NCAA President Charlie Baker says he won’t put a deadline on the NCAA’s decision to accept or reject a House settlement and adds: "The most important part about the settlement – and let's face it there's still a lot of work to be done there – the most important part about it is to create some clarity and some sort of visibility on a whole bunch of issues that have been roiling everybody for a while. The other thing is it creates predictability and stability for schools. It also creates tremendous opportunities for student-athletes especially at the schools that are most heavily resourced. And it creates a framework that then makes it possible to then have a different kind of conversation with Congress. So, in many ways, I’m hopeful.” Plaintiffs attorney Jeffrey Kessler, however, tells CBS’ Dennis Dodd that May 23 is growing in importance as the hard and fast deadline for the two sides to reach an agreement. "We've made very clear that the case is going to trial unless it's settled. The reason for having a deadline is that if it's not agreed to, we're going to trial. In that sense, it's our deadline." Also from Baker: “If we can land this thing, I think it gives a tremendous amount of benefits to student-athletes at the highest-resourced programs. I think it creates a lot of stability and clarity for schools. And it makes it possible for all of us to start thinking about what the next act will look like as it rolls out instead of feeling like you’re waiting for the next shoe to drop.” (link, link)

Sports Illustrated’s Pat Forde profiles ACC Commissioner Jim Phillips and his leadership in this moment in time and posits: “The burning question for the ACC is whether an idealist can guide it through today’s cutthroat landscape of college athletics.” Former Duke Men’s Basketball HC Mike Krzyzewski tells Forde: “His values as a leader are needed. But it’s a really tough time. People [in the ACC] have not been forthright in expressing their agendas. They have hidden agendas. Fans would be amazed by all the stuff that is secretly happening in our conference. It finally came to fruition with Florida State, but Florida State’s not the only one looking at different things. It’s a hell of a job right now.” Phillips sends congratulatory messages to every ACC Athlete of the Week in every sport and sends messages of support or celebration to coaches and ADs after tough wins or losses. Forde notes that “some within the league see such interpersonal pleasantries as a sign Phillips is focused on the wrong things.” One AD says: “I don’t think [SEC Commissioner] Greg Sankey is spending time sending out those emails. Jim is incredibly nice, and believes that being nice will get you where you need to go. But it’s not the same as having a strategy. … You’ve got to be so strategic and so aggressive in this business.” Still others defend Phillips, including Pittsburgh AD Heather Lyke, who says: “He’s shifted the mentality in regards to football while maintaining everything that’s great about ACC basketball. Instead of being humble about how great we’ve been, we’re starting to go ahead and brag a little bit.” Lots more. (link)

North Carolina AD Bubba Cunningham opted not to go into depth when asked about criticism from some members of the UNC Board of Trustees, telling the News & Observer’s Andrew Carter: “I really don’t have any reaction. I haven’t talked to anybody. You know I’ve been here the whole time.” Cunningham adds that he’ll “prepare for Thursday'' when he meets with the board. (link)

JohnCanzano.com’s titular publisher answers a question about whether Portland State needs an AD. “Or could a non-profit take over and you have an academic person for the student part?” Canzano: “PSU could outsource some of the development and fundraising. But it still needs someone to run the operations, schedule games, deal with coaches, build future sports schedules, help with NIL, and do all the things that athletic directors do behind the scenes. The better idea is to hire the right person. The Vikings don’t need a search firm. PSU is a nuanced place. Outsiders won’t easily grasp the challenges or know where the money is buried. The school needs to stay local on this one.” (link)

Kansas AD Travis Goff talks with KSNT’s Glenn Kinley about his process of selecting new head coaches: “We call every head coach of the top 50-75 programs in Division I and then we call every head coach at the high end of Division III and the high end of Division II, with the exact number depending on the sport and need.” Doing so, Goff explains, accomplishes several things. “You are getting some insights, you’re getting some recommendations about what we need to do to invest in that program from successful head coaches. The other thing you might get is them raising their hand and saying ‘You know what, I might want to learn more about that.’ That’s not why you’re calling, but that might be one of the outcomes.” Goff says the four HCs he’s hired in Lawrence (Football HC Lance Leipold, Women’s Golf HC Lindsay Kuhle, Baseball HC Dan Fitzgerald and Women’s Soccer HC Nate Lie) “had demonstrated longevity and commitment and some form of loyalty which maybe is less and less common in our industry. Do they really bring to life this notion that ‘KU is special?’ That they feel that, that they want that and this is an aspirational job. More often than not if all those things shine through then I think longevity comes with it once they get here.” Fitzgerald: “I thought KU had an incredible picture of who they were and where they were at, and then a great picture of where they wanted to go. And then for me, I was really looking for something for our family- a place to go and a destination.” (link)

After parting ways with three HCs in his first six months on the job, ULM AD John Hartwell talks about his approach to evaluating coaches: “You know, people think, ‘Oh gosh, in John's previous life he was a CPA. He’s purely looking at the numbers, the wins and losses.’ That is far from the case. It’s got to be about the trajectory of the program and is it moving in a positive direction. So, that's probably one of the biggest factors but another really significant factor…[is that] student-athlete welfare, student-athlete safety trumps everything else. We’re gonna win, but we’re going to win the right way. There are some mistakes that can be recovered from, others that can’t.” (link)

The Georgia Athletic Association Board of Directors next week will be asked to approve a budget in excess of $192M for FY25, an increase of about 10% YoY. The Athens Banner-Herald’s Marc Weiszer notes that “no specific figures were mentioned” in a meeting with the board’s finance committee, “but the SEC distribution also is projected to rise with the addition of Texas and Oklahoma joining the SEC and a new TV deal with ESPN/ABC. An average of about $51.3M was distributed to SEC schools in fiscal year 2023, according to USA Today sports.” Season ticket sales and premium seating areas are expected to bring in more revenue after renovations to Sanford Stadium, but Bulldogs AD Josh Brooks told the committee costs will also continue to increase. “The cost of doing business is going up whether we’re talking about planes, buses, hotels, meals, staffing increases, things like that. It’s just a reality.” (link)

Syracuse professor/Burton Marketing Group Founder Rick Burton and New England School of Business Dean/T1 Agency Partner Norm O’Reilly offer a glimpse at what the future of game-day innovation looks like and note that “food may seem like a simple part of the stadium equation, but increasingly we’re inclined to believe if stadiums don’t manage food temperature, customer service, waiting time in lines and general ambiance, the home team is at risk of not getting valued fans back.” Delaware North VP for IT Amanda Whichard notes that “major league amenities are already coming with free-flow access into the park. I expect technology evolution to instantly auto-calculate fan purchases and enable biometric-based payment methods across all food service and retail outlets. … A fan entering a stadium should be able to select what they want and walk right back to their seat – condensing the transaction phase of the purchase down to a moment. Age verification would occur through biometrics and a digital identity, and the fan would be automatically charged when they leave the venue. Teams could then focus on interacting with fans, offering a customer service-oriented experience that could be very dynamic instead of staff being narrowly focused on executing transactions.” Burton and O’Reilly go on to ask what other innovations could be in store. “Moving sidewalks, massage rooms or sleeping pods (like what we see in airports)? Fewer seats but more recliners (think upscale movie theaters)? … The big question is determining which startling innovations teams must introduce before the home sofa makes the value debate a coin toss.” (link)

MLB is on the verge of implementing an electronic system for balls and strikes, per Newsday’s David Lennon, who reports that system won’t replace umpires but be available should players or coaches wish to challenge a call. MLB Commissioner Rob Manfred: “The technology is awesome. I mean it’s good to a 100th of an inch. It’s unbelievable how accurate the technology is. The technology is viable with any geometric shape of the strike zone. You just tell it what to call and that’s what it will call. The technology piece is really in great shape.” No word on a timeline. (link)

ESPN’s Dan Murphy and Pete Thamel report the “tentative terms” of a settlement in the House case include the “NCAA paying more than $2.7B in past damages as well as setting up a system for its most powerful conferences to share a portion of their revenue with athletes moving forward. One major obstacle to reaching a settlement has been finding a way for the NCAA and its schools to protect themselves from future lawsuits, including potential claims they would be colluding to cap player compensation without using a collective bargaining agreement.” Steve Berman, co-lead counsel for the plaintiffs, tells ESPN he and his team have proposed a solution that would extend the class-action settlement on an annual basis. In this scenario, athletes would receive a notice each year providing them with the opportunity to object to the terms of the revenue-share agreement. Berman explains those athletes would then have the chance to attend a hearing and persuade the judge that the revenue-share arrangement was unfair in order to push for a change. "Each year we would have a hearing where any new athlete who wasn't previously bound [by the settlement] can come and object. They would have to come and say, 'I don't think this is fair.' That would be a hard burden to prove." Murphy and Thamel also report the belief that the power conferences have the majority votes to settle. “The Big Ten is generally on board with settling. The SEC has some detractors of settling but is trending to a majority. The Big 12 is expected to follow along. There's some dissension in the ACC, which has amplified why Florida State and Clemson are suing to leave the league, but sources say it's unlikely the ACC will end up voting against it.” Lots more. Yahoo’s Ross Dellenger reports a settlement in the House case “is expected to feature nearly $2.9B in back damages for former players; a future revenue sharing model with athletes starting at as much as $22M annually per school; and an overhaul of the NCAA scholarship and roster structure. While plaintiffs attorneys Steve Berman and Jeffrey Kessler mostly declined to discuss specifics of the case, Berman tells Dellenger: “As we had [settlement] discussions, they were playing both sides. [NCAA President] Charlie Baker would run to Capitol Hill to say, ‘Let’s pass a bill!’ for complete immunity. Every time Charlie would go talk to someone on the Hill, I’d go talk to someone on the Hill. I was trying to explain why they [NCAA] are not entitled to immunity.” Dellenger notes that “industry leaders describe the next two weeks as, perhaps, the most consequential in college athletics history, laying out a timeline for potential ratification of a deal as soon as the week of May 20.” Kessler: “This is very simple. What’s worse for them? A deal that is negotiated together that everyone, their commissioners and president of the NCAA, thinks will be a meaningful system? Or would they like to lose in court?” If the two sides agree on a settlement, Dellenger notes it could still take several months to conclude the process: “(1) Judge Claudia Wilken…must approve the settlement terms, which ‘should easily be satisfied,’ said Berman; (2) Athletes who are part of the class receive a notice about the terms with a choice to object to any terms or completely opt out of the settlement; and (3) a final approval hearing, or hearings, is scheduled in court.” Kessler says the settlement would not be completed by the start of the academic year. In regards to the settlement’s Title IX implications, Berman says: “It doesn’t impact us. If we have a settlement, we’ll negotiate a system in which athletes will be compensated. The degree in which Title IX applies will be determined [by the courts].” (link)

The Mercury News’ Jon Wilner posits that by adding Grand Canyon and Seattle, the WCC “did more than fortify its ranks. It added the perfect school to carry the conference banner in the event Gonzaga leaves in coming years. … Grand Canyon, which is based in Phoenix, has immense potential in men’s basketball as a private school with deep pockets, the backing of former Phoenix Suns owner Jerry Colangelo and – crucially – no football program. The Lopes, who beat Saint Mary’s in the first round of the NCAA Tournament, possess the wherewithal to attract and sign high-end talent, reach the NCAAs regularly and advance to the second weekend occasionally. … In our view, the Lopes have more potential than Saint Mary’s and will become Gonzaga’s primary competition for WCC supremacy the minute they join the conference.” As for what the expansion portends in regards to Gonzaga’s future in the league, one source tells Wilner: “This has nothing to do with Gonzaga leaving. Nine schools was a death knell. We were too small. It was too hard to schedule.” Furthermore, Wilner notes the Zags lack the support needed within the Big 12 to make a move to that conference. Also: “[Mountain West] Commissioner Gloria Nevarez and her presidents must assess their strategic options in the wake of the WCC adding Grand Canyon and Seattle. A reconfigured conference that includes Washington State and Oregon State — and potentially competes under the Pac-12 banner — might see value in adding Gonzaga. This much seems clear: The WCC’s shrewd decision to invite GCU and Seattle won’t be the final move; more realignment is coming to the West Coast.” (link)

The North Carolina Board of Trustees has approved an audit of the athletic department “amid concerns and anger over the Tar Heels' revenue, management and changes to college sports,” according to WRAL’s Brian Murphy, who adds the board “approved a top line of $134.97M for the department as part of its all-funds budget that is due to the Board of Governors this week, but demanded further discussion with athletics director Bubba Cunningham.” Board Chair John Preyer: "I think it's imperative for the board to hear all of this in closed session. I don't think they understand the level of bad data that has been provided, and I think it is incumbent on us to get it right." Trustee Jen Evans noted the athletic department submitted a preliminary budget proposal with a $17M deficit for the 2024-25 academic year and $100M in cumulative deficits moving forward. "With no plans to address that, to mitigate that, I don't want anyone to think we're talking in code. There are real issues here, a real concern that one of the most valuable assets and something that really generates revenue is not being managed properly. That is the need for the question and answer and that is the need for the audit." Trustee Ralph Meekins defended Cunningham and said that the deficits were forecast during COVID because the school did not cut programs. “I don't appreciate the comments and inferences that the athletic director has not been forthcoming and available when we want to talk to him.” Trustee Dave Boliek said he wants UNC to join a league with higher revenue. "I am advocating for that. That's what we need to do. We need to do everything we can to get there. Or the alternative is the ACC is going to have to reconstruct itself. I think all options are on the table.” (link)

Former Utah State men’s basketball student-athlete Great Osobor has committed to Washington out of the transfer portal and will earn at least $2M this season, making him the highest-paid known player in college basketball. Field of 68’s Jeff Goodman notes the arrangement could be worth as much as $2.2M depending on other deals and adds that “for comparison, the 30th pick in this year's NBA Draft will earn around $2.5M.” The Mercury News’ Jon Wilner: “Good chance we'll look back on Osobor deal as the apex of this era of free market college athletics. Unrestricted movement. Unrestricted payments. Unrestricted everything. Even in the revenue-sharing era to come, athletes might not have it as good as they have it now.” (link, link, link)

The Athletic’s college football staff catches up with several coaches, NIL officials, agents, staffers and players to get the scoop on how NIL and the transfer portal really work. One GM explains how there are ways around making direct contact to gauge the interest of potential transfers: “You can follow a kid on Instagram, you can like his stuff. You know if he’s liking your stuff back that he likes you, or if you follow him on Twitter and he follows you back — the kid is not dumb, that’s happening for a reason. Back a few years ago when people weren’t tampering as much, that’s the way you did it. … I think there are some schools that straight-up just call the kid, text them, talk to them. It’s reckless.” Once they enter the portal, some players report hearing from as many as 60-70 schools. One AC says there are some advantages to recruiting from the portal: “You get straight to the brass tacks of it, right? … Getting them in and out, showing them the depth chart, showing them the opportunities, talking about the NIL aspect and how they can take advantage of that. It’s more of a business model.” On getting deals done, one personnel staffer says the following about players’ representatives: “Some of them are highly qualified agents who are reputable and have history and background of success within the world. Then you have this other group of agents who have no f—ing clue what they’re doing.” One GM adds: “You have to have the balls to say no to the players or stand up to the agents. If you open up your hand, they’re just going to try to eat from it at all times. We had a player who wasn’t very good tell us on a visit he would sign immediately if we promised him $15K a month. Baylor has created a new NIL unit that will be led by Assoc. AD for External Affairs Operations David Kaye, who will take over in a new role as NIL GM. Kaye and his team will be tasked with “properly supporting the NIL efforts of Baylor's student-athletes and the Baylor-focused collective, GXG. The newly formed area will work in collaboration with the NIL Advisory Council and GXG CEO Jon Passavant.” Bears AD Mack Rhoades: "We are excited to officially announce this formally. David has been a key player in Baylor's approach to NIL since its inception and has been working behind the scenes to lead our efforts since this past fall. David is a dynamic presence for us in this space. His work with our coaches and student-athletes has been impactful and continues to further our goals in support of this new and ever-evolving arm of collegiate athletics. The Louisiana House Education Committee unanimously approved Senate Bill 465, which was introduced by Senator Kirk Talbot (R-River Ridge) and acts as a trigger-law that would immediately allow universities more involvement in NIL deals if federal law or NCAA regulations allow it. The bill would also allow schools and affiliated individuals to directly engage in NIL deals if the NCAA, federal government or a court case allows them to do so. Representative Charles Owen (R-Rosepine): I’m for this because it’s to keep us competitive, but…I think NIL is ruining college sports and is absolutely decimating small schools.” Talbot’s bill, which is now headed to the full House floor, would also make financial literacy classes an annual requirement for student-athletes. Libby: “Leaving behind all of the wonderful coaches in all different sports, who mentored, encouraged, and inspired me throughout my years at Iowa will be the hardest part of saying goodbye. I will miss your friendship and unconditional support, but I look forward to the future and bringing all I have learned to whatever new opportunities lie ahead." (link)

Las Vegas will host the 2027 College Football Playoff national championship, while New Orleans, Dallas and Miami are negotiating to host the title games from 2028-30, respectively, according to Action Network’s Brett McMurphy, who is told by one source: “Supposedly, nothing is ever a ‘lock,’ but Las Vegas is a ‘lock' to host the 2027 game. It is a done deal. The College Football Playoff has been wanting to get to Vegas for years. We’ll finally get our wish.” If any of the aforementioned cities for the 2028-30 championships can’t reach an agreement, the CFP has selected Houston, Phoenix and Tampa as backup sites. (link)

Elon has received a $1M gift from an alumnus to jumpstart a $3M fundraising initiative to expand and enhance training and practice facilities for the men’s and women’s golf teams. The project includes improvements to the driving range, renovations to Holland House to create a clubhouse for the programs, and upgrades to the W. Cecil Worsley III Golf Training Center, which will become a dedicated indoor practice facility.
