Former Southland Conference Commissioner Burnett, who now runs Southwest Sports Partners, joins D1.ticker/Connect’s Eargle to talk about the modern path to the commissioner’s chair, along with thoughts on key industry developments. Burnett: “We don’t know what we don’t know about NIL yet. We’re only two years in. I see NIL as mostly transactional and that’s ok. I feel like NIL moving forward needs to be more inclusive of the larger range of services we can provide student-athletes. It’s not just about the appearance paycheck. I think there are some education and professional development opportunities that can help student-athletes more holistically than just the transaction.” Also: “If we can settle in with conference realignment, it will allow the commissioners to work with their presidential groups, their athletic directors and coaches, that will go a long way in the conference model of administration.” Lots more. On3’s Wittry takes a look at Western Michigan's & Kent State’s recent MMR agreements with Van Wagner to review how some departments are attempting to safeguard their IP amid the proliferation of NIL. In the Broncos case: “Western Michigan agreed that it shall not permit athletes who enter into an NIL deal to use any university marks or IP in connection with their agreement unless it’s with a Van Wagner sponsor that’s authorized to use those marks.” Alternatively, Kent State: “...the university agreed that it ‘shall use commercially reasonable efforts to ensure that its processes with regard to Student NIL protects the rights granted to Van Wagner under this Agreement.’” That “process” for the Golden Flashes includes a “set of clearinghouses” - which includes Van Wagner’s review - before IP approval for the student-athlete. Further, Kent State has the ability to renegotiate the deal if there’s a “change in applicable law.” Kent State Asst. AD for Athletic Communications Griffin: “That’s why those clauses are in there. We don’t foresee anything happening but you never know with those ever-changing laws and basically NIL adapting as things go on.” More. (link)

Beaver Stadium will keep its name, says Penn State AD Kraft, despite the $700M price tag for renovations. Kraft: “Beaver Stadium’s not on the table (when it comes to naming rights opportunities).” The intention is to keep capacity at a minimum of 100K, though Kraft would not share further specifics. Phase One, which costs $70M, will begin in the next few months and “will include priority maintenance projects, architectural and design development and winterization, which will allow the stadium to be used when temperatures are below freezing for events such as a possible College Football Playoff home game starting in 2024.” The athletic department will fund the entire renovation. San Diego State will raise men’s basketball season ticket prices by an average of 5%. The only area that topped 7% is the newly created bench seating on the sidelines at the top of Viejas Arena, which jumped 25% from $199 to $249. Bench seating behind the baskets on the upper benches went from $199 to $209. A courtside season ticket in the first eight rows costs $940 for the ticket plus $1,575 to the Aztec Club — a total of $2,515. For comparison, those seats cost $2,395 last year, representing a 5% hike. This is the eighth time in the last decade that the Aztecs have raised ticket prices for men’s hoops. (link)

Oklahoma AD Castiglione on the idea of a Sooners softball game being played at Gaylord Family - Oklahoma Memorial Stadium: “We're always looking at new ideas. We actually looked at this before, it's not original ... We're going to look at other places, who knows where that might be. Maybe it's not this stadium, maybe it's another stadium somewhere else where we can create an event. … It's very different to set up a volleyball game versus a softball game. ... But we have some other work we're considering doing in the near future ... So it's all a part of the feasibility study. But I love the out of the box thinking, that is part of the characteristic of Oklahoma's athletic program.” (link)

More from the New Mexico State men’s basketball situation as former Aggies student-athletes Odunewu & Benjamin told ESPN the fifth-grade practice of “pantsing” members of the program included not just fellow student-athletes, but also coaches. Benjamin: “After the [game] at UTEP, when we lost, they pantsed one of the assistants. [...] [Other coaches acted] like they didn't see it.” Benjamin’s father, William, is in NMSU’s Hall of Fame: “At first I just asked him, like, if he was experiencing the same things I was when he was in college. The Charlotte Observer’s Janes deep dives into how Queens’ move from Division II to Division I is going, nearly a year in. Royals Assoc. AD for Strategic Planning and Leadership Development/Director of Swimming Operations Dugdale: “The very reality of everything, is that — whether we went to Division III or Division I — that a group of people, this would not have been what they bargained for. Because they came for something different. It’s not all roses. But it’s not all thorns either.” President Lugo: “No one wants to be a ‘best-kept secret.’ There’s zero future in being a best-kept secret, and in many ways, our athletic department was a best-kept secret. Not anymore. ... There’s much more interest in what is happening at Queens. … This is a long-term play. It is about building an institution that’s worthy of more attention. It’s about building an institution that wants to have a much more diverse reach of students that we can enroll and recruit. ... One day we’d love it if it broke even.” Of note, new student enrollment is up 30% for the fall 2023 semester and according to Lugo, applications from major cities near ASUN schools — Atlanta; Jacksonville, Florida; Nashville — have increased by more than 40%. We see that as a huge priority from an equity perspective and continuing to grow the game perspective for both our NBA and WNBA business.” That’s NBA SVP and Head of Youth Basketball Development Krichavsky at the Jr. NBA Conference in New York City this past week. He continues: “The momentum that exists in women’s basketball at the WNBA level and the NCAA level, with the record viewership and engagement they had around this year’s NCAA tournament, is absolutely trickling down to the youth level. We are very much trying to seize that momentum to grow girls’ participation. Women’s basketball is surging, and we’re working hard to capitalize on that momentum.” (link)

Student-Athlete Insights is launching an NIL/mba, which has two courses starting later this month. Taught through a weekly Zoom lecture and discussion, the course costs $1,250. Vermont Professor/Student-Athlete Insights Founder Carter: “What I recognized in the last year is that almost every time, like clockwork, within a couple of days, I would get a call or two from just one or two of those 50 to 75 people that were in the room. Those people would say, ‘I learned so much, it was really great. But I’m working on this thing. Now what do I do?’ And then it was this recognition that I had, which is the workshop is really great. For the majority of people who either don’t really need to focus on NIL, it’s part of their job, but it’s sort of on the periphery. But if you really needed to get into the detail because you were building something, or creating something or investing in something, those one-hour workshops don’t go that depth.” (link)

More details connected to the NCAA’s selection of Endeavor to review its media rights positioning, which was initially reported back at the end of January, comes from a recent DIII Presidents & Management Councils summary: “The consultant will engage with the membership over the next two months to determine priorities and desired outcomes before delivering a preliminary strategy consideration report to the NCAA Board of Governors in April 2024 and a final report by the end of June, with process recommendations and next steps anticipated by the end of July. (Presidents) Council members noted the anticipation surrounding these negotiations given the confluence of increased media and fan interest for women’s sports, particularly basketball, volleyball (indoor and beach), gymnastics and softball.” (link)

SBJ’s Mullen reports mega-agent & CAA headliner Sexton has “submitted a declaration on behalf of the NCAA and college conferences” in the House v. NCAA case. In a nutshell from Sexton on how the plaintiffs are proposing to distribute process to student-athletes based on league & sport: “If broadcast revenue sharing is permitted in college athletics, agents representing star football and basketball players would not advise their player clients to accept the same payment as a player of less talent, ability, and value on the field of play -- and star football and basketball players would almost certainly refuse to enter into such a payment structure. I would anticipate a significant amount of litigation ensuing from star players who would not want to participate in such a revenue sharing process.” (link)

AAC Commissioner Aresco received $2.08M in compensation in FY22 as the league recorded $188.24M in total revenue in FY22, which was a 94% jump from the year prior. Per the Orlando Sentinel’s Murschel: “The increase can be attributed to several factors, including a surge in media rights money from $52.15 million in 2020-21 to $65.24 million in 2021-22. Another significant source of income comes from $51.5 million in exit fees, with the Big 12-bound schools UCF, Cincinnati and Houston paying $18 million each for their early departures over the next several years. The University of Connecticut is still paying its $17 million exit fee for leaving the AAC for the Big East in 2020. In addition, the conference received $17 million in entry fees from six new teams joining in July: UAB, FAU, Charlotte, North Texas, Rice and UTSA.” In return, the league distributed $93.83M ranging from Cincinnati at $11.32M down to Wichita State at $2.17M. Wake Forest has received its largest cash endowment commitment from the Lyons family to endow the Men’s and Women’s Golf Associate HC positions. Executive Assoc. AD for Development and Sales Faircloth: “The incredible impact on current and future student-athletes in our Wake Forest golf programs cannot be overstated after this incredible commitment by the Lyons family. This endowment gift allows both golf programs to enhance investments in performance training and technology, provide additional summer school and academic support, and recruit at an elite level.” Since launching in 2018, Wake’s Athletics Excellence Funds have brought in over $30M in annual operational support. A notable proposed rule changes from Men’s Basketball Rules Committee: Defenders must have established position when an offensive player plants his foot to go airborne to draw a charge. Previously, a defender could establish position as an opponent goes airborne. Committee Chair & Tennessee HC Barnes: “Our goal is to try to reduce the number of charges that are called," said Rick Barnes, the committee chair and coach at Tennessee. "We want to give more time to the offensive player to adjust to defensive player movement and reduce the hard collisions that are taking place.” Among other recommendations: Student-athletes can wear numbers 0 - 99, airborne timeouts can be called by players with possession of the ball, nonstudent bench personnel would be allowed to serve as peacekeepers when an altercation occurs, more. The NCAA Playing Rules Oversight Panel will review the proposals on June 8. (link)

On the Women’s Basketball front, the Women's Basketball Rules Committee proposed that “players judged to have flopped would be issued a warning on the first offense, with a technical foul being charged for any subsequent infractions. Under the recommendation, the second and any subsequent flop calls would count toward the team foul count but would not count toward a player's five fouls leading to disqualification.” Also notable, the Committee suggested moving the restricted arc to directly under the basket. Stinson: "We accomplished a tremendous amount in my first stint, but during my time away, I felt there was more we could accomplish and I wanted to see it through. I learned a lot during my time away and, with this evolved perspective, I know we can remain focused on our quest to become a premier NCAA Division II program and continue to provide the best experience in college athletics for our student-athletes, coaches, alumni and supporters. Penn State’s Board of Trustees signed off on the first $70M to renovate Beaver Stadium, which The Athletic’s Snyder notes is “the first step forward for the long-awaited renovation that is slated to not exceed $700 million.” Nittany Lions AD Lyons: “The additional revenue generated throughout the renovated stadium will not only offset the costs but also enhance our overall athletics budget in the future. … We expect to see significant revenue in sponsorships and third-party contracts, all of which enables Penn State Athletics to remain self-sustaining.” (link)

Montana has broken ground on its $10.2M indoor practice facility, which will include space for FB and soccer, six sprint lanes, pickleball courts and more. Grizz AD Haslam on the privately funded project: “The facilities that our student-athletes spend really 90% of their time [are] in locker rooms, training rooms, academic centers, practice — that’s where they spend the bulk of their time. And so investing in those facilities has always been the top of what we’ve wanted to get done. […] There is a rental contract. We gotta generate revenue off of this to pay for the operations and maintenance of the facility. We’ll have rental opportunities for the community soccer and lacrosse and different community-based members. And there will be just intramural time that they can use for flag football, or ultimate Frisbee or any of those types of things.” (link)

They’re always going to be being paid to coach the group of people who we, as a society, devalue.
