LEAD1 CEO McMillen breaks down the current state of federal NIL legislation, noting the GOP-controlled House of Representatives is likely to pass a skinny bill to “avoid other committees with possible jurisdiction.” Meanwhile, U.S. Senators Tuberville (R-AL) and Manchin (D-WV) are attempting to negotiate a compromise bill, and McMillen explains such a bill would “likely include some of the provisions the House avoided.” As such, passing a bill in the Senate “may need to include other provisions, such as a medical trust fund, increased Title IX penalties, a Congressional Committee to study Title IX compliance or eliminating the tax deduction for donations to collectives. … The challenge, of course, is that the employment issue is looming and outstanding court cases and California pending legislation may accelerate the timetable for additional Congressional action on these matters. Based upon the House hearing, it is evident that there are a minority of House members who would support an employment model. The issue is that if the courts or California move forward on employment or revenue sharing, the Congress will have to act with speed to overturn such action. Given the difficulty passing an NIL bill, stopping an employment model would be a challenge.” (link)

CBS’ Dodd catches up with former Arizona State swim student-athlete House, who opens up about his decision to join an antitrust lawsuit against the NCAA. House explains he was inspired by music students in ASU’s honors college who were allowed to get paid to play Carnegie Hall. “I always thought it was interesting that…if [those musicians] can monetize this, take it to the farthest reaches, I couldn't because I was an athlete doing my own aspirations and dreams. … That just didn't sit well with me and confused me a lot." House was approached to be part of the lawsuit during COVID-19 after a practice in 2020 when teammate Smith was on the phone with her mother, who happens to be an attorney with Hagens Berman, a firm which has a “notable history with the NCAA.” House: “It was really interesting to be approached…and having Alston pass during the very beginning stage of this suit to the point the NCAA's hands had to be forced to make changes.” House goes on to dismiss arguments against NIL based on its impact on a locker room, saying: “I blame that on the culture. I don't blame that on NIL. If your culture is that fragile, that weak, you as a university need to fix that." More from Dodd. (link)

+ Memphis AD Veatch on the Tigers’ NIL efforts as they relate to men’s basketball: “It has some momentum, and we’ve done OK. But it’s not near where it needs to be. If we want to be successful and win at the level that we want to and that we’ve been accustomed to here at different times, then we’re going to have to see more and more investment in NIL in a pretty significant way. … Two years ago, things shifted completely. That is a challenge. Cal State Fullerton’s elephant mascot, Tuffy, will undergo a redesign, per the Daily Titan’s Orta, who reports the trademark registration on the old, animated Tuffy will expire in 2027, at which point it will be replaced by the new Tuffy, making that three Tuffys in one sentence – four if you count that last one. Orta also notes the redesigned Tuffy will be drawn as a “friendly cartoon version with a thicker black outline.” The application for the new Tuffy trademark is in the approval process with the university. Iowa State Wrestling HC Dresser comments on the investigation into alleged gambling by student-athletes: “To be quite honest, there’s a part of me that thinks – and I’m usually one to say what I think – part of me thinks there’s a little bit of witch hunt. But at the same time, I also know there’s rules, and if they didn’t follow the rules, there’s going to be penalties. … I also look at it in the big scheme of things. These guys didn’t assault anybody. These guys didn’t get a drunk driving (offense). It’s another example that Division I athletes are held to a different standard than the average college student. It sure would be nice, sometimes, if our athletes could just be college students.” (link)

Fanatics Betting and Gaming CEO King tells CNBC the cost to enter new betting markets has declined between 40% and 50% compared to where it was roughly three to five years ago, adding: “We’re really able to save tens of millions of dollars worth of upfront license fees by leveraging PointsBets footprint versus going at it with a new footprint.” Further, King believes more consolidation is on the way for the industry because “there really is no new capital kind of coming into this category. Anybody without a sustainable business model is going to be ripe for an acquisition.” (link)

Peacock will carry one NFL playoff game exclusively on the streamer this season, the Wall Street Journal’s Flint and Toonkel report, adding that the deal is believed to be worth $110M for the NFL, although terms have yet to be disclosed. The playoff game will take place on January 13. NFL Media EVP/COO Schroeder says this “will be transformative for sports on digital,” adding that talks with NBCUniversal intensified this spring and are part of the league’s efforts to attract younger viewers as well as cord-cutters. Realignment Rumblings…
+ Sports Illustrated’s Dellenger with a bunch of observations, starting with the Pac-12’s and Big 12’s “near-yearlong realignment buzz surrounding these two conferences—will Pac-12 members defect to the Big 12?—is entering what appears to be its final chapter.” The larger story, Dellenger continues, is yet to be written, as he asks “How do the Big 12, Pac-12 and ACC keep up competitively while generating millions less than college football’s two behemoths? Some believe all three of them cannot coexist successfully.”
+ Notre Dame AD Swarbrick, for instance, remarks: “The big next issue is, can we keep the perception of college athletics as involving all of us? Or, does the Big Ten and SEC become college athletics in terms of popular perception, and, if they do, how does that influence shape the future of college athletics?”
+ As the Big 12 and Pac-12 battle to the west, Dellenger notes the ACC is dealing with a rebellion from within, as seven schools have “coalesced over what many of them describe as an untenable situation.” For those schools and for the ACC as a whole, their options are limited to three: seek more revenue from ESPN, secede from the league, or create another league. “If the seven agree to dissolve the current grant-of-rights agreement (we don’t know yet if this is a possibility), they may add a couple of more schools and begin their own association in hopes of it being more lucrative. This comes with its own issues, of course. You’d need a broadcast partner or private equity to fund such an endeavor. And, as one official asks, ‘Will it really be that much more lucrative?’”

+ One Big Ten source tells The Athletic’s Auerbach that as the ACC situation unfolds, Florida State, Clemson, Miami, Virginia and North Carolina are “where the real value is,” adding that it makes more sense for the Big Ten to expand further down the eastern seaboard than the Pacific Northwest, “which has not had nearly enough support internally or among the league’s media partners since the idea was first broached.” (link)

More from former FAU President Brogan on his experience with LIU Senior Deputy AD/former Owls AD/Hawaii AD finalist Angelos, as Brogan tells KITV: “When he was at Florida Atlantic University, we had a similar setup where we do a great deal of work with the Florida Legislature here for the non-academic programming, which means working with the leadership and the membership of the legislature. And Craig was very good at that. He's a good people person. He is very intelligent and very articulate. He knows his subject matter in college athletics, that's for sure. … Craig was instrumental in fundraising for the athletic facilities and programming. As a result, we built a stadium of 30,000 seats, which is great for Florida Atlantic University. And much of that is because of his work to lay that ground and ensure we were prepared to move to the next level." (link)

The format of the Big Ten football schedule remains unsettled, and Illinois AD Whitman tells The Athletic’s Dochterman he’s not sure of the timeline for deciding on one. “We know that we’ve got to make some decisions here at some point, but I don’t know if that’ll happen this next week or in subsequent weeks.” Meanwhile, Dochterman reports that “there appears to be very little appetite within the league for the continuation of a two-division structure” once USC and UCLA join. Iowa AD Barta says he feels comfortable with the options being considered. “Either way, by adding the two schools we’re adding, whatever version we come up with, the competitiveness of the Big Ten has gone up. There’s never been a night off. Now you’re adding two more schools, and they’re going to make it even that much more challenging.” More. (link)

Missouri State AD Moats talks about the challenges of trying to increase hoops attendance, noting that he's made changes to ticket prices in different sports before that didn't create much of a difference. Moats also says he’s aware that different fans have different reasons for not attending games, and they can range from the game day atmosphere and the lack of postseason success to the lack of roster continuity in the transfer portal era. He’s most often asked about strategies for increasing student attendance and says: "It makes a difference when they're there and it changes the environment. We continue to try to keep figuring out what's going to get them there on a consistent basis — not for just one or two games. I wish I could tell you the answer but we're trying. It's not like we're twiddling our thumbs. With the things we do, we've just got to figure out how we can do it better. It's easy to say and hard to do. We've already met once or twice and we'll meet more in the offseason and you'll see some different things — probably a lot of different things as we move forward and hope people come out and see what those changes are." The Athens Banner-Herald’s Weiszer reports Georgia’s FY24 budget will be roughly $173.6M, up from last year’s total of $162.2M, if approved by the UGA Athletic Board this week. Revenue increases would be the result of increased donations to the Hartman Fund for football as well as “donors vying for position during the seat selection process,” according to Bulldogs Deputy AD for Finance Ransom. UGA is also expecting a 40% increase in revenue from men’s basketball. The budget also shows a cost of living adjustment for staffers with staff benefits increasing by $1.1M. Ransom: “The budget reflects we’ve been impacted just like everybody else by inflation. There are increases across travel, nutrition, utility, plant operations, facility maintenance and squad travel and other areas.” (link)

Kansas State is in the process of upgrading Ahearn Field House, which will serve as the track & field team’s indoor home now that the Wildcats’ football team has its own new facility. The upgrade will bring all of K-State’s teams with the exception of golf to within walking distance of Bill Snyder Family Stadium. On facilities overall, Taylor says: “I think we’re gonna be done with major facility renovations for a while. I think we’re gonna give our donors a little bit of a break, which they’re probably pretty happy about, kind of refocus them a little bit and have them, you know, understand our needs from an operational dollars perspective.” (link)

Kansas City has issued an RFP as it considers the possibility of developing a 5K-seat arena for men’s and women’s basketball and volleyball. Roos AD Martin: “This RFP creates a tremendous opportunity for UMKC to create a new gateway for the campus to engage with the Kansas City community. Athletics is a critical component of this project, which will certainly enhance our facilities and position us well with our peer institutions. It will empower our athletics department and offer a tremendous experience for our student-athletes, as well as our student body, fans and community supporters while increasing the visibility of UMKC as the premier university in the region." Extra Points purveyor Brown shares some thoughts on Notre Dame’s apparel partner prospects, noting that Under Armour, while not totally out of college yet, has lost a significant amount of staff with strong connections to college sports. “Industry analysts have told me that UA has not really replaced the managerial talent that focused on college relationships over the last few years. Still, it isn’t totally accurate to say that UA is no longer interested in college athletics. … The experts I’ve talked to said that Under Armour shouldn’t be completely counted out, and that the company will fight hard to keep Notre Dame in their portfolio, even as Nike and Adidas (and potentially Jordan Brand) are expected to get into the mix.” More. San Diego State men’s basketball student-athlete Butler, who has entered the NBA Draft but not the transfer portal, received more than 10 NIL offers from representatives of other schools, according to his father, Lamont Butler, Sr., who tells the San Diego Union-Tribune’s Zeigler: “The most was $1M, a couple $500,000s, a couple $300,000s, a couple $175,000s. At the end of the day, most people would jump at that. … My son, he wants to be an Aztec. He’s an Aztec for life. Lamont never wanted to go, he just wanted to make sure we were taken care of.
