NCAA President Charlie Baker talks with Sports Illustrated’s Pat Forde about his student-athlete compensation proposal and doesn’t dispute that it’s at least in part a way of signaling to Congress that college sports is being proactive. “I’m working on the theory that not just people in Congress, but people in and around college sports, who would like to see the NCAA chart a course here, create a direction. I certainly heard from a lot of the folks I talked to who said, ‘You all need to be forward-facing if we’re going to make progress here.’ Which I understand.” The proposal has already achieved its goal of sparking a conversation, and Baker tells Forde: “One of the best parts of this, I’ve already had people reach out to me and say, ‘What about doing this instead?’ The one thing I said to people when I was talking to them, I said, ‘Don’t say no.’ People have already started to take that idea and propose alternatives to it—which is fine. That’s kind of the whole purpose of it. I’ve seen very little pushback. The big message from almost everybody was, ‘Thank God we’re finally talking about the elephant in the room.’“ Baker goes on to remark: “I’m very anxious to make sure that when we come out of this, we don’t lose all the sports that are the so-called non-revenue-producing sports. I want those to continue to be a big part of the show. But at the same time, we’ve got to recognize—especially at the highest-resourced institutions—more has got to be done here.” (link)

“I think there's a lot of conversation about collegiate athletics in this country right now and we are adjacent to those conversations in some ways, but they're not really about us. The things that get the most headlines, that's not who we are and making sure people understand that Division III exists. This is another opportunity. We are college athletics, we are just as competitive and we have students who can compete at any level. That's probably a big problem for Division III. How do we keep getting that message out because I think we all know, we're pretty terrific.” That’s NCAC Executive Director Keri Alexander Luchowski on the biggest issues facing the division. Luchowski on creating the family atmosphere of the league: “I think being intentional about that is really important. It's part of our mission. Every sport is treated equally. There are no premier sports, we don't tier sports. Every single sport from the beginning, men's sports equal to women's sports, field hockey equal to football, take your pick, cross country swimming, whatever it is, we treat all sports identically and that's important. It doesn't mean we do the exact same things for every single sport, but it does mean that they all get treated with the same respect and value.” More. (link)

Transfer Tension:

+ U.S. District Court Judge John P. Bailey has granted a 14-day temporary restraining order prohibiting the NCAA from enforcing its transfer waiver rules. The TRO also prohibits the NCAA from enforcing its rule of restitution, which allows punishment for playing athletes who are later deemed ineligible. During the hearing, West Virginia (DI) men’s basketball student-athlete RaeQuan Battle compared his “NIL contract” at WVU to an employment contract and argued the NCAA is preventing him from accessing his full payment. “I’m not going to get what I signed for.” A full hearing is set for December 27. + As for how many schools will play student-athletes while the rules are suspended, Kennyhertz Perry attorney Mit Winter remarks: “I think it’s unlikely the NCAA tries to enforce its transfer rules against any athletes now. It will instantly get sued. And I think the judge is also likely to grant a preliminary injunction after the end of the TRO’s 14 day period.” Winter also points out that to grant a TRO, a court “has to find there’s a likelihood of success on the merits of the underlying claims. This means the judge believes the state AGs will likely prevail on their claim that the NCAA’s transfer waiver rules violate fed antitrust law.” (link)

+ The NCAA says in a statement to Ross Dellenger that as a result of the decision, it “will not enforce the year in residency requirement for multiple-time transfers and will begin notifying member schools.” (link)

Hartford will add Field Hockey and Men’s and Women’s Tennis to expand its portfolio to 20 sports and begin competing in fall 2025. VP for Student Success/Dean of Students Aaron Isaacs: "The growth and popularity of field hockey in the United States is significant, and tennis is a sport also growing in our part of the country, with data showing this year that the sport has surpassed one million players in New England for the first time ever." Student-athletes are reporting fewer mental health concerns than they did during the height of the pandemic, according to the NCAA Student-Athlete Health and Wellness Study. In men's sports, the biggest drops occurred in constantly feeling overwhelmed (down from 25% to 17%) and being mentally exhausted (down from 22% to 16%). Among women's sports participants, reported mental health concerns were also down in nearly every category, but the decreases were smaller in comparison: 44% of women's sports participants reported feeling overwhelmed (down from 47%), and 35% reported feeling mentally exhausted (down from 38%). When responding to questions regarding their comfort in talking to their coaches about mental health issues, 40% of women's sports participants and 54% of men's sports participants said they would feel comfortable doing so. Those numbers were lower (a decrease of 9 percentage points for women's sports and 8 points for men's sports) than reported in pre-pandemic studies. As it pertains to health and safety educational training, 42% of men's sports athletes and 47% of women's sports athletes reported receiving bystander intervention training. NCAA CMO Brian Hainline: "As schools continue to improve their mental health care services while fostering an environment of well-being, student-athletes will continue to reap the benefits of wellness and mental health care seeking. That being said, we need to understand better the gap in perceived mental health concerns between men and women student-athletes." More from the study. (link)

S&P Global Ratings is projecting a “bifurcated” outlook for higher education next year, with strong institutions faring well and less selective colleges expected to face challenges. According to its report, S&P forecasts operating pressures will increase in 2024 with enrollment challenges and wage and expense growth combining for “weaker” operating margins than 2023. “Although we expect greater economic stresses in 2024, we also expect higher-rated institutions with solid demand will maintain their creditworthiness as they continue to generate positive cash flow and operating margins, thus sustaining their healthy balance sheets.” (link)
