota that prohibits transgender athletes in K-12 and in college from competing in championships within the state to be limited to those who compete for teams sponsored within North Dakota. However, Representative Koppelman (R-West Fargo), one of the bill’s co-sponsors, contends transgender female athletes from outside the state of North Dakota would be barred from competing under the legislation. Koppelman: “If a college athlete from another state wants to come here, when they’re playing in North Dakota, this law would govern us. You would only be allowed to play in the division of sports that matches the sex at birth. … The NCAA has greatly punted on the issue. They’re deferring to the rules of each irrespective [sic] sport.” Fenton remarks that “obviously we’re not in the business of breaking the law,” but adds: “We want our environments to be as inclusive as they can be for any and all that are able to participate.” (link)

Missouri lawmakers have revised the state’s NIL law to allow college coaches to “identify or otherwise assist with opportunities for a student athlete to earn compensation from a third party for the use of the student athlete's name, image, likeness rights.” The amended legislation also allows in-state high school recruits to start earning endorsement money as soon as they sign with in-state colleges. The measure also adds a provision that states the new bill “shall not be construed to qualify a student athlete as an employee of a postsecondary educational institution.” Tigers AD Reed-Francois, Football HC Drinkwitz, Men’s Basketball HC Gates and others visited the state capitol to support the law’s passage. Under Armour’s Q4 earnings and revenue beat analysts’ expectations, but the company’s guidance for the next fiscal year fell short of Wall Street’s consensus. Revenue for the quarter was $1.4B, up 7.5% YoY. Full-year sales reached $5.9B for a YoY increase of 3.1%. Revenue is expected to be “flat to up lightly” in FY24 with earnings forecasted to range from 47 cents to 51 cents, well below analyst expectations of 61 cents. CEO Linnartz: “Fiscal 2024 will be a year of building for the brand. We must deliver better for athletes and our customers, and meaningfully increase returns for shareholders in the years ahead.
