RedBird Capital Partners and Weatherford Capital announce Collegiate Athletic Solutions (CAS), a “purpose-driven, dedicated capital and business-building platform for public and private university athletic departments.” From the press release: “Anticipating a revenue-sharing model, the CAS platform and capital can help offset incremental, athletic-related expenses and, when needed, right-size operating structures. Understanding that every state has nuanced governance, financial, and legal structures, CAS has developed bespoke programs to meet the needs of both public and private universities nationwide.” Weatherford Capital Founding Partner/former Florida State QB/FSU trustee Drew Weatherford: “We are in the late stages of the competitive divide between athletic departments and programs. The impact of conference realignment, diverging media rights deals, and the advent of NIL and revenue sharing is creating a greater financial divide at both the university and conference level. History has proven that the universities that adeptly invest in their athletic departments consistently win and outpace peer institutions. Our mission at CAS is to offer athletic departments a unique capital solution to invest when and where they need it to compete at the highest level during this tenuous paradigm shift.” (link)
|
Weatherford tells Yahoo’s Ross Dellenger that “no school has said, ‘No, that is not something we would consider.” He also says CAS is in “deep conversations” with a “handful” of athletic departments but declines to name specific schools. At least three power conference ADs have confirmed as much to Dellenger with one AD saying: “If you want to compete at this level, private equity and capital is really important. I’ve been talking to these people for 10-12 months. I haven’t pulled the trigger. But is this what you are going to need to be successful and survive? Yes, it is.” Weatherford reiterates that CAS is seeking neither ownership stakes nor managerial roles within athletic departments; however, he notes CAS would aim to be advisers for presidents and athletic departments in managing revenue growth. Dellenger: “After all, they do have an incentive to see increases in a department’s revenue: They earn a percentage on any new annual growth. Over a 10- to 20-year period, that percentage decreases from, perhaps, 22% in the first few years to 2% by its end, as the firm meets its original principal investment. Weatherford describes this as taking a ‘revenue royalty.’ If there is no revenue growth, the firm doesn’t take a cut.” Weatherford: “They are not mandated to pay us back the money we give them. … I deeply personally believe in college athletics. As an ex-athlete, I owe a lot to it and so does my family. We believe in college athletics. I don’t like the fact that 10 to 15 teams have a chance to win a national title every year. I’d like that to be 40-50.” (link)
|
Sportico’s Eben Novy-Williams and Daniel Libit report CAS is “raising money and is already in talks with a number of other universities” and “plans to initially partner with five to 10 athletic departments, offering $50M to $200M to each.” In an email to Texas Tech AD Kirby Hocutt late last year, Cardinale wrote that the current tumult in college athletics has created “one of the most potentially transformative opportunities I’ve witnessed in my 30-year career in sports.” Novy-Williams and Libit also note CAS has one employee publicly listed on LinkedIn, former Big Ten Commissioner Jim Delany’s son, Newman Delany, who is listed as an SVP. The younger Delany requested from TTU a number of pieces of financial information in order to produce a “tangible TTU-specific analysis as the foundation for a constructive discussion.” Hocutt consequently sent an email to Red Raiders Deputy AD Jonathan Botros asking if he had “concern in sharing this type of general information.” Also from Novy-Williams and Libit: “CAS’ approach is different from traditional private equity, or even private credit. The group does not plan to take an equity position in any athletic department’s commercial venture, nor does it intend to secure fixed payments in return for the upfront capital. Instead, a source said, the deals will be structured with returns tied to new revenue generation.” (link)
|
Sportico’s Eben Novy-Williams notes there is a “misunderstanding in much of college sports regarding the nature of the talks between universities and private equity funds. Yes, schools are looking for infusions of capital, but I expect to see those talks yield significantly more private credit deals than private equity deals. … Private credit is likely an easier sell in public academia, and it would be backstopped via contracted media rights and football ticket sales, two fairly stable income streams for top college sports programs.” He also points out it’s important to know how much money athletic departments would need to borrow before striking a private credit deal. “Overestimating could leave a school with an excess of expensive up-front cash, with needlessly onerous terms on the back end.” To that end, if a House settlement is reached, schools would likely have a better sense of their budgetary needs moving forward, and “for better or worse, that’s likely enough to get the ball rolling on a new era of financing in college sports. The barbarians are at the gate, they’re just waiting for it to unlock.” (link)

ESPN and TNT have reached a five-year agreement for TNT to sublicense select College Football Playoff games beginning with the upcoming season. Specifically, TNT Sports will present two first-round CFP games during the 2024 and 2025 seasons and add two quarterfinal games each year beginning with the 2026 season through the 2028 season. ESPN will present all other CFP games on its platforms as well as continue to manage the sponsorship program for the presentation of the CFP. ESPN EVP of Programming & Acquisitions Rosalyn Durant: ESPN is pleased to sublicense to TNT Sports a select number of early round games of the College Football Playoff, an event we’ve helped to grow – alongside the CFP – into one of the preeminent championships. We’re confident in the reach and promotion that this new agreement will provide as we enter the new, expanded playoff era.” (link)

All 12 Pac-12 presidents and chancellors are expected to approve the terms of the House settlement, according to The Mercury News’ Jon Wilner. Campus CEOs will meet on a video call this week, likely Thursday, and are expected to give their stamp of approval. How the distribution reductions will play out among all 12 institutions with 10 leaving for other conferences remains unclear, but Eric MacMichael, an attorney for Washington State and Oregon State, tells Wilner the House case was “front and center in our thinking. We had to address that. It’s an existential case for the NCAA and all the (named) conferences.” Wilner: “In other words, WSU and OSU were wary of holding the bill for the 10 departing schools. And the 10 departing schools didn’t want to have to pay double damages, with the NCAA withholding their distributions as members of the Pac-12 and their new conferences. Details are murky. But according to an industry source, NCAA officials, conference commissioners and key attorneys have discussed how to handle the damages for schools that are changing leagues this summer. The source says: “The two (WSU and OSU) are not getting stiffed, and the 10 are not getting stiffed — they aren’t having their shares reduced twice.” (link)

Undergraduate enrollment increased by 2.5% this spring, according to a report from the National Student Clearinghouse Research Center. This marks the second consecutive spring that enrollments have increased and it builds on last fall’s 1.2% bump. Inside Higher Ed’s Liam Knox: “Most notably, spring enrollment in bachelor’s programs is up for the first time in four years at both public and private nonprofit institutions—and the 2.3% average growth rate is higher than the fall’s, a rarity. First-year enrollment is up by 3.9% overall, though it fell by 1.5% at private nonprofit four-year institutions. Graduate enrollment was up by 3% this spring, reversing last year’s losses. … For the second year in a row, undergraduate enrollment rose at [HBCUs] as well, and at an even higher rate: 4%, compared to 3.2% in 2023.” This spring also marks the first time since the pandemic that enrollment has increased across all four geographic regions. Georgia (6%) and Kentucky (5%) experienced the highest increases while only Washington and West Virginia had declines of 1% or more. (link)

In every role she has had at GW, she has led with distinction, supporting our student-athletes with warmth, care, and tireless devotion. I am so grateful for the support I have received from President [Julie] Sullivan, each and every one of the student athletes who have passed through our doors, and the committed staff, coaches and administrators, alumni and donors who make this an amazing place. It is time now, to tend to the needs of my family, after 40 years away from home, but I do so secure in the knowledge that Santa Clara Athletics will continue its climb." (link)

House Updates…
+ The ACC has joined the Big 12 as the second Power 4 conference to vote to settle the House and other related antitrust cases. League presidents and chancellors held the vote at their in-person meetings yesterday. ESPN’s Pete Thamel: “Sources have consistently indicated to ESPN that there's little resistance on the conference level, and the NCAA is also expected to pass the settlement measure.” (link)
+ Officials in non-Power 4 leagues continue to voice their displeasure with the proposed settlement terms. One source with knowledge of the meetings among administrators says: “We're way too early in this process, but there's been enough discussion about hard decisions that’ll have to be made. And if it comes back to hard decisions have to be made that negatively impact our student athletes’ experiences and opportunities because [The Power 5] didn't want to take on an additional amount that was a fair, rational amount, then shame on us as an industry.” Yet another non-P5 official wonders: “The big picture question for me – if this is 10-year payment plan, so is that a 10-year commitment that we're all going to be under the same umbrella for 10 years? I don't know. We just saw the Pac-12 dissolve. What happens if another conference doesn't survive the next 10 years? How is that payment schedule then altered?" Georgia State AD Charlie Cobb on the potential fallout: “It's a real simple thing – what's our annual participation number in terms of lost revenues? If it’s several hundred thousand dollars per year, we’ve got to make corresponding changes…and either we're going to find new ways to replace that income or decrease services.” (link)
+ Yahoo’s Ross Dellenger reports that if a settlement is reached, the damages will be distributed unevenly to “thousands of athletes who participated in Division I athletics in the four years before the NCAA lifted restrictions on NIL compensation in 2021. Plaintiff attorneys will use ‘allocation formulas’ to determine how much each former player receives. Some athletes will get an equal share from damages for their use in video games. Others, the more notable major conference college football and basketball players, will receive variable amounts based around the formula.” The formula itself has yet to be disclosed. Also unclear is the number of plaintiffs in the case. Dellenger cites three sources with direct knowledge who believe it will be between 10,000-15,000. “If 15,000 plaintiffs received equal shares, the average payment per athlete is about $180K over 10 years, when not excluding attorney fees.” Plaintiffs attorney Jeffrey Kessler declined to reveal what kind of attorney fees will be associated with the settlement, but Dellenger cites two sources who say the figure will be north of $100M. (link)
+ While the House settlement appears to be gaining momentum, USA Today’s Steve Berkowitz notes a fourth antitrust case, Fontenot v. NCAA, presents a potential legal hurdle. A hearing in the case is scheduled for Thursday before U.S. District Court Judge Charlotte Sweeney in Colorado who is considering the NCAA and conferences’ request to have the matter transferred to California, where it likely would be folded into the House, et al. settlements. Lawyers on both sides of the House settlement believe the case will ultimately be moved to California, but if it’s not, plaintiffs attorney Garrett Broshuis, says in a filing that “it seems likely” that one of the plaintiffs “will opt out of any such settlement to continue to litigate their claims in this case … Plaintiffs expect that many other athletes will opt out as well and could seek to join this case to seek better and fairer terms for athletes.” The filing also described those reported terms as “alarming” and claimed that would involve “the displacement of one artificial cap on revenue sharing for another artificial cap.” It also took issue with the proposed damages payment amount and the impact of a 10-year payment plan on the present value of the proposed total of nearly $2.8B. Plaintiff’s lawyer Steve Berman: "These lawyers have sour grapes over coming years late to these issues and not being at the table. What their pleading fails to address is that the settlement will resolve their claims such that there is nothing left to resolve in Colorado.” More from Berkowitz. (link); Full court filing. (link)
|
North Texas AD Jared Mosley talks about publicly voicing his displeasure with the House settlement on X earlier this week and tells the Denton Record-Chronicle’s Brett Vito: “There are a lot of people talking about it. It’s not just me. If you stay silent in these situations, no one is going to come back to the table. At some point you have to voice your frustration and do your best. You are starting to see people ready to circle up and have conversations about what parts of this we can take into our hands and control our destiny instead of waiting to have it dictated to us what our new world is going to look like.” Mosley goes on to observe that the “Power Fours are looking at $1.4M to $1.5M a year. That is nothing to them. The proportionality is disappointing and frustrating. The schools at this level did not drive us to this place.” (link)
|
Auburn AD John Cohen talks about the Tigers’ new apparel partnership with Nike and says of student-athlete involvement: “Student-athletes are like everybody else, they all have preferences. Many of them did talk about how certain shoes, certain equipment fit them personally. And we listen to that as well. I will tell you that if we brought 100 of our athletes in this room, you’re not going to get a consensus. Our student-athletes gave us great information about the product on both sides. We listened.” Cohen on influences from other programs: “We’re not going to make decisions based on what others around us are doing. Under Armour worked for us for a long time. And again, we won championships in Under Armour. This was an internal decision, not necessarily a decision influenced by anybody around us.” (link)
|
Nebraska Football HC Matt Rhule believes reducing roster sizes would be an “awful thing” because “for every player that ends up with a with a high-end commercial, there's 100 players that are becoming better people by having played college football and being part of a team. And those are the people that usually end up running our country, running our corporations, running our businesses. I mean, we spend all this time talking about what great things college football does, and now if we take it away from a bunch of people, I would really really be sad. What I don't want is I don't want a world in which because we're playing the 17 games to win the national championship, which I’m all for, I don’t want teams loading up on seniors and juniors only. I don't want high school recruiting to die. I don't want walk-ons to die. … I hope the people that are making these decisions don’t forget about access. We need access for young people that really need it.” (link)

The Toledo Blade’s Dave Briggs analyzes former Toledo Football AC Craig Kuligowski’s $10M lawsuit against the university and acknowledges he “can’t speak to exactly what happened and how his dismissal was handled procedurally. Maybe a smoking gun will emerge. But the larger, more sensational charge of reverse racism in the Toledo athletic department strikes me as insulting as it is flawed and reductive. First, it is hard to imagine UT was looking for a reason to dismiss Kuligowski.” While Kuligowski’s “ego could be a handful,” Briggs notes that “no one could deny Kuligowski loved his alma mater and was a good coach. What’s more, he had just received a two-year extension in March 2022 and was celebrated as a member of the ‘22 class of the school’s athletic hall of fame. All the while, UT was cooking up a reason to dismiss him? That feels like quite the reach, and the reputed reason why feels like an even longer one.” Briggs goes on to characterize the “suggestion that UT athletics discriminates against white employees” as “laughable” and points out Rockets AD Bryan Blair has hired four HCs since his arrival, all of whom were white and two of whom were over 40.” Furthermore, there are 15 athletic department staffers with Asst. AD or Assoc. AD in their titles, 14 of whom are white, and Briggs notes: “These are just facts, not a commentary.” (link)

The Southern Conference has chosen Boost to be its website provider. SoCon Commissioner Michael Cross says when he took over in the role he wanted to ensure the conference was “engaging in good storytelling, engaging in the best communication mechanisms possible and moving your agenda and your messaging to the public and recruits and student athletes and their campuses forward in a really meaningful way.” Cross adds: “Every time we talked to [Boost], we came away really impressed with their forward-thinking approach to a whole variety of things.” Boost Co-President Nate Schnader: “What this will really look like is a completely updated, modern website platform. That platform itself will have things like user accounts and AI-generated content, AI-video clipping, the ability to show specific fans tailored advertising and content and commerce opportunities. It will also enable their staff to do much more with less, not only just the AI components with the automated writing and videos, but also, we really modernized a lot of the administrative things around Player of the Week voting and annual voting, which is a big part of what a college conference does.” (link)

Colorado Governor Jared Polis has signed into law a bill requiring public colleges and universities to submit reports outlining the transfer credits they accept and reject. Called the Institution of Higher Education Transparency Requirements, the law is designed not only to enhance transparency on colleges’ transfer activity, but also guarantee that more courses count toward students’ majors when they transfer from a community college to a four-year institution, or between in-state universities. Senator Janet Buckner (D-29), one of the bill’s co-sponsors: “This new law is a pivotal step towards creating a more inclusive, transparent, and student-centric higher education system in Colorado. By prioritizing the needs of students, we can pave the way for greater educational outcomes and economic mobility for students and families.” (link)
